1) Find the draft Seven Year Capital Improvement Program for the Department of
Public Works for FY 2013/14 — FY 2019/20 to be in conformity with the Moorpark

BACKGROUND
On October 30, 2013, an application for a Conditional Use Permit (CUP) No. 2013-03
was filed by Vance Pomeroy (Velotera Services, LLC) for AT&T. The applicant is
requesting a CUP for a Wireless Communications Major Facility to install 12 panel
antennas screened by two 10-foot high parapets located on the rear corners of an
existing industrial building and install aboveground mechanical equipment storage,
located at 6144-6176 Condor Drive.
DISCUSSION
Project Setting
Existing Site Conditions:
The industrial building is located on the north side of Condor Drive, approximately 230
feet east of Princeton Avenue; south of the SR-118 Freeway. The building is one-story
with a mezzanine and is subdivided into two units: 6176 Condor Drive on the west and
6144 Condor Drive on the east. 6176 Condor Drive is occupied by Simi Motorsports, a
motorcycle dealership and repair facility, and 6144 Condor Drive is occupied by Action

Sports Games USA, a distribution warehouse. Access to the property is from Condor
Drive.
Previous Applications:
On July 18, 1998, the City Council adopted Resolution. No. 98-1489 approving Industrial
Planned Development (IPD) No. 98-01 to 98-03, for the construction of two separate
industrial buildings, one located at 6190 Condor Drive (IPD No. 98-3) and one located at
6176 and 6144 Condor Drive (IPD Nos. 98-1 and 98-2 respectively).
On January 15, 2003, the Planning Commission approved CUP No. 2002-06, to allow a
factory authorized Harley Davidson motorcycle dealership with service, storage and
retail areas, at 6190 Condor Drive. Conditional Use Permit No. 2012-04 was approved
on June 26, 2012, for the expansion of the motorcycle dealership to include
approximately 20,850 square feet at 6176 Condor Drive for service of motorcycles, a
showroom, office space, storage, and retail sales of motorcycle parts and apparel.

General Plan and Zoning Consistency:
The applicant's proposal for a roof-mounted facility meets the definition of a "Major
Facility" in the Wireless Communications Facilities chapter of the Zoning Ordinance and
requires a Conditional Use Permit in the Industrial Park (M-1) zone. Extensions above
the existing parapet of the building are required to be screened by a material that is
compatible with existing design, color and architecture of the building and must comply
with all other provisions of Sections 17.42.070.B and 17.42.070.0 of the Municipal
Code. The proposed cellular facility is consistent with the light industrial designation of
the City's General Plan.

Proposed Project
Antennas:
The proposed wireless communication facility consists of 12 panel antenna arrays set at
an overall height of 10-feet above the top of the existing building. The antennas
measure at 6-feet tall and approximately 12 inches in width, and are mounted on a 4-
foot pole. They are screened by two parapet structures located on the northeast and
northwest (rear) corners of the industrial building. The parapet on the northwest corner
is designed to screen 4 antenna arrays, while the parapet on the northeast corner is
designed to screen 8 antennas. The northwest corner has additional space to add more
antenna arrays; however, there are no intentions of adding more antennas at this time.
The facility transmits signals between the panel antennas and wireless telephones and
computers within the coverage area in the industrial area and the residential
communities in the northern part of the City.
The height of the existing building, to the top of the parapet, is 31 feet. In the Industrial
Park (M-1) Zone, there currently is a maximum allowable height of 30 feet; however, a
roof-mounted wireless communications major facility such as this may exceed this
maximum building height limit, but not more than 10 feet above the height of the existing
building, if approved by the Planning Commission as a disguised or stealth facility. This
is discussed in the analysis section below. According to the applicant, the typical
antenna height for most AT&T installations is 41 feet, which gives a coverage radius of
approximately three miles. Antennas below this height would reduce the intended
coverage objective.
Above Ground Equipment Enclosure and Cabling:
An 8-foot wide by 18-foot long above ground mechanical equipment storage structure is
proposed for this facility, to be located in an existing parking space (discussed below),
next to an uncovered trash enclosure. A 6-foot high concrete block wall is proposed to
enclose 3 cabinets and 2 GPS antennas. The above ground mechanical equipment
storage is proposed to have a metal door and a wooden trellis, which would extend
across the top of the trash enclosure. The equipment will operate on a 24-hour, 7-day a
week remote sensing basis. A cable tray riser is proposed on the outside of the building
to connect the antennas to an underground run to the equipment enclosure. The
coverage of the equipment storage structure and trash enclosure, along with the
proposed external cable tray riser, are discussed in the analysis section.
Compatibility with the Surrounding Area:
The materials proposed to be used in construction of the site would not create
substantial glare that would affect either daytime or nighttime views in the area. The
proposed use is located in an area that is not likely to impact any of the adjacent uses,
due to its location. Additionally, staff has added a Condition of Approval that the
parapet shall be.painted to complement the existing industrial building.

The proposed cellular facility is considered a passive use, which would not produce
noise, not violate any air quality standards, affect biological resources, or cause an
adverse effect on cultural resources. It will require no transport of hazardous materials
to or from the site. Although the proposed use is designed to primarily serve the
surrounding industrial area and residential communities, it would not induce substantial
population growth, nor displace existing housing or have a negative impact on public
services. Therefore, the proposed cellular antenna facility operation will not disturb the
surrounding area or be harmful or detrimental to neighboring properties or uses.
Parking and Loading:
The project site currently has 90 parking spaces, of which 86 are required. The site
also has 2 loading spaces, both of which are required. The project proposed to utilize
one parking space for an equipment enclosure. The site plan also shows a proposal to
replace the parking space lost, however, the replacement location is in a required
loading area. Staff was unable to identify any other viable options for replacement of
the parking space. Because the replacement parking space is not needed as required
parking for the building, it should be removed from the plan. A condition is included to
maintain required parking and loading spaces on the site.
ANALYSIS
Issues
Staff analysis of the proposed project has identified height and aesthetics as the primary
issues for Planning Commission consideration in their decision, which are discussed
below.
Under the current code, no wireless communications major facility may exceed the
maximum building height for the applicable zoning district in which the facility is
proposed to be located (30 feet), unless the Planning Commission determines that it
has been designed as a disguised or stealth facility, in which case the facility could be
up to 10 feet above the existing building height. In addition, a condition of approval on
the IPD Permit allowed for rooftop equipment only when it is screened on all four sides
by view obscuring material that is an integral design element of the building.
The existing building height to the top of the parapet is 31 feet. The applicant is
proposing two parapet structures on the two rear corners of the building rising 10 feet
above the existing building height for a maximum height of 41 feet. All antennas will be
hidden behind the parapet structures. The parapets would be 4-sided structures set
back slightly from the existing building parapet to avoid their taking on a dominant
appearance. The material proposed for the exterior of the parapets is lightly textured
fiberglass-reinforced composite with vertical reveals proposed to be painted gray to
match the gray of the existing building parapet. Though views from the street would be
limited, the parapets structures would be more visible from adjacent parking areas and
for a brief time from travelers on the SR-118 freeway. Their design is compatible with
the overall building design, and as such, the facility could be considered a disguised or

stealth facility. Given the overall horizontal massing of this building, however, staff
recommends a condition of approval that the reveals on the parapet structure be
oriented horizontally to minimize their vertical appearance.
The proposed external cable tray riser is not compatible with the design of the existing
building, as the building was designed with no visible exterior ducting. Downspouts are
internal to the structure. A condition is recommended to prohibit any cabling, conduit
and risers that would be visible from the building exterior. A trellis is proposed across
the equipment enclosure to also cover the trash enclosure. Current City standards
require that trash facilities be fully covered to reduce stormwater pollution. A condition is
recommended that a full roof be incorporated in the design to address this issue. The
condition is recommended for both trash enclosures on the project site to ensure that
roof structures match each other. In addition, a condition of approval is recommended
that, in the event that these antenna arrays are abandoned, the applicant shall remove
the facility, including parapet structures and equipment structure within 90 days at the
request of the Community Development Director. The property owner would be
responsible for removing the facility if the applicant fails to remove it.
Findings
Conditional Use Permit Findings:
A. The proposed use is consistent with the provisions of the General Plan, zoning
ordinance, and any other applicable regulations, in that the proposed use, height,
setbacks and improvements are consistent with City Code requirements.
B. The proposed use is compatible with both existing and permitted land uses in the
surrounding area, in that the wireless communication facility will provide
additional cellular service to the industrial area and the residential communities in
the northern part of the City. The existing industrial building has been determined
to be an appropriate location for a wireless communication facility by the city.
C. The proposed use is compatible with the scale, visual character and design of
surrounding properties, in that it is designed so as not to detract from the
physical and visual quality of the area. The material and color of the parapets as
conditioned complement the existing industrial building.
D. The proposed use would not be obnoxious or harmful, or impair the utility of
neighboring property or uses, in that the proposed use has been designed to
eliminate any negative visual impacts.
E. The proposed use would not be detrimental to the public health, safety,
convenience, or welfare, in that the project has been conditioned to protect the
public's health and safety.
Wireless Facilities Findings:
A. The proposed facility will not create any significant blockage to public views, in that
the cellular facility will be placed on the rear corners of an existing industrial building.

B. The proposed facility will be an enhancement to the City due to its ability to
provide additional communication capabilities in the northern part of the City.
C. The proposed facility will be aesthetically integrated into its surrounding land
uses and natural environment, in that it will be painted a color that will
complement the colors of the existing industrial building.
D. The proposed facility will comply with FCC regulations regarding interference
with the reception or transmission of other wireless service signals within the City
and surrounding community.
E. The proposed facility will operate in compliance with all other applicable Federal
regulations for such facilities, including safety regulations, in that AT&T operates
its wireless network in compliance with its FCC license and FCC rules and
regulations concerning frequency emissions and/or radio frequency interference.
The transmission densities emanating from the facility will not exceed current
American National Standards Institute (ANSI) recommended maximum exposure
levels for wireless transmission frequencies which do not have the potential to
significantly impact the community. In all cases, Effective Radiated Power
(ERP), and its associated electromagnetic (EM) radiation power densities are a
small fraction of the maximum permissible exposure set by ANSI, or the more
restrictive exposure standard put forth by the National Commission on Radiation
Protection and Measurement (NCRP).
F. The public need for the use of the cellular facility has been documented
consistent with California law, in that the proposed cell site will provide a
substantial increase in the coverage area (an increase from weak coverage to
good coverage in the target area).
G. The applicant will provide at its own expense a field survey or other method
consistent with Federal law to provide written verification that the facility is in
compliance with applicable Federal regulations regarding electromagnetic
frequency emissions. This radio-frequency (RF) report shall also include signal
strength exhibits, including calculations and measurements under maximum
loading conditions. Such field survey shall be provided to the City upon request,
not to exceed one such request in any 24-month period.
PROCESSING TIME LIMITS
Time limits have been established for the processing of development projects under the
Permit Streamlining Act (Government Code Title 7, Division 1, Chapter 4.5), the
Subdivision Map Act (Government Code Title 7, Division 2), and the California
Environmental Quality Act Statutes and Guidelines (Public Resources Code Division 13,
and California Code of Regulations, Title 14, Chapter 3). Under the applicable
provisions of these regulations, the following timelines have been established for action
on this project:

NOTICING
Public Notice for this Conditional Use Permit was given consistent with Chapter
•
17.44.070 of the Zoning Ordinance as follows:
1. Publication. The notice of the public hearing was published in the Ventura
County Star on May 10, 2014.
2. Mailing. The notice of the public hearing was mailed on May 9, 2014 to owners
of real property, as identified on the latest adjusted Ventura County Tax
Assessor Roles, within one-thousand (1,000) feet of the exterior boundaries of
the assessor's parcel(s) subject to the hearing.
3. Sign. One 32 square foot sign is to be placed on the street frontage by May 16,
2014.
ENVIRONMENTAL DETERMINATION
In accordance with the City's environmental review procedures adopted by resolution,
the Community Development Director determines the level of review necessary for a
project to comply with the California Environmental Quality Act (CEQA). Some
projects may be exempt from review based upon a specific category listed in CEQA.
Other projects may be exempt under a general rule that environmental review is not
necessary where it can be determined that there would be no possibility of significant
effect upon the environment. A project which does not qualify for an exemption
requires the preparation of an Initial Study to assess the level of potential
environmental impacts.
Based upon the results of an Initial Study, the Director may determine that a project will
not have a significant effect upon the environment. In such a case, a Notice of Intent to
Adopt a Negative Declaration or a Mitigated Negative Declaration is prepared. For
many projects, a Negative Declaration or Mitigated Negative Declaration will prove to be
sufficient environmental documentation. If the Director determines that a project has
the potential for significant adverse impacts and adequate mitigation cannot be readily
identified, an Environmental Impact Report (EIR) is prepared.
The Community Development Director has determined that the project is categorically
exempt from the requirements of the California Environmental Quality Act (CEQA) and
the City's CEQA Guidelines. The project qualifies under the Class 3 exemption under
State CEQA Guidelines Section 15303 (New Construction or Conversion of Small
Structures)because of the proposed 12 panel antennas screened by two 10-foot high
parapets located on the rear corners of the industrial building and mechanical
equipment storage enclosure are small structures compatible with the existing building
and site on which they would be installed and compatible with surrounding land uses. In
addition, the use is consistent with the applicable general plan designation and all
applicable general plan policies as well as with applicable zoning designation and

regulations, and there is no substantial evidence that the project will have a significant
effect on the environment.
STAFF RECOMMENDATION
1. Open the public hearing, accept public testimony and close the public hearing;
and
2. Adopt Resolution No. PC-2014- conditionally approving Conditional Use
Permit No. 2013-03.

WHEREAS, On October 30, 2013, an application was filed for Conditional Use
Permit (CUP) No. 2013-03 by Vance Pomeroy (Velotera Services, LLC) for AT&T to
install 12 panel antennas screened by two 10-foot high parapets located on the rear
corners of an existing industrial building; and, to install an aboveground mechanical
equipment storage, located at 6144 Condor Drive; and
WHEREAS, at a duly noticed public hearing on May 27, 2014, the Planning
Commission considered Conditional Use Permit (CUP) No. 2013-03; and
WHEREAS, at its meeting of May 27, 2014, the Planning Commission
considered the agenda report and any supplements thereto and written public
comments; opened the public hearing and took and considered public testimony both
for and against the proposal; closed the public hearing and reached a decision on this
matter; and
WHEREAS, The Community Development Director has determined that the
project is categorically exempt from the requirements of the California Environmental
Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies under the
Class 3 exemption under State CEQA Guidelines Section 15303 (New Construction or
Conversion of Small Structures) because, the proposed 12 panel antennas screened
by two 10-foot high parapets located on the rear corners of an existing industrial
building and mechanical equipment storage enclosure are small structures compatible
with the existing building and site on which they would be installed and compatible with
surrounding land uses. In addition, the use is consistent with the applicable general plan
designation and all applicable general plan policies as well as with applicable zoning
designation and regulations, and there is no substantial evidence that the project will
have a significant effect on the environment.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DOCUMENTATION: The Planning
Commission concurs with the Community Development Director's determination that the
project is categorically exempt from the requirements of the California Environmental
Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies under the
Class 3 exemption under State CEQA Guidelines Section 15303 (New Construction or
Conversion of Small Structures) because of the proposed 12 panel antennas screened
by two 10-foot high parapets located on the rear corners of an existing industrial
building and mechanical equipment storage enclosure are small structures compatible
with the existing building and site on which they would be installed and compatible with
surrounding land uses. In addition, the use is consistent with the applicable general plan
designation and all applicable general plan policies as well as with applicable zoning
designation and regulations, and there is no substantial evidence that the project will
have a significant effect on the environment. The Planning Commission has reviewed
the Community Development Department's determination of exemption, and based on
its own independent judgment, concurs in staffs determination of exemption.
SECTION 2. CONDITIONAL USE PERMIT FINDINGS: Based upon the
information set forth in the staff report(s), accompanying studies, and oral and written
public testimony, the Planning Commission makes the following findings in accordance
with City of Moorpark, Municipal Code Section 17.44.040:
A. The proposed use is consistent with the provisions of the General Plan, zoning
ordinance, and any other applicable regulations, in that the proposed use, height,
setbacks and improvements are consistent with City Code requirements.
B. The proposed use is compatible with both existing and permitted land uses in the
surrounding area, in that the wireless communication facility will provide
additional cellular service to the industrial area and the residential communities in
the northern part of the City. The existing industrial building has been determined
to be an appropriate location for a wireless communication facility by the city.
C. The proposed use is compatible with the scale, visual character and design of
surrounding properties, in that it is designed so as not to detract from the
physical and visual quality of the area. The material and color of the parapets as
conditioned complement the existing industrial building.
D. The proposed use would not be obnoxious or harmful, or impair the utility of
neighboring property or uses, in that the proposed use has been designed to
eliminate any negative visual impacts.
E. The proposed use would not be detrimental to the public health, safety,
convenience, or welfare, in that the project has been conditioned to protect the
public's health and safety.

SECTION 3. WIRELESS FACILITIES FINDINGS:
A. The proposed facility will not create any significant blockage to public views, in
that the cellular facility will be placed on the rear corners of an existing industrial
building.
B. The proposed facility will be an enhancement to the City due to its ability to
provide additional communication capabilities in the northern part of the City.
C. The proposed facility will be aesthetically integrated into its surrounding land
uses and natural environment, in that it will be painted a color that will
complement the colors of the existing industrial building.
D. The proposed facility will comply with FCC regulations regarding interference
with the reception or transmission of other wireless service signals within the City
and surrounding community.
E. The proposed facility will operate in compliance with all other applicable Federal
regulations for such facilities, including safety regulations, in that AT&T operates
its wireless network in compliance with its FCC license and FCC rules and
regulations concerning frequency emissions and/or radio frequency interference.
The transmission densities emanating from the facility will not exceed current
American National Standards Institute (ANSI) recommended maximum exposure
levels for wireless transmission frequencies which do not have the potential to
significantly impact the community. In all cases, Effective Radiated Power
(ERP), and its associated electromagnetic (EM) radiation power densities are a
small fraction of the maximum permissible exposure set by ANSI, or the more
restrictive exposure standard put forth by the National Commission on Radiation
Protection and Measurement (NCRP).
F. The public need for the use of the cellular facility has been documented
consistent with California law, in that the proposed cell site will provide a
substantial increase in the coverage area (an increase from weak coverage to
good coverage in the target area).
G. The applicant will provide at its own expense a field survey or other method
consistent with Federal law to provide written verification that the facility is in
compliance with applicable Federal regulations regarding electromagnetic
frequency emissions. This radio-frequency (RF) report shall also include signal
strength exhibits, including calculations and measurements under maximum
loading conditions. Such field survey shall be provided to the City upon request,
not to exceed one such request in any 24-month period.
SECTION 4. PLANNING COMMISSION APPROVAL: the Planning
Commission herby approves Conditional Use Permit No. 2013-03 subject to the
Standard and Special Conditions of Approval found in Exhibit A attached.

SECTION 5. FILING OF RESOLUTION: The Community Development
Director shall cause a certified resolution to be filed in the book of original resolutions.

STANDARD AND SPECIAL CONDITIONS OF APPROVAL FOR
CONDITIONAL USE PERMIT (CUP) No. 2013-03
STANDARD CONDITIONS OF APPROVAL
The applicant shall comply with Standard Conditions of Approval for Conditional Use
Permits as adopted by City Council Resolution No. 2009-2799 (Exhibit B), except as
modified by the following Special Conditions of Approval. In the event of conflict
between a Standard and Special Condition of Approval, the Special Condition shall
apply.
SPECIAL CONDITIONS
1. This Conditional Use Permit is granted or approved with the City's designated
approving body retaining and reserving the right and jurisdiction to review and to
modify the permit—including the conditions of approval—based on changed
circumstances. Changed circumstances include, but are not limited to, major
modification of the business; a change in scope, emphasis, size, or nature of the
business; the expansion, alteration, reconfiguration, or change of use; or the fact
that the use is negatively impacting surrounding uses by virtue of impacts not
identified at the time of application for the conditional use permit or impacts that.
are much greater than anticipated or disclosed at the time of application for the
conditional use permit. The reservation of right to review any permit granted or
approved under this chapter by the City's designated approving body is in
addition to, and not in lieu of, the right of the City, its Planning Commission, City
Council and designated approving body to review and revoke or modify any
permit granted or approved under this chapter for any violations of the conditions
imposed on such permit.
2. The development must be in substantial conformance with the plans presented in
conjunction with the application for Conditional Use Permit No. 2013-03, except
any modifications as may be required to meet specific Code standards or other
conditions stipulated herein.
3. Approval of a Zoning Clearance is required prior to the issuance of any new
Building Permits. All contractors must have valid City of Moorpark Business
Registrations.
4. This facility is approved as an unstaffed operation. Following construction of the
facility, traffic generated by this use shall be limited to periodic and emergency
maintenance of the facility. Required parking and loading spaces on the site
shall be maintained in compliance with Zoning Ordinance.
5. The applicant will provide, at its expense, a field survey or other method
consistent with Federal law to provide written verification that the facility is in
compliance with applicable Federal regulations regarding electromagnetic
frequency emissions. This radio-frequency (RF) report shall also include signal

strength exhibits, including calculations and measurements under maximum
loading conditions. Such field survey shall be provided to the City upon request,
not to exceed one (1) such request in any 24-month period.
6. The applicant shall allow the City to co-locate a radio antenna on the structure
and place associated equipment and electronics within or on the ground level
equipment cabinet, at no cost, so long as this is done for City purposes at the
expense of the City, there is no interference with the operation of the primary
equipment, and that security and access are feasible.
7. Prior to the issuance of a Zoning Clearance for any new building permits, the
applicant shall submit all construction plans for review and approval by the
Community Development Director.
8. Reveals on the parapet structures shall be oriented horizontally to complement
the overall horizontal massing of the building, the parapet structures shall be
painted to match existing colors on the building, cabling shall be routed inside the
building to avoid the visibility of cabling or the addition of a cable tray riser to the
exterior of the building, and the equipment enclosure shall be designed with a
roof that covers both the equipment enclosure and both trash enclosures on the
project site to prevent stormwater pollution to the satisfaction of the Community
Development Director.
9. The wireless facilities under this permit shall be maintained so that the materials
and colors remain compatible with the rest of the building. Failure to maintain
these facilities to the satisfaction of the Community Development Director shall
result in the scheduling of a revocation hearing.
10. In the event that this antenna array is abandoned, the applicant shall remove the
facility within ninety (90) days at the request of the Community Development
Director. Should the facility owner fail to remove the facility upon abandonment,
the property owner shall be responsible for its removal.
11. In the event that the uses under this Conditional Use Permit are determined to be
abandoned, the City of Moorpark may, at its discretion, initiate revocation
procedures for cause per the provisions of Section 17.44.080. For purposes of
this condition, "abandoned" shall mean a cessation of a business or businesses
which would render the use unavailable to the public for a period of 180 or more
consecutive days. Initiation of revocation procedures may result in the
revocation of the permit or modification of the permit, based upon the evidence
presented at the hearing.

SUBJECT: Consider Draft Seven-Year Capital Improvement Program for the
Department of Public Works for FY 2013/14— FY 2019/20
BACKGROUND
Staff has prepared a draft of the City's updated seven-year Capital Improvement
Program (CIP) for FY 2013/14 — FY 2019/20 for the Department of Public Works
(attached).
As in past years, prior to City Council action approving the CIP, it is necessary that the
Planning Commission first review the document and render a finding with regard to its
conformity with the Moorpark General Plan, as required by Section 65401 of the
Government Code of the State of California. This staff report summarizes the
recommended changes from the previous CIP, and requests that the Planning
Commission render its finding with regard to General Plan conformity.
Also included in this report is a description of certain projects which require acquisition
of additional street right-of-way, and a request that said acquisitions are also in
conformance with the Moorpark General Plan, as required by Section 65402 of the
Government Code of the State of California.
DISCUSSION
A. General Plan Conformity
Public Works, Engineering and Community Development staff has reviewed the
draft CIP and have confirmed the following: ,

1) All of the future streets and other Public Works projects listed in the Circulation
Element and other elements of the Moorpark General Plan have been included
in the CIP.
2) The Circulation Element of the Moorpark General Plan designates Moorpark
Avenue to be a two lane local collector. CIP Project 113: Moorpark Avenue
Widening calls for the widening of Moorpark Avenue to more than two (2)
lanes. Said project is, therefore, inconsistent with the provisions of the
Circulation Element of the Moorpark General Plan.
3) Except as noted above, the projects listed in the subject draft CIP are in
conformance with the Moorpark General Plan.
Staff is currently working to update and revise the Circulation Element and will
present this document to the City Council in the near future. It is the intent of staff
to include in the recommended changes, a different designation for Moorpark
Avenue which will allow for more than two (2) lanes of traffic.
B. Right-of-Way Acquisition
The following projects will require acquisition of additional street right-of-way:

said acquisitions to be in conformance with the Moorpark General Plan.

C. Revisions to the CIP
The following revisions have been made to the CIP for FY 2013/14 — FY 2019/20:
• The description of Project 8086 — Sidewalk and Bicycle Lane at AVRC, and
the Civic Center Pedestrian Access and Bus Stop Improvement Project was
modified to clarify that these are Parks, Recreation and Community Services
Department projects.
• The following projects were added to Appendix I —Completed Projects:

Capital Improvement Program
A. Introduction
This is the updated Seven Year Capital Improvement Program (CIP) for the City of Moorpark,
Department of Public Works for the period covering FY 2013/14 through FY 2019/20. The primary
purpose of this CIP is to provide the City Council with a framework for identifying, planning and
prioritizing needed municipal capital improvements. The year each project is recommended to be
funded, is an indication of the priority given to each project. The figures cited in the FY 13/14 column,
should be identical to the appropriations approved in the FY 2013/14 Budget for capital improvement
projects for(8000 series).
Projects have been organized into the five (5) Sections noted below. The projects identified in this CIP
include both City funded projects as well as major projects which are likely to be constructed by land
developers. The projects listed in Section 100 include future streets which are identified in the
Circulation Element of the Moorpark General Plan. The projects listed in Section 500 include future
needed storm drains identified in the Moorpark Master Drainage Study. Also included in Section 500
are certain projects of importance to the City which are planned to be constructed by the Ventura
County Watershed Protection District.
A brief description of the contents of this CIP is as follows:

It should be noted that there has been no preliminary engineering performed for most of
the projects programmed in future years. The cost estimates provided for those projects
are a rough estimate only and should not be relied upon to predict actual costs. These
estimates were included in the project descriptions in order to provide a general idea of
the total estimated program costs. Individual project cost estimates will be revised as
engineering for each project is developed.

Project Description
Construction of improvements and modifications to Spring Road, from a point south of Los Angeles
Avenue northerly to Flinn Avenue. This project requires the acquisition of additional street right-of-way,
widening, new curb, gutter and sidewalk along the east side of the street. Ultimate improvements will
include four (4) travel lanes, six foot (6') wide bike lanes, a fourteen foot (14') wide landscaped median
and double left-turn lanes southbound on Spring Road. The project extends south of Los Angeles Avenue
to accommodate a shift of the centerline to the east. The project also includes new signal poles at the
northeast and southeast corners of Los Angeles Avenue and Spring Road.

Project Description
Widening, realignment and reconstruction of Princeton Avenue from a point east of Spring Road to South
Condor Drive. Additional street right-of-way is being acquired to provide an eighty-eight feet (88') wide
corridor — sufficient to allow for future widening of the road to four lanes. The current project design
provides for only one lane in each direction with a paved median and paved shoulders. The project plans
call for the realignment and reconstruction of the street pavement, the construction of storm drains and the
construction of retaining walls as required.

Project Description
Widening of Los Angeles Avenue to provide for six (6) travel lanes of traffic. At Spring Road the
centerline will be shifted to the south to avoid acquiring right-of-way from the residential properties along
the north side of the street. The additional right-of-way in this area will be acquired from the south side of
the street. At Moorpark Avenue the additional street right-of-way will be acquired from the north side of
the street. The project includes westbound right-turn lanes at Spring Road and at Moorpark Avenue, and a
new traffic signal at Millard Street.

Project Description
This project provides for street widening and improvements to the rail crossing by adding a center median
and four(4) crossing gates. The project also includes acquisition of additional street right-of-way and street
widening on the east side of the street between the rail crossing and Princeton Avenue to provide an

Project Description
Prior Year costs are for the Arroyo Simi Trail Study. That study evaluated options for the possible future
development of a trail system, generally along the levee road of the Arroyo Simi, from the westerly City
Limit easterly to Madera Road in the City of Simi Valley. Future expenses are for projects to implement

The existing Ventura County Watershed Protection District [VCWPD] facilities within the Gabbert Canyon
and Walnut Creek watersheds are inadequate. This project calls for the construction of new detention,
diversion and capacity enhancement improvements to those existing facilities. The 2006 cost estimate for
those improvements was estimated to be $12,000,000 plus financing costs. No implementation or
financing plan has yet been developed. Some of the required improvements have been, or are planned to

Project Description
There is a culvert under Arroyo Drive at the entrance to the Villa Del Arroyo Mobile Home Park, which
connects to a storm drain pipe owned by the Mobile Home Park. This"private"drain line extends southerly
to the arroyo. It has been determined that the function of that storm drain is impaired and that remedial
action must be taken in order to provide adequate drainage for both the City street and the Mobile Home
Park. Consistent with the provisions of a Settlement Agreement between the City and the Mobile Home
Park, the property owner is required to take corrective action to remedy this problem.

Project Description .
A number of projects, to be undertaken by the Ventura County Watershed Protection Agency, to construct
improvements to the Arroyo Simi to render it capable of containing flows from a 100 year storm event, in a

Capital Improvement Program
D. Congestion Management Program
The purpose of the Ventura County Transportation Commission's (VCTC) Congestion
Management Program (CMP) is to monitor certain street segments and/or intersections
on the CMP Road Network (see Map), to confirm that the Level of Service (LOS) [a
measurement of the level of congestion] on those segments, or at those intersections,
does not deteriorate below certain stipulated levels. Increased traffic generated by
development is one of the major causes of increased traffic congestion and, therefore,
the deterioration of the LOS. The CMP requires each Agency to identify projects
designed to increase capacity and/or otherwise improve the efficient and effective
movement of traffic. The projects set forth in this seven year program, which are on the
CMP Road Network and which could reduce congestion, are listed on the following
page.

#G, and Making a Determination of Exemption Under CEQA in
Connection Therewith on the Application of Devery Morgan (No Curdinary
Whey). Staff Recommendation: 1) Open the public hearing, accept public
testimony, and close the public hearing; and 2) Adopt Resolution No. PC-
2014-597 approving Conditional Use Permit No. 2014-03 with conditions
of approval and making a determination of exemption under CEQA in
