Condition No. 1 was to indicate that the form of the fault notice would be subject to the approval of the City Manager. Condition No. K was to clarify that the approved dwelling units are those which have been presented to your Council. In addition, a new condition, No. L, was to be added to indicate that no more than 257 of any single model may be built and that no more than three continuous dwelling units may be of the same model. The attached resolution has been prepared in conformance with this direction. However, as I indicated to your Council on October 5, Condition No. L may be overly strict and may frustrate the overall intent of the Council. Typically, housing tracts have between three and six models. While the exact mix of models will vary, generally there will be the fewest of the smallest models and the majority will be of the mid -sized and larger units. I recommend that your Council consider the attached alternative conditions. Either or both of these conditions would, I believe, insure to your Council that there would be a mix of all models within the proposal, while allowing greater flexibility for the builder. Please also bear in mind that at the present time the co- permittee, the Pardee Corporation, does not have any approved models. While Pacifica has six models, it may be that Pardee wishes to develop the property with only three models, but this condition would apply equally to each co- permittee. That it is the intent of this permit to provide for an adequate mix of all approved models and floor plans. Therefore, there shall not be a preponderance of any one model or floor plan. L -2. Not withstanding Condition No. 4 of the permit, the final plot plan shall be subject to the approval of the City Council. 10 -19 -83
