HomeMy WebLinkAboutMIN 2013 1106 CC SPC MINUTES OF THE CITY COUNCIL Moorpark, California November 6, 2013 A Special Meeting of the City Council of the City of Moorpark was held on November 6, 2013, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:32 p.m. 2. ROLL CALL: Present: Councilmembers Mikos, Millhouse, Van Dam, and Mayor Parvin. Absent: Councilmember Pollock (arrived following reconvened special meeting closed session at 10:12 p.m.) Staff Present: Steven Kueny, City Manager; Kevin Ennis, City Attorney; Hugh Riley, Assistant City Manager; Deborah Traffenstedt, Deputy City Manager; David Bobardt, Community Development Director; and Joseph Vacca, Principal Planner. 3. PUBLIC COMMENT: None. 4. REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 5. CLOSED SESSION: Mr. Kueny requested the Council go into closed session for discussion of one case under Item 5.A. on the agenda. Mr. Ennis announced that pursuant to Government Code Section 54956.9(e)(1), the facts and circumstances that might result in litigation, which the City believes are not yet known to a potential plaintiff, need not be disclosed. MOTION: Councilmember Millhouse moved and Mayor Parvin seconded a motion to adjourn to closed session for discussion of one case under Item 5.A. on the agenda. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Significant exposure to litigation pursuant to Subdivision (b) of Section 54956.9 of the Government Code: (Number of cases to be discussed - 4) Present in closed session were Councilmembers Mikos, Van Dam, and Mayor Parvin; Steven Kueny, City Manager; Kevin Ennis, City Attorney; Hugh Riley, Assistant City Manager; Deborah Traffenstedt, Deputy City Manager; David Bobardt, Community Development Director; and Joseph Vacca, Principal Planner. The Council reconvened into open session at 7:02 p.m. Mr. Kueny stated one case under Item 5.A. was discussed and there was no action to report He also stated the meeting would be recessed at this time and then reconvened for continued closed session following the regular November 6, 2013, City Council meeting. The Council reconvened the special meeting at 10:12 p.m. following the regular City Council meeting. Mr. Kueny announced that the Council would be going back into closed session for discussion of two cases under Item 5.B. and for discussion of Item 5.C. on the agenda. MOTION: Councilmember Millhouse moved and Councilmember Pollock seconded a motion to adjourn to closed session for discussion of two cases under Item 5.B. and for discussion of Item 5.C. on the agenda. The motion carried by unanimous voice vote. The time was 10:12 p.m. B. CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION Initiation of litigation pursuant to Subdivision (c) of Section 54956.9 of the Government Code: (Number of cases to be discussed — 4) C. CONFERENCE WITH LEGAL COUNSEL— EXISTING LITIGATION (Pursuant to Subdivision (a) of Section 54956.9 of the Government Code) Mario Riley vs. City of Moorpark (Case No. 56-2012-004-28596-CU-OE- VTA) Present in closed session were Councilmembers Mikos, Millhouse, Pollock, Van Dam, and Mayor Parvin; Steven Kueny, City Manager; Kevin Ennis, City Attorney; Tilden Kim, attorney with Richards, Watson and Gershon (via conference call); Hugh Riley, Assistant City Manager; Deborah Traffenstedt, Deputy City Manager; and David Bobardt, Community Development Director. Mr. Bobardt left the meeting at 10:22 p.m. Mr. Kim, Mr. Kueny, Mr. Riley, and Ms. Traffenstedt left the meeting at 10:25 p.m. The Council reconvened into open session at 11:16 p.m. Mr. Ennis stated that two cases under Item 5.B. and Item 5.C.were discussed and there was no action to report.
