GILLESPIE Chief of Police SUBJECT: Freeway Agreement and Memorandum of LJnderstand.ing The City Staff, as directed, prepared draft language for a. Memorandum of_ Understanding (MOU) and forwarded the MOU to Jack llallln, Chief Engineer for District 7. Mr. Hallin's r_eponses to the MOU were .received on June 14, 1.989. After review, many of his requested changes were incorporated . into a. .revised. MOU. Some requested changes, however, related t.o the State's commitment to improve a section of Highway 1.18 which has been impacted by increased truck. traffic due to the failure of the Statee to connect the two highways. Staff did. not feel it was appropriate to aniencl l::he proposed MOU to that extent and has returned the MOU to the State for- further. consideration. RH:sc 896163.tem MOORPARK, CALIFORNIA City Council Meeting Of e _ 1I8 `/ ACTION: al� e� , J-1 w ti qA,a fv / --?. , By 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 of 7 -VEN -118 M18.8/R21.0 7- VEN -23 Rll.1 /Rll.5 North end of Rte 23 Pwy to 0.3 Mi E/O College View Avenue FREEWAY AGREEMENT THIS AGREEMENT, made and entered into on this day , 19 , by and between the STATE OF CALIFORNIA, acting by and through the Department of Transportation (herein referred to as "STATE "), and the City of Moorpark (herein referred to as "CITY "), WITNESSETH: WHEREAS, the highways described above have been declared to be freeways by Resolution of the California Transportation Coi- -nission on December 16, 1964 and October 28, 19!.4; an-1 WHEREAS, STATE and County of Ventura have entered into Freeway Agreements, dated July 6, 1971, relating to that portion of State Highway Route 118 between 0.7 mile west of Walnut Canyon Road and 0.3 mile west of proposed Madera Road and November 30, 1971, relating to that portion of State Highway Route 23 between 0.4 mile south of Tierra Rejada Road and Happy Camp Road; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the STATE as it affects streets of the CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; NOW, THEREFORE, IT IS AGREED: 1. This Agreement supersedes those portions of said Freeway Agreements dated July 6, 1971, from 0.1 mile east of .Princeton Avenue to 0.3 mile east of College View Avenue, and November 30, 1971, from 0.4 mile south of New Los Angeles Avenue to 0.4 mile north of New Los Angeles Avenue. 2. CITY agrees and consents to the closing of CITY streets, relocation of CITY streets, construction of frontage roads and other local roads, and other construction affecting CITY streets, all as shown on said plan map attached hereto marked Exhibit A and made a part hereof by this reference. 3. STATE shall, in construction of the freeway and at STATE's expense, make such changes affecting CITY streets in accordance with the plan map attached hereto marked Exhibit A. 4. STATE agrees to acquire all necessary right of way as may be required for construction, reconstruction, or alteration of CITY street,, frontage roads, and other local roads, and CITY hereby authorizes STATE to acquire in its behalf all such necessary right of way. -2- 5. It is understood between the parties that the right of way may be acquired in sections or units, and that both as to the acquisition of right of way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units of the project as funds are budgeted and. made lawfully available for such expenditures. 6. CITY will accept control and maintenance over each of the relocated or reconstructed CITY streets, and the frontage roads, and other STATE constructed local roads on receipt of written notice to CITY from STATE that the work thereof has been completed, except for any portion which is adopted by STATE as a part of the freeway proper. CITY will accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by STATE. 7. This Agreement may be modified at any time by the mutual consent of the parties hereto, as may become necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway project for the benefit of the people of the STATE and of the CITY. -3- IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their respective duly authorized officers.
