MOORPARK CITY COUNCIL REPORT /� �R AGENDA �a TO: Honorable City Council FROM: Dave Klotzle, City Engineer/Public Works Director DATE: June 20, 2014 (CC Meeting of 07/02/14) SUBJECT: Consider Resolution Establishing Parking by Permit Only Zones Moorpark High School Parking Restrictions and on Appleglen Court Near Section 10.04.190 of the Moorpark Municipal Code and California Vehicle Code Section 22507 allows the City Council to establish parking restrictions by resolution on any City street, and to establish preferential parking privileges for residents adjacent to a street upon which any such parking restrictions have been established, exempting any vehicle displaying a permit issued by the City from such parking restrictions. Over the years, in response to requests from residents, several Parking by Permit Only Zones have been established by City Council resolution, particularly near Moorpark College, Moorpark High School, and for weekends near Peach Hill Park. On February 19, 2014, the City Council adopted Resolution No. 2014-3273 establishing new, and re-establishing existing parking by permit only zones on certain streets in the Campus Hills area, near Moorpark High School and on Peach Hill Road near Peach Hill Park. This resolution re-established the existing "No Stopping Anytime — City Permit Exempt" zone on Summerglen Court near Moorpark High School as well as established a new "No Parking 7:00 a.m. to 3:00 p.m., Monday through Friday — City Permit Exempt" zone on Honeyglen Court, also near Moorpark High School. On February 19, 2014, the City Council also adopted Resolution No. 2014-3274 adopting policies and procedures for establishment of parking by permit only zones and issuance of parking permits within established parking by permit only zones. On April 2, 2014, the City Council adopted Resolution No. 2014-3284 establishing new parking by permit only zones on Delfen Street, Beragan Street, Kernvale Avenue, and portions of Melray Street and Overly Street near Moorpark College. Honorable City Council July 2, 2014 Page 2 DISCUSSION On May 19, 2014, enforcement of the recently established parking by permit only zones began including Honeyglen Court. On May 21, 2014, residents on Appleglen Court, the next street east of Honeyglen Court, began to report to staff that the number of vehicles parked on Appleglen Court during school hours had increased significantly in this neighborhood. As of June 1, 2014, staff received requests from twelve different residents on Appleglen Court for the same parking restrictions that were recently established on Honeyglen Court. The requests included reports of vehicles blocking driveways, trash left near parked vehicles and drivers moving trash cans to park their vehicles. There are twenty-three homes on Appleglen Court. Based on the numerous requests from Appleglen Court residents, and the fact that many vehicles continue to park on this street during school days, staff recommends the adoption of a resolution (Attachment 1) establishing parking restrictions and parking by permit only zones on Appleglen Court from 7:00 a.m. to 3:00 p.m. Monday through Friday, City permits exempt. On June 16, 2014, notices were mailed to all property owners and residents of Appleglen Court describing the actions to be considered by the City Council at this meeting. Attachment 2 is a sample of the notice which indicated that written comments or concerns about the parking by permit only zones could be submitted to the City. The notice also included the date, time and location of this City Council meeting. As of the date this report was prepared, staff has received one email response to the notice (in addition to the twelve requests received prior to the notice being mailed) from an Appleglen Court resident opposed to the parking by permit only zone. FISCAL IMPACT The establishment and administration of the various parking by permit only zones throughout the City has been provided to residents at no cost. Staff estimates that approximately $1,000 will be spent on sign and permit materials, and staff time to implement the parking by permit only zone on Appleglen Court. In addition, approximately $2,000 is spent on materials and staff time on an annual basis for maintenance of signs, printing forms and permits, and issuing permits for the various parking by permit only zones. STAFF RECOMMENDATION Adopt Resolution No. 2014 - Attachment 1: Resolution 2014 - Attachment 2: Sample Notice to Residents 55 Attachment 1 RESOLUTION NO. 2014- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING PARKING RESTRICTIONS AND PARKING BY PERMIT ONLY ZONES ON APPLEGLEN COURT NEAR MOORPARK HIGH SCHOOL WHEREAS, Section 22507 of the California Vehicle Code authorizes the City to establish parking restrictions on any City street, and to establish preferential parking privileges for residents adjacent to a street upon which any such parking restrictions have been established, exempting any vehicle displaying a permit issued by the City from such parking restrictions; and WHEREAS, Section 10.04.190 of the Moorpark Municipal Code sets forth certain parking restrictions, including the establishment of any area or zone where parking or stopping of any vehicle for all or any part of any day is restricted by resolution of the City Council; and, WHEREAS, residents have requested that the City Council of the City of Moorpark establish parking by permit only zones on certain City streets; and WHEREAS, the City Council of the City of Moorpark has determined that it is necessary and appropriate to revise and establish certain parking restrictions, preferential parking privileges and parking by permit only zones. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That "PARKING BY PERMIT ONLY" zones are established on Appleglen Court with parking restrictions during the days and times shown in Exhibit "A." SECTION 2. That parking restrictions established on roads listed herein shall not apply to vehicles displaying a valid permit issued by the City exempting said vehicles from said parking restrictions. SECTION 3. That the establishment of parking by permit only zones, and the issuance of parking permits exempting vehicles from said parking restrictions shall conform to the policies and procedures for establishment of parking by permit only zones and issuance of parking permits within such zones, adopted by resolution of the City Council. 56 Resolution No. 2014 - Page 2 SECTION 4. That parking permits exempting vehicles from said parking restrictions shall not exempt said vehicles from any other parking restriction, including any Street Sweeping Parking Restriction, or any provision of the California Vehicle Code. SECTION 5. That the City Manager is directed to cause the installation and maintenance of appropriate signs giving notice of said parking restrictions. SECTION 6. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
