Agreement for Use of Facilities, Supplies and
Services between Moorpark Unified School District and
The City of Moorpark
Attached for your review is an Agreement for Use of Facilities,
Supplies and Services from the Moorpark Unified School District. The
agreement is for continued space rental and utility costs for the
portable trailer (Star Club building) located at Flory Avenue School.
Under the agreement, the City would pay -to the School District thirty
dollars ($30.00) per month for the use of the grounds and one dollar
($1.00) per hour used for utilities at the site. This is a
continuation of our current agreement.
Lyle Richardson informed staff the School Board approved this agreement
at their January 23, 1989, Board meeting.
STAFF= RECD MENDATION:
Authorize Mayor to execute the agreement on behalf of the City.

AGREEMENT FOR USE OF FACILITIES, SUPPLIES & SERVICES
between
MOOR13ARK UNIFIED SCHOOI, DISTRICT AND THE CITE' OF MOORPARK
The City of Moorpark, hereinafter referred to as City and the
Moorpark Unified School District, hereinafter referred t.o as
District muttial.ly agree as follows:
1. The City shall lease from Gelco Space the present
36' x 60' relocatable Continuation High School
building located at 157 E. Los Angeles Avenue. The
City activities shall not interfere with the normal
or extra curricular operations of the School
District.
2. The City shall pay the District Thirty Dollars
($30.00) per month for the use of the grounds and one
($1.00) per hour used for utilities at the site. The
fee is payable in advance on the first day of each
and every calendar month of facility use.
3. The City shall provide all custodial service and
supplies for care of the building, as well as
sweeping sidewalks clean, and will be responsible for
any damage to the building and sidewalks around the
building. The District shall provide proper
containers for trash disposal.
4. The City at its own expense, shall procure and
maintain adequate liability insurance against bodily
injury and property damage with respect to all City
programs. Said insurance shall have a combined
single limit of liability for bodily injuries and for
property damage in the amount of not less than One
Million Dollars ($1,000,000). The City shall furnish
the District with a Certificate of Liability,
Insurance from an insurer admitted to do business in
the State of California, which certificate shall.
verify that the City carries public liability
insurance as described above. Said Certificate shall
verify:
a. that the District is listed as an additional
insured in said insurance;
b. that such insurance covers premises, liability,
contractual liability, owned and non -owned
automobile liability;

c. that said insurance shall riot be cancelled or
terminated without thirty (30) days prior
written notice given to the District; and
d. that such insurance shall be primary insurance,
notwithstanding any "other insurance" clauses
to the contrary which may be contained in
either the City's or District's insurance
contracts including defense costs.
5. The City shall not erect or display or permit to be
erected or displayed on the premises any sign or
advertising matter without the prior written consent
of the District, which consent shall not be
unreasonably withheld.
6. The City hereby indemnifies and defends the District:
against, and holds the District, its officers and
employees harmless from all claims, costs, expenses
and liabilities arising out of or in any way
connected with the use or occupancy of the premises
by the City or its guests, patrons, agents,
employees, licensees, contractors, passengers and
invitees, including defective conditions of premises.
7. All of the other usual requirements of the District's
Use of Facilities Policy shall apply.
8. This Agreement shall be effective February 1, 1989,
and shall remain in effect through July 31, 1989, to
be reviewed every six (6) months, not to exceed
twenty -four (24) months. This Agreement may be
amended by mutual agreement.
9. The City shall pay the total cost of removal of the
relocatable building at the end of the Agreement
period. Should the Agreement be terminated before
twenty -four (24) months, the party initiating the
termination shall pay all removal costs.
10. This Agreement shall be reviewed and may be renewed
every six (6) months at the discretion of the
District.
