SUBJECT: PERFORMANCE BONDS
Background
Recently staff has been proposing Performance Bonds on
Commercial /Industrial Discretionary Permits as a means to assure compliance
with conditions of approval. This practice began several weeks ago with the
Major Modification to PD966 (Mash). A $10,000 performance bond was required
for this project. Staff felt that this amount was reasonable considering
that the cost of a bond is only a sma.l.l. portion of the bonds face value.
At the hearing, Council requested st. -ff to bring back: this issue for
further discussion.
Discussion.
At the present time there exists insufficient staff to assure compliance
with conditions of approval. for all of the discretionary projects
throughout the City. Staff believes that the implementation of a
performance bond provides an incentive for a permittee to adhere t:o the
conditions of approval.. Typically, bonds cost approximately l.% of a face
value and are issued for two years. Thus a $10,000 bond would cost
approximately $100 every two years. ThP: Director of Commun:i.ty Development
may, through a public hearing to be heard before the City Council,
recommend that any or all of the funds =in the Performance Bond be forfeited
for noncompliance of the Conditions of approval. or other just: cause.
It is possible for an applicant to request a reduction in the amount of the
security or removal of the condit:i.on at: some point in the future once the
permitted operation has established a ;:rack record of compliance with the
Conditions of Approval. by filing for a Minor Modification. However, it is
the intention of the Community Development Department that this condition
remain for the life of the project.. Staff would also encourage the Council
to consider the establishment of a fee to pay for .future project condition
compliance. As the City matures Hie likelihood of projects to defer_

realistic possibility. Future projects could be conditioned to provide a
one time payment to a Code Enforcement program.
Recommendation
That a condition of approval requiring Performance Bonds continue to be
placed on Commercial /Industrial Discretionary Permits.
