Richards, Director of Community Development January 10, 1989 (CC meeting of 1/18/89) SUBJECT': TRACT 3953 -3 (GRIFFIN HOMES) - REQUEST FOR CLARIFICATION OF CONDITION NO. 20 OF THE COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS Eiackclroulid In 19 86, when Tract 3963 was approved, the City Council also approved it's companion PD--1041. Within the PD conditions of approval was Condition No. 20. This condition required that a 20 foot distance be established between the rear property line or t:oe of slope (whichever was mr,7i°e restrictive) and any residential unit and any room addition. The condition is enclosed with this memorandum as Attachment A. discussion Although -it remains unclear why the toe of the rear slope on lots 302, 313, 314, 305, and 306 is so close to the proposed homes; the fact remains that they will be very close to the toe cf a slope. The applicant is reOuesting clarification that the use of a terrace wall is an acceptable solution in meeting compliance with Condition No. 20 of Resolution No. 86­275. Without; the use of a terrace the applicant would need to install as. much as a ten foot high retaining wall. The ter, foot mark is the highest point as the height decreases as distance from the high point increases. The applicant has provided alternatives A & 0 with cross- section-, which illustrate the issue. It is staff's opinion that the us+:? of a terrace wall defeats, the intent of Condition 20, inasmuch as Lhe "useable" rear yard area is decreased. In order that the intent remain under, Condition 20, staff would SLJqqest that the terrace effect be provic-led beyond the 20 foot flat useable rear yard. In this way the taller retaining walls could be reduced in height. Another consideration should also be given to the width of the upper terrace. If a greater width is created it may provide even greater utilization of the rear slope area for the future owner. Recommendation That the Council determine Condition No. 20 of Resolution No. 86 -275 requires a 20 foot flat useable area at the rear of each residence within the tract, but the use of a terrace wall (six foot maximum height) beyond the required 20 feet to gain additional rear yard access and useability will be acceptable as long as convenient access (stairs) is provided as determined by the Director of Community Development. As we discussed, to achieve a 20 foot setback in the rear yards of lots 302 -306, would require a ten (10) foot wall. By stepping the wall as shown in Exhibits A, the useable area can be increased in a more aesthetic way than with the tall wall. These are to include, but are not limited to, the following: 1) Low flush toilets (not to exceed 1 -1/2 gallons). 2) Shower controllers. 3) Stoves, ovens and ranges, when gas fueled, shall not have contin- uous burning pilot lights. 4) All thermostats connected to the main space heating source to have night setback features. 5) Kitchen ventilation system to have automatic dampers to insure closure when not in use. 6) Solar panel stubouts. 7) Floor plans to demonstrate reservation of space for solar equipment adjacent to furnace. 19. That gutters and downspouts shall be provided over all garage doors and front entryways, unless covered. 20. That the distance between the rear property line or toe of slope (which- ever is more restrictive) and the residential unit and any room addi- tions shall be a minimum 20 feet. The distance between the residential unit and front property line shall be a minimum 20 feet. 21. That patio covers shall conform to the "Patio Cover Policy" adopted by the City Council on May 15, 1985. The required patio cover setback of 10 feet shall be measured from the rear property line or toe of slope (whichever is more restrictive). Accessory structures shall be located a minimum 5 feet from the rear property line or toe of slope (whichever is more restrictive), and side property line. Patio covers and acces- sory structures shall cover no more than 40 percent of the required minimum rear yard area (20 feet in length multiplied by the width of the lot measured at 20 feet from the rear property line or toe of slope, whichever is more restrictive). 22. That patio covers, accessory buildings and room additions shall be reviewed and approved by the Homeowners Association prior to the issu- ance of a zone clearance. 23. A model home complex shall be permitted within the tract boundaries, subject to issuance of a zone clearance.
