O. JERRY STRAUGHAN At your last meeting, Councilmember Beaulieu requested that this matter be placed on a future agenda for consideration. Attached for your review is a copy of the applicable code sections from the City of Walnut, which would be used as a guide for you. An ordinance amending our Municipal Code will be prepared to reflect your direction in this matter. :ddb encl. § 2 -28 Administration § 2 -29 Article IV. Planning Commission .1 Sec. 2-28. Created. A planning commission for the city is hereby established with membership, powers and duties as provided herein and by statutes of the state. (Ord. No. 4, § 1.) Sec . 2-29. Compositio n; appointment; qual i fications of members; terms of office; vacancy in office; removal of members . The planning commission shall consist of five members, which five mem- bers shall be appointed by the mayor with the approval of the city council. In addition thereto, the city manager and the city attorney shall be ex officio or advisory members who shall not have the power to vote. The members of the commission shall be residents and registered voters of the city. At such time that the terms of office of all members of the planning commis- sion now serving expire, the mayor with the approval of the city council shall appoint five commissioners to serve until the first Tuesday of May, 1976. Their successors shall be appointed for terms of two years. Nothing in this article is intended to preclude the reappointment of any planning commissioner upon the expiration of his term. All members of the planning commission shall serve at the will of the city council. If a vacancy shall occur otherwise than by expiration of term, it shall be, filled by appointment for the unexpired portion of the term. The term of the ex officio or advisory members shall correspond to their respective terms of office. Any member of the planning commission may be removed by either of the following: (a) The appointing official, subject to the approval of the legislative body. (b) A majority vote of the legislative body . (c) Absence from three consecutive regular meetings without formal consent of the commission shall be deemed to cons tute the resignation of the commissioner and the position declared vacant. (Ord. Absence from meetings . ` If a member of the planning commission shall be absent from three succes- sive regular meetings of the commission, without cause, the office of such mem- ber shall be deemed to be vacant and the term of such member ipso facto ter- minated and the secretary of the planning commission shall immediately inform the city council of such termination. An absence due to illness or an unavoidable absence from the city and written notice thereof to the secretary of the planning commission on or before the day of any regular meeting by the commission shall be deemed absence for cause. (Ord. No. 4, § 1.) Sec-. 2 -31. Councilmen not eligible for membership No member of the city council shall be eligible for membership on the planning commission. (Ord. No. 4, § 1.) Sec . 2- 32. Powers . The planning commission shall have power, except as otherwise provided by law, to: (a) Recommend to the proper office plans for the regulation of the future growth, development and beautification of the city in respect to its public and private buildings and works,' streets, parks, grounds and vacant lots. (b) Recommend to the proper office of the municipality, plans, con- sistent with the future growth and development of the city, in order to secure sanitation, proper service of all public utilities, shipping and transportation facilities. (c) Make recommendations to any public authorities or persons with reference to the location of any proposed buildings, structures or works. (d) Recommend to the council approval, conditional approval or dis- approval of tentative maps of proposed subdivisions of land. The council here- by designates the planning commission as its advisory agency with respect to the design and improvement of proposed subdivisions. Every such map or plat shall, prior to its final approval or disapproval by the council, be submitted to the commission for action thereon. (e) Do such other things as shall be necessary to carry out the provi- sions of this article and the provisions of the Conservation and Planning Act of the state, amendments or any act substituted therefor. (f) Adopt such bylaws as it may deem necessary to provide for: 16 Supp. #2, 10 -74 § 2 -33 Administration § 2 -34 (1) The time and place of meeting. (2) The time and method of electing officers. (3) Such other matters relative to the organization of the commission and methods of administration of its duties which are not otherwise provided for by statute or ordinance. (Ord. No. 4, § 1.) Sec. 2 -33. Regular meeting. A regular meeting as provided by law or by rule of the planning commission or any regularly advertised public hearing shall be deemed a regular meeting. (Ord. No. 4, § 1.) Sec. 2 -33.1. Compensation for services. Members of the planning commission shall receive compensation for their at- tendance at each meeting of the commission in the sur, of twenty -five dollars per meeting per commissioner, payable on the first day of each month following the preceding month in which said.compensation was earned, but not exceeding the sum of fifty dollars per month. (Ord. No. 346, § 1.) Article V. Parks and Recreation Commission. Sec. 2 -34. Created; composition; appointment; terms of office; filling vacancies in office; absence from meetings. The parks and recreation commission shall consist of five members, which five members shall be appointed by the mayor with the approval of the city council. In addition thereto, the city manager, chairman of the planning commission, super- intendent of Walnut Unified School District or the represen- tative of any of the foregoing shall be ex officio members who shall not have the power to vote. The members of the commission shall be residents and recistered voters of the city. (c) Absence from three consecutive regular meetings without formal consent of the commission shall be deemed to constitute the resignation of the commissioner and the posi- tion declared vacant. (Ord. No. 118, § 2; Ord. No. 180, § 1; Ord. No. 185, § 1; Ord. No. 244, 5 1; Ord. No. 265, § 2.) Sec. 2 -35. Organization; officers: rules and regulations; meetings; minutes. Immediately after their appointment, the members of the parks and recreation commission shall meet and organize. At the organization meeting, the commission shall elect from the members, a chairman, a vice - chairman, and shall appoint a secretary, their duties shall respectively be such as are usually carried out by such officers. Offi- cers shall hold office for one year, or until their succes- sors are elected. The commission shall adopt rules and regulations to govern procedures and shall by vote set a time for regular meetings which will be held monthly at a time and place adopted by the commission at its first meeting. In the event of a change of time or place of meeting, due notice shall be given the members of the city council. Special meetings shall be held in a manner determined by the commission with provision for due notice. A majority of the regular members shall constitute a quorum. . Minutes of all meetings shall be filed with the city clerk and the superintendent of schools. (Ord. No. 118, § 3.) Sec. 2-36. Duties and responsibilities. The duties and irilities of the parks and recreation. commission are as follows: (a) act in an advisory capacity and be responsible to the city council in all matters pertaining to public recrea- tion and to cooperate with other governmental agencies and civic groups in the advancement of sound recreation and parks and (walnut 11/8o) 18 2 -37 Administration § 2 -37 (b) Formulate policies on recreation services for ap- . proval by the city council including: Agreements with the board of trustees of the school districts and the city council for the best possible joint use of recreation and park facilities. (c) Advise the city council on the problems of adminis- tration, development of recreation areas, facilities, pro- grams and improved recreation services. (d) Recommend the adoption of standards on organiza- tion, personnel, areas and facilities, program and financial support of recreation and park activities. (e) Make periodic inventories of recreation services that exist and may be needed and interpret the needs of the, public to the city council. (f) Aid in coordinating the recreation and park ser- vices with the programs of other governmental agencies and voluntary organizations. (g) Interpret the policies and functions of the recrea- tion department to the public. (h) Advise the city council in the preparation of the annual budget request and a long -range recreation and parks capital improvement program, by March 1st, each year. (i) Consider and recommend on all requests for perman- ent facilities to be erected on park areas. (j) To aid the city council in the planning, beautifi- cation, maintenance, and development of parks, boulevard and street tree programs. (k) Perform such other duties as may be requested from time to time by the city council. (1) All aforementioned recommendations, reports and requests shall be submitted in writing to the city clerk not later than the Wednesday preceding the next following regular meeting of the city council. (Ord. No. 118, § 4.) Sec. 2 -37. Compensation for services. Members of the Wal- nut parks and recreation commission shall receive compensa- tion for their attendance at each meeting of the commission 19 (Walnut 11 /80) § 2 -37 Walnut City Code § 2 -37 in the sum of fifteen dollars per meeting per commissioner, ' payable on the first day of each month following the preced- ing month in which said compensation was earned, but not exceeding the sum of thirty dollars each per month.
