SUB,IF.C7:: MINOR MODIFICATION NO. TO PD -1047 TO ALLOW ON -SITE
SALE OF BEER AND WINE IN AN EXISTING RESTAURANT
LOCATED IN THE PARKLANE SHOPPING CENTER AT 304 WEST
LOS ANGELES AVENUE.
Discussion
Desi Cano has requested a. Minor. Modification to Commercial Planned
Development Permit No. PD -1047 to allow the sales of alchoholic beverages
at the King Pollo restaurant which is identified on the approved site
pl.an.The existing restaurant consists of 975 square feet.
Staff has included Conditions of Approval to require: That the restaurant
does not contain a separate fixed bar area, that alcoholic beverages be
sold in conjunction with food service, and that the restaurant shall close
by 12:00 a.m. (midnight). If a separate bar area is proposed in the
future, a Major Modification to the permit would be required to allour for
adequate public notice.
No other additional. conditions regarding tenant occupany were determined to
be necessary for this modification request since the following is already
included as a Condition of annrova.l for PD -1047:
"That if, in the future, any uses are contimplated on
the site differing from that specified in. this
permit, either the permittee, owne..r, or each
prospective tenant shall File a project description
prior priorr to the execution of the new lease
the Planning Director will. be. conducted to determine
if the proposed use is compatible with the CPD zone
z.-eview will be conducted at no charge and an. approval
letter sent unless a mi.n.or or major inod-ification -is
required.

The Director of Community Development has reviewed the proposed
modification and has conditionally approved it.
Pursuant to Resolution No. 88 -523, the Director has the authority to
approve Minor Modifications. This matter is being presented to the Council
as a courtesy. In the event the Council wishes to appeal the Director's
decision, it may do so. Should the Council desire to appeal, it should set
a public hearing date. The next available meeting date would be the
Council's regular meeting of June 7, 1989. Tf the Council takes no action,
the Director's decision stands.

1. Separate fixed bar in a restaurant shall_ require the approval of a
Major Modification by the City Council.
2. The sale of alcoholic beverages(beer and wine) shall be in conjunction
with food service only.
3. All eating establishments shall close by 12:00 a.m. (midnight).
