Knipe, Assistant City Engineer July 25, 1989 AGREEMENT TO CONSTRUCT IMPROVEMENTS AND APPROVAL OF FINAL MAP FOR LDM -11 (EMBASSY) BACKGROUND INFORMATION The subject parcel is located at the northwest corner of Spring Road and Tierra Rejada Road in the City of Moorpark. A location map is enclosed for your reference. The parcel map represents the subdivision of 4.38 acres into 2 parcels for commercial use. The tentative parcel map was approved by the Moorpark City Council on September 16, 1987. Except as noted below, the conditions of approval for the parcel map have been satisfied along with all requirements prior to recordation. The grading, street, and storm drain plans are presently undergoing minor revisions and should be approved within one week after map approval. The approval of the parcel map has been delayed subject to acquisition of right -of -way along Spring Road for all required improvements. This right -of -way documentation is currently being reviewed by the City Attorney. The applicant has submitted a bond for right -of -way acquisition to ensure that the required right -of -way will be obtained. The parcels are being developed by Embassy Plaza No. 16, and will be provided water and sewer services by the Ventura County Waterworks District No. 1. 799 Moorpark Avenue Moorpark, California 93021 , (805).529 -6864 July 3, 1989 Page 2 Included in this final submittal are the following items (to be placed on file with the City Clerk): 1. PD -1063 Dear Mr. Richard*: The undersigned, Embassy Plaza No.16 and Natioual Convenience Stores, Inc. (hereinafter 'NCS'), hereby agree with respect to their application for approval for a zone clearance for PD -1063, a 3,090 of building at 3917 Spring Road (AF# 500- 390 - 34,35,85), to provide the zone clearance. If this dots not occur, Embassy Plaza No. 16 and NOS will not file any lawsuit against the City of Moorpark and/ or Charles Abbot and Associates because of such failure to provide a zone clearance and will not seek the return of any fees paid for zone clearance, plan check or in conjunction therewith. The undersigned also understands that in no way would any costa expended ,give the applicant a vested right to proceed with the project. Nor will it grant any rights for the issuance of a building permit.
