SUBJECT: B1IILDING AND SAFETY SERVICFS -- PROPOSED RATE INCREASE
Background
Since June of 1988 the firm of Charles Abbott. Associates, Tnc. (Abbott) has
been providing the City with Building rind Safety services.
On September 1.3, 1989 . the City r.ecnived notice from Charles Abbott
Associates, Inc. that they intended to increase their personnr.l services
billi_n.g, rates. These increases would brcome effective November. 1., 1989.
According to the Agreement for Building and Safety Services, Abbot -.t is
required to notice the City of a fee in, -rease nt Least 45 clays pri.ol- to the
effective dnte of increase. Also, thi.e agreement only allows one increase
every twelve calendar months.
Discussion
Staff has met. with Mr. Charles Abbott nud discussed the proposed increase.
During this meeting Mr. Abbott noted ra decrense in his estimated increase
predicated upon a r.eductfon' in the act11r11 cost of professional li.abi1.1ty
insurance. The amount of professional linbilit.y provided by Abbott is
one (1) million dollars.
The previous agreement: di.d not requir-e L:hi s type of insurance. however,
this was a provision discussed with Mr Abbott during the City's initial
negotiations, but was removed because it. wns not available- to Abbott at
that time.
At the conclusion of staff's meeting wi.l.h Abbott the following was agreed
upon:

1. An average 7.8 percent increase for professional services rates
with the actual rates identified in the column referred to as
revised proposed new rates.
2. That the agreement would be amended to include professional
liability insurance with the City named as additional insured if
allowed by the underwriter of the policy.
ff Recommended Action
1. Approve the increase in rates effective November 1, 1989; and
as listed in the attached letter.
2. Approve amending the agreement to .include professional liability
insurance in the amount of one (1) million dollars per above with
actual language as approved by the City Manager and City Attorney.

As discussed and agreed with you and Mr. Kueny on October 25,
1989, enclosed is our adjusted rates for the new year. As you
requested, I have included our billing rates showing last year's
rate (Column 1), the rate quoted to you in our correspondence of
September 6th with the anticipated insurance adjustments (Column
2), and the third column of rates are computed after our
insurance costs have been finalized (Column 3). As I discussed
with you on the 25th, our actual cost for insurance was sub-
stantially lower than the original quotes from the insurance
carriers.
Our new rates, which now include one million dollars of pro-
fessional liability coverage, effectively increased 7.8% instead
of the 11.2% quoted in our September correspondence.
You have been supplied with the insurance certificates for our
new professional liability policy. If we can be of additional
assistance or if additional information is needed, please do not
hesitate to contact me.
