Knipe, Assistant City Engineer( _ DATE: February 7, 1989 / SUBJECT: Agreement to Construct Improvements and Acceptance of Grant Deeds for PD -1064 (Topa) BACKGROUND INFORMATION PD -1064 is located at the southwest corner of Los Angeles Avenue and Spring Road. A location map is enclosed for your reference. On January 20, 1988 the City Council approved the above project for construction of a commercial building. As conditions of approval, the developer was required to dedicate to the City of Moorpark the necessary right- of -wa }, for construction of Los Angeles Avenue and Spring Road fronting their property. In addition, grant deeds for sidewalk purposes, ingress and egress, access easements and storm water acceptance were required. Included with this submittal are the following (on file in the office of the City Clerk): 1. Agreement for Construction of Improvements. 2. Bonds: Type Amount Surety Company Bond No. Performance $231,000 Travellers Indemnity Co. 402J7939 & Payment Grading $ 22,500 Travellers Indemnity Co. 402J7952 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- 3. Grant Deeds: Description Purpose Los Angeles Avenue/ Provides right -of -way for current Spring Road Grant roadway construction as well as Deed limits ingress and egress rights Los Angeles Avenue Provides Irrevocable Offer ill of along Los widening, Sidewalk Easement Provides meanderin an irrevocable offer of additional right -of -way Angeles Avenue for future if necessary an easement for a g sidewalk Access Easement Allows for access to south and west adjoining properties through 4 access easements Storm Water Accept- Allows for acceptance and disposal ance Easements of storm water from Los Angeles Avenue onto subject property Spring Road Easement Provides easement along Spring Road over adjoining property to south for road transition and storm drain construction RECOMMENDED ACTION Authorize the Mayor to sign the Agreement to Construct Improvements and direct the City Clerk to retain the original agreement and return an executed copy to the developer and surety company.
