ADJOURNMENT 7 /,.>' MOORPARK PLANNING COMMISSION Staff Report and Recommendation Meeting of January 24, 1984 SUBJECT: Parcel Map 3930 APPLICANT: Marla Brossard 6892 N. Westwood Drive Moorpark, CA 93021 REQUEST: The applicant is requesting approval of a four lot subdivision of a 4.4 acre parcel (see Exhibit "2" for subdivision map) . A. BACKGROUND: 1. Location and Parcel Number: The project site is approximately 4.4 acres in size, and is located north of and adjacent to Wicks Road in the City of Moorpark (Exhibit "3" for location map) . The Assessor's Parcel Map Number is 512-05-18 and 19. 2. History: The property was created as result of Parcel Map 3496, which was filed by the Ms. Brossard in 1980. The project was then sold to a Mr. Kia who applied for a time extension on the subdivision and recorded the map in 1982. Ms. Brossard through a foreclosure on the property received two of the lots and filed the subject map on the property. B. EVIDENCE REGARDING SUBDIVISION MAP ACT AND ZONING ORDINANCE FINDINGS: Certain findings must be made in order to determine that the proposed project is consistent with the State Subdivision Map Act and the City Ordinance Code. These findings, and the project information and evidence to support them, are presented below: 1. Consistency of Tentative Map Design and Improvements with Applicable Zoning and General Plan a. General Plan Designation: The City' s Land Use Element designates the site in the "R-H" (Rural High) cateogry which permits lots of one acre or greater in size. In addition, the proposed project is consistent with City's Circulation Element. b. Adjacent General Plan Designations and Land Uses the, Open Space Element designates the properties surrounding the prof..es t site for "urban" land uses. The City's Land Use Element designates the adjacent properties as follows: Staff Report and Recommendation Meeting of January 24, 1984 PM~3930; Page 2 North: Rural Low: Five acres per dwelling unit South, East and West: Rural High: One acre per dwelling uuit. The existing land uses adjacent to the project site area as follows: North: vacant South: residential East: vacant West: residential The proposed project is compatible with the adjacent laud uses. C. Zoning: The existing "8-D-lAc" (Rural Exclusive, One Acre Minimum) zone was adopted on August 8, 1961 (Ordinance No. 1092) . d. Adjacent Zoning: Zoning on surrounding properties is primarily urban in nature and consists of the following: North: "B-D-l&cre" (Rural Exclusive, One Acre Minimum) South: '/B-l" (Single Family Residential) West and East: R-D-lAcze (Rural Exclusive, One Acre Minimum) . The project is consistent with the surrounding zoning. 2. Physical Suitability of Site for Proposed Type and Density of Development o, Existing Natural Features and Laud Use: l' Geologic: The site is currently vacant and is characterized by sloping topography and Lot l is in excess of 28 percent slope. The Public Works Agency has recommended Condition No. 22 requiring additional geologic information prior to recordation to address the slope and drainage of that property. b. Traffic/Circulation: l. On site: Access to the site is via two private driveways. 2, Off Site: The project site is serviced by Wicks Road, u public roadway. Condition 20 requires the applicant to improve Wicks Road to u 24 wide pavement width from Walnut Canyon Bnod to the project site. Stuff Report and Recommendation Meeting of January 24, 1984 PM-3930; Page 3 Cumulative traffic on Los Angeles Avenue will be increased as a result of the project and therefore, Condition 25 informs the applicant that prior to the issuance of a building permit on any of the lots a contribution will be made to the Los Angeles Avenue Improvement Area of Contribution. With the imposition of the above conditions to mitigate the geologic and traffic impacts, the project site can be determined to be physically suitable for the type and density of the proposed development. 3. Likelihood of Proposed Project to Cause Substantial Environmental Damage: As di"kcsoed in B-6 40naTe, the impact of the proposed development 'on on-site resources, drainage, and traffic circulation is either negligible or has been adequately mitigated by the proposed conditions of upDrovol. The project will therefore not cause significant environmental damage. 4. Likelihood of Proposed Project to Cause Serious Public Health Problems: a' Services: The present and proposed services to the project are as follows: l. Water: The Ventura County Waterworks District No. l has indicated that it is capable of providing water service to the proposed project. 2. Sanitation: The Moorpark Sanitation District has indicated that service is adequate to serve the subject project' 3, Fire: The proposed project is within one-quarter mile of the Moorpark Fire Station. As a result, no adverse impact would result. 4. Law Enforcement: The project site is located in a developed area and would have no adverse impact on existing level of Sheriff service. 5. Education: The proposed project is located within the Moorpark Unified School District and capacity is adequate for the proposed project. 5. Potential Conflict of Proposed Project with Public Dusemcuco or Waterways: Based upon examination of the preliminary title report issued by Iicor Title Insurance on June 15, 1983, the applicant has certified that there are no public access easements on the property. Moreover, the subdivision does not contain or front on any public waterways, rivers, Staff Report and Recommendation Meeting of January 24, 1984 PM-3930; Page 4 streams, coastlines, shorelines, lakes, or reservoirs. Therefore, the proposed subdivision design and improvements would not conflict with established public easements or waterways. 6' Potential Water Discharge into Existing Community Sewer System in Violation of Law; As discussed in 4a above, the project will be required to utilize sewer service in the development of the lots. As a result, there will be no discharge of water from the project into an existing community sewer system in violation of water quality control requirements under Water Code Section, 13000 et seq. C. SUBDIVISION MAP ACT AND ORDINANCE COMPLIANCE: Based upon the information and findings developed by staff, it is determined that this application, with the attached conditions, meets the requirements of Government Code Sections 86473.5, 66474, 66474'6 and 66478' 1 et seq. and County Ordinance Code Section 8111-2. 1. The findings that were discussed in the previous section are summarized below. The section of this staff report in which the evidence supporting these findings is presented is mbuwu in ' parentheses: l' Subdivision Map Act Findings a' The proposed map is consistent with applicable general and specific yluoa (Section D-l) ; b' The design and improvements of the proposed subdivision are consistent with applicable general and specific plans (Section 8-l) ; C. The site in physically suitable for the type of development proposed (Section B-2) ; d. The site is physically suitable for the proposed density of development (Section 8-2) ; e' The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat (Section B-3) ; f. The design of the subdivision and the type of improvements are out likely to cause serious public health problems (Section B-4) ; A' The design of the subdivision and the type of improvements would not conflict with easements, acquired by the public at large, for access through or use of, property micbio the proposed subdivision (Section 8-5) ; Staff Report and Recommendation Meeting of January 24, 1984 PM-3930; Page 5 h. There would be no discharge of waste from the proposed subdivision into an existing community sewer system in violation of existing water quality control requirements under Water Code Sections 13000 et seq. (Section B-6) ; and i. The proposed subdivision does not contain or front upon any public waterway, river, stream, coastline, shoreline, lake or reservoir (Section B-5). D. CALIFORNIA ENVIRONMENTAL QUALITY ACT COMPLIANCE In that the same property is being addressed as part of the subject proposal and environmental considerations are similar the Planning Division has subsequently used the Negative Declaration previously filed on Parcel Map 3496. E. PUBLIC COMMENTS To date, no public comments have been received regarding the proposed project. F. DEVELOPMENT ADVISORY COMMITTEE: A Development Advisory Committee meeting was held in November 1983 and the applicant expressed agreement with all conditions. RECOMMENDED ACTION: 1. Find that this project will not have a significant effect on teh environment and certify that the attached Negative Declaration has been completed in compliance with CEQA and the State EIR Guidelines issued thereunder, and that this body has reviewed and considered the information contained in the Negative Declaration originally prepared for Parcel Map 3496; and 2. Adopt the proposed findings presented in this staff report and approve Parcel Map 3930 subject to the conditions included as Exhibit "1". That the conditions of approval of this Tentative Map supersede all conflicting notations, specifications, dimensions, typical sections and the like which may be shown on said map and that all of the provisions of the Subdivision Map Act, City of Moorpark Subdivision Ordinance and adopted City policies apply. 2. That all requirements of any law or agency of the State, City of Moorpark and any other governmental entity shall be met. 3. That no zone clearances shall be issued for residential construction until the parcel map or final map has been recorded. Prior to construction, a zone clearance shall be obtained from the Planning Division and a building permit shall be obtained from the Division of Building and Safety. 4. Recordation of this subdivision shall be deemed to be acceptance by the property owner(s) of all conditions of this map. 5. That fees for temporary school facilities may be required to be paid prior to issuance of a building permit. 6. That all utilities shall be placed underground. ENVIRONMENTAL HEALTH DIVISION CONDITIONS: 7. That in order to protect the public safety and prevent groundwater - pollution, any abandoned wells on the property shall be destroyed in accordance with the Ventura County Well Ordinance prior to recordation/ occupancy. 8. That prior to recordation, the applicant shall demonstrate the availability of domestic water for all parcels created by submitting a "will-serve" letter from a domestic water purveyor licensed by the Ventura County Environmental Health Department or the State of California Department of Public Health to the Ventura County Environmental Health Department and the Ventura County Public Works Agency. 9. That prior to recordation, a "will-serve" letter shall be obtained for sewage service for each lot created. Said letter shall be filed with the Ventura County Environmental Health Department and the Ventura County Public Works Agency. FIRE DEPARTMENT CONDITIONS: 10. That prior to combustible construction, all-weather access road(s) , suitable for use by a 20 ton fire department vehicle shall be installed. This improvement, or provisions to guarantee its installation shall be completed prior to recordation. 11. That the access road(s) shall be a minimum surfaced width of 15 feet and located within an access easement a minimum of 20 feet wide, from Wicks Road to Parcels No. 1, 2, 3, and 4. 12. That the access road(s) shall be certified by a registered civil engineer as having an all-weather surface in conformation with Public Works Standards. This certification shall be submitted to the Ventura County Bureau of Fire Prevention prior to occupancy. 13. That if the subject parcel is not within or not annexing to a Water Purveyor District, an acceptable private water system for fire protection shall be provided prior to conbustible construction. 14. That if the subject parcel is within a Water Purveyor District, water mains capable of providing 1,000 GPM at 20 psi shall be installed from the public right-of-way, or from the purveyor point of connection to all property lines of Parcels No. 1, 2, 3, and 4. The cost of engineering, installation and maintenance of these mains shall be that of the applicant of this division (Parcel Map) . That the applicant shall provide to the Fire Department verification from the water purveyor that the purveyor can provide the required fire flow for the project. 17. That the private road shall be named. The street name(s) shall be submitted to the Bureau of Fire Prevention for review prior to recordation. 18. That street name signs shall be installed in conjunction with the road improvement. The type of sign shall be in accordance with Plate F-4 of Ventura County Road Standards. PROPERTY ADMINISTRATION AGENCY CONDITION: 19. That prior to recordation the applicant shall pay all fees as determined by the PAA pursuant to Ventura County Ordinance Code, Sections 8297-4 et seq. , as such sections read as of the date the parcel or final map is recorded, for the purpose of providing fees in lieu of land dedication for local park acquisition and/or development for the future residents of the subdivision. PUBLIC WORKS AGENCY CONDITIONS: 20. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, road improvement plans, prepared by a Registered Civil Engineer; shall enter into an agreement with the County of Ventura to complete the improvements; and shall post sufficient surety in an amount agreed upon by the Public Works Agency guaranteeing the construction of the improvements. The improvements to Wickes Road shall include an A.C. berm on the north side of the road, and paving for a 24 food wide roadway from Walnut Canyon Road to the property line on the west side of the project site. 21. That prior to the submittal of the Final Map, the developer shall transmit by certified mail a copy of the conditionally approved tentative map together with a copy of Section 66436 of the State Subdivision Map Act to each public entity or public utility that is an easement holder of record. Written compliance shall be submitted to the Public Works Agency. 22. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, grading plans, drainage plans, hydrologic, and hdraulic calculations prepared by a Registered Civil Engineer. The drainage plans and calculations shall indicate the following conditions: Water flow rates, major water courses, drainage areas and patterns, diversions, collection systems, flood hazard areas, sumps and drainage courses. 23. That prior to any work being conducted within the State or County right-of- way, the developer shall obtain an Encroachment Permit from the appropriate Agency. 24. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, road improvement plans for the access roads from Wickes Road to Parcels 1 and 2 and Parcels 3 and 4, prepared by a Registered Civil Engineer; shall enter into an agreement with the County of Ventura to complete these improvements; and shall post sufficient surety in an amount agreed to by the Public Works Agency guaranteeing the completion of the improvements. 25. That prior to the issuance of a Building Permit, the developer shall deposit with the Public Works Agency, a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit shall be the then current Los Angeles Avenue Improvement Area of Contribution applicable rate at the time the Building Permit is issued. That if archaeological or historical artifacts are uncovered, the permittee shall ensure the preservation of the site; shall obtain the services of a qualified archaeologist to recommend proper disposition of the site; and shall obtain the Public Works Agency's written concurrence of the recommended disposition before resuming development. Proposal: Applicant proposes to divide a 6.67 acre parcel into four lots: 2 .2 acres, 2 . 2 acres, 1 . 0 acres and 1.3 acres. 4 . Location and Parcel Number: (See attached map) The subject property designated as Assessor' s Parcel No. 512-05-11 and 512-05-08 is located in the Moorpark Sphere of Interest. The site is adjacent and north of Wicks Road. 5 . Responsible Agencies: LAFCO II. STATEMENT OF ENVIRONMENTAL FINDINGS: An initial study was conducted by the Planning Division to evaluate the potential effect of this project upon the environ- ment. Based upon the findings contained in the attached initial study it has been determined that this project will not have a significant effect upon the environment. III. MITIGATION MEASURES INCLUDED TO AVOID POTENTIALLY SIGNIFICANT EFFECTS : See Annexation Section of Initial Study Attachment. IV. PUBLIC REVIEW: 1.
