A: ', The Honorable City Council Steven Kueny, City Manager �/ C April 15, 1988 SUBJECT: CONSIDER ABANDONMENT AND SALE OF CERTAIN PARK LAND LOCATED IN THE CAMPUS PARK AREA OF THE CITY (APN: 500 -0- 281 -073) LOCATED WEST OF THE HAPPY CAMP DRAIN AND TRACT NO. 2453 On March 16, 1988 the City Council adopted Resolution No. 88 -457 declaring its intention to abandon the subject property and pursuant to Government Code Section 38501, et. seq. setting April 20, 1988 as the public hearing date to consider the matter. As you are aware, this is a necessary formal step to sell the property. The Council conducted an informal public hearing on October 21, 1987 concerning sale of the subject site to Varsity Park Estates (US Condo /A &R Development). Notices were mailed to surrounding property owners. No testimony was given at that time. As you know, the subject site was inadvertently included within the boundaries of Tract 3049 at the time of its tentative approval. To avoid a dispute and resolve the matter, a Settlement Agreement was approved to sell the property to Varsity Park Estates for $151,200 as a prerequisite to Map Recordation for Tract 3049. STAFF RECOMMENDATION It is recommended that the City Council make the following findings and abandon the site for park use: 1. The public has not used the land as a park; 2.
