SUBJELT: Consider Agreement with Owner of PD -1040 (Munoz formerly
Schl.eve) for Participation in High Street Improvement Project
PD -1040 (Schleve) was approved by the City on November 13, 1984. This
project is lncated at the northeast. corner of Magnolia Avenue and. High
Street. As part of the conditions of approval, certain improvements,
including the curb, gutter, sidewalk and street pave -out on High Street
were deferred until occupancy of the second building in t:he_. project. The
City continued to allow deferral of the .improvements except the sidewalk
pending the City's planned high Street improvements. These improvements
are guaranteed by surety bonds totalling $15.000.00.
As you are aware, the High Street Improvement Project is now ready for
contract award with work to start in June, 1.989. It is important to
construct the improvements on the High Street frontage of PD -1040 in
conjunction with the City's project in order to complete the enti.r.e north
side of High Street east of Magnolia Avenue.. It. is City Staff's
recommendation to allow the owner of P!) -1040 to par.tici.pate in the City's
project. PD -1040 has recently been ac0uire.d by Mr. Munoz.
Mayor Brown and City Manager Kueny recently met with Mr. Munoz concerning
this matter. He initially expressed concern about participating since
some of the improvements proposed for funding by him (sidewalk, water
meter and fire hydrant) had already been installed by the previous owner.
After reviewing the bid costs and related information. Mr. Munoz agreed to
pay $13,500 as his share of the cos Ls. lli..s lot:ter of agreement, including
timing of the payment, is attached. i concur with the points in the
letter except that Mr. Munoz needs t7o acknowledge iiis obligation to make
the improvements and his payment of thi, total scan fulr.i.l.ls the obligation.

Staff Recommendation
Approve agreement with Mr. Munoz to meet street improvement requirements
of PD -1040 with points as contained in his May 26, 1989 letter and as
amended by this report; and authorize City Manager to sign on behalf of
the City.

Dear Mr. Kueny,
I'm glad we had the opportunity to meet with you and Mayor Brown
yesterday to discuss the above subject. It was a pleasure meeting
both Mayor Brown and yourself.
As per our agreement, the cost of the improvenents in front of
313 -325 High St. Moorpark, will be in the amount of $13,500.00.
Payment will be made in two installments of $6,750.00 each. The
first payment will be due and payable upon the issuance of notice,
on or about June 14, 1989. The second and final payment, will be
due 90 days thereafter, on or about September 14, 1989.
The improvements will certainly add to the aesthetic value of
the property as well as to the convenience of all concerned. We
look foreward to their completion.
Please acknowledge receipt of this letter on the enclosed copy,
and, return to me in the envelope provided.
