GILLESPIE Chief of Police Government Code Section 2.0169 requires a City to publish a notice inviting bids and contract for the publication of legal notices when there is more than one newspaper of general circulation printed and published within a City. This process is to be completed before the beginning of each fiscal year. On May 17, 1989, staff received authorization to go out to bid for, the publication of the City's legal notices and ordinances. The specifications for publication were the same as last year with the additional requirement of a modem to directly transfer information from the City to the publisher. The Notice Inviting Bids for this work was published in the Moorpark News on May 24, 1.989 with the bid opening set for June 13, 1989 at 2 :00 p.m. The notice was also sent to: the Moorpark. Mirror, Daily News, Star -Free Press, News Chronicle, The Enterprise, and Moorpark News. Bids were received in a timely manner, in proper form from the Enterprise, Moorpark News, and Moorpark Mirror. A non- conforming bid was received from the News Chronicle. The bids were opened at the date and time set forth in the notice by the Deputy City Manager, with the City Clerk present. The Moorpark Mirror with a bid of .50 cents per line (17 pica line, Helvetica 8 point type on 9 point leading), $2.50 per column -inch rate for non -text ads, and electronic_ transfer line rate of .40 cents per line and $2.25 per column -inch, was the low bidder. The Moorpark News bid .53 cents per line (17 pica line, Helvetica 8 point type on 9 point leading), $3.25 per column -inch rate for non -text ads, and electronic transfer line rate of .48 cents per line and $3.25 per column -inch. The Enterprise bid .315 cents per line (8 pica line, 8 point Sans No. 1 with 8 point leading), an electronic transfer rate was not bid. STAFF RECOMMENDATION Award the bid for legal publications /ordinances to the Moorpark Mirror for Fiscal Year 1989/90. The Moorpark Mirror's bid follows in three parts. Part A answers your request for bid prices line by line, including your bid option for the electronic transmittal of data. Part B is the Moorpark Mirror's offer for free use of a Macintosh computer and software. And Part C describes other advantages to the City of Moorpark that the Moorpark Mirror offers. Part A: Legal Publication Rates 1. Line rate (17 pica line, Helvetica 8 point type on 9 point leading). Moorpark Mirror's bid price: 50 cents per line 2. Standard Advertising Unit (SA U) column -inch rate for non -text ads. Moorpark Mirror's bid price: $2.50 per column -inch 3. Customary rate charged for private legal notices (17 pica line, Helvetica 8 point type on 9 point leading). Moorpark Mirror's regular price: $1.07 per line 4. Customary Standard Advertising Unit (SA Q) column -inch rate charged for private legal notices. Moorpark Mirror's regular price: $5.00 per inch 5. Enclosed as Exhibit A is a copy of the Ventura County Superior Court Case No. 100296 decree declaring the Moorpark Mirror to be a Newspaper of General Circulation for the City of Moorpark and the County of Ventura. Mr. Richard Hare June 9, 1989 Page 2 6. a. The City may submit notices and ordinances for publication up to 9 a.m. on the day prior to publication (Thursday, 9 a.m. for Friday publication) b. The City may submit notices and ordinances for publication as late as 5 p.m. on the fifth working day before publication date (generally Friday, week before publication) and receive a proof copy of the notice or ordinance by noon on the third working day (Tuesday) before publication, as long as proof copies are returned to the Moorpark Mirror by 9 a.m. the day before publication. 7. The Moorpark Mirror shall submit for payment and processing all billings and Affidavits of Publication for legal notices to the Moorpark City Clerk within 30 days of publication. 8. Electronic Transfer of Data - Discounted Rates a. Line rate (17 pica line, Helvetica 8 point type on 9 point leading). Moorpark Mirror's bid price: 40 cents per line b. Standard Advertising Unit (SAU) column -inch rate. Moorpark Mirror's bid price: $2.25 per column -inch c. Customary rate charged for private legal notices (17 pica line, Helvetica 8 point type on 9 point leading). Moorpark Mirror's regular price: $1.07 per line d. Customary Standard Advertising Unit (SA Q) column -inch rate charged for private legal notices. Moorpark Mirror's regular price: $5.00 per inch Part B: Free Use of Macintosh Computer and Software If the Moorpark Mirror is awarded the legal publication contract for the 1989 -90 fiscal year, the Moorpark Mirror will provide to the City of Moorpark free use of the following equipment and software during the contract period: • Macintosh computer • Word processing, desktop publishing and telecommunications software This will enable the City to lower its typesetting costs, generate artwork, posters, programs and newsletters. Computer compatibility with the Moorpark Mirror means minimal errors and lower cost for all parties. Mr. Richard Hare June 9, 1989 Page 3 Part C: Other Advantages of the Moorpark Mirror Price and data processing efficiency are not the only factors to be explored. How effective the City's message is delivered is a crucial consideration. The Moorpark Mirror offers additional advantages to the City that translate directly to increased readership, and therefore increased community awareness of important public issues: Extensive Moorpark Circulation: Audited circulation exceeds 4,000 in Moorpark - higher than any other newspaper. Publication Schedule: Friday publishing date permits City Council actions on Wednesday night council meetings to appear in the Friday paper. Extensive Newsrack Network: More than 100 newsracks will soon be placed throughout Moorpark. Front Page Flag: Important public meetings (such as the recent Redevelopment Agency Workshops) can be flagged on Page 1 of the newspaper for immediate recognition by the community - at no cost to the City. El Reflejo: A special section - entirely in Spanish - of local news and information now distributed in the Moorpark Mirror throughout the community Directory of Public Servants: The Moorpark Mirror routinely prints the telephone numbers of important local officials to help bridge the gap between them and the citizens. Autonomous Management: The Moorpark Mirror is the only newspaper owned and published in Moorpark. Unlike all other so- called "local newspapers," The Moorpark Mirror's owner is visible and active in the community and accessible to all residents. In closing, the Moorpark Mirror offers the City of Moorpark a fair price, the free use of a Macintosh computer and software, and additional advantages unmatched by other newspapers in Moorpark.
