Knipe, Assistant City Engineer DATE: January 23, 1989 SUBJECT: Collins Drive Widening South of Tract 3963 BACKGROUND INFORMATION The conditions of development for Tract No. 3963 (Griffin) required that Collins Drive be constructed south of the tract boundary line to provide for two northbound through lanes and one southbound through lane. In order to construct this roadway, the developer was required to obtain right -of -way from the existing Mormon Church adjacent to the roadway. This section of Collins Drive was originally required to be constructed prior to the issuance of a Certificate of Occupancy for the 70th unit of Tract 3963. Due to delays in obtaining the necessary right -of -way, the construction was deferred by the City Council until January 15, 1989 at the meeting of August 17, 1988. As the enclosed letter from Griffin Homes indicates, the necessary right -of -way for construction of Collins Drive will not be transferred to Griffin Homes until mid - February. The current extension for construction of Collins Drive must therefore be extended. It is felt that the developer is doing all within its power to obtain the necessary right -of -way and begin the construction of this section of Collins Drive. Bonding for this section of Collins Drive has been received by the City. Therefore, it is felt that completion of Collins Drive can be delayed until April 15, 1989. This time extension should be sufficient time to obtain this right -of -way and allow for any delays which may occur. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- RECOMMENDED ACTION Require that Collins Drive south of the Tract 3963 boundary be completed by April 15, 1989. The approval which was required by the Community College District Board has just been completed. The process to get this on their Board agenda will mean the item will be heard their first meeting in February. In the interim, the Morman Church in Utah will be acting on the deeds to transfer the properties. Hopefully, everything will be signed and completed by mid- February. We could then begin actual work by early March. If there is any change to this process, I will let you know. Have a happy New Year.
