CITY OF ♦O.'P ., CAUFORNIA City Council Ai FROM: Deborah Traffenstedt, Deputy City Manager Prepared by: Teri Davis, Senior Management Analyst DATE: May 27, 2014 (CC Special Meeting of 5/28/2014) SUBJECT: Consider an Ordinance Revising Section 2.48.040, Disaster Council — Creation — Membership of Chapter 2.48, Emergency Preparedness and Section 2.48.050, Disaster Council — Power and Duties of Title 2 of the Moorpark Municipal Code BACKGROUND AND DISCUSSION Attached is a draft ordinance to revise Section 2.48.040, Disaster Council — Creation — Membership and Section 2.48.050, Disaster Council — Powers and Duties of Chapter 2.48, Emergency Preparedness, of Title 2 of the Moorpark Municipal Code (MMC). This draft ordinance is being presented to the City Council in a Special Meeting to allow time for consideration of a Draft Emergency Operation Plan, and adoption, in July 2014. The attached draft ordinance has been reviewed by the City Attorney. The reason for revising Section 2.48.040 is to reorganize membership. It is recommended by staff, including the City Attorney, that the City Council be appointed as the disaster council. In so doing, membership of the disaster council will shrink from up to fifteen seats to five seats and, among others, civic organizations (representatives from business, labor, veterans, professional or other organizations with official emergency responsibility) will no longer be a component of the City's disaster council. This reorganization will help avoid duplicative efforts of existing countywide emergency planning. The County comprehensive regional emergency planning and preparedness coalition includes, but is not limited to, the Ventura County Emergency Planning Council and the Emergency Coordinators Council. Many local agencies, public utilities, and non-profit organizations are involved in these coalitions and provide input at regularly scheduled meetings. Section 2.48.050 is being revised to have language consistent with revised language in Section 2.48.040 and to clarify powers and duties pursuant to state law. FISCAL IMPACT There is no fiscal impact for revising Section 2.48.040 to the MMC other than the printing costs for updating the code, which are budgeted for in the normal course of business. AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, REVISING SECTION 2.48.040, DISASTER COUNCIL — CREATION — MEMBERSHIP AND SECTION 2.48.050, DISASTER COUNCIL— POWERS AND DUTIES, OF CHAPTER 2.48, EMERGENCY PREPAREDNESS, OF TITLE 2 OF THE MOORPARK MUNICIPAL CODE WHEREAS, Government Code Section 8610 provides the authority for a legislative body to create disaster councils; and WHEREAS, on March 1, 1989, the City Council adopted Ordinance 106 adding the Emergency Preparedness chapter to the Moorpark Municipal Code, including establishing the Moorpark disaster council; and WHEREAS, on December 7, 1994, the City Council adopted Ordinance 201 amending Section 2.48.040, Disaster Council-Creation-Membership and Section 2.48.050, Disaster Council-Powers and Duties; and WHEREAS, there is a comprehensive regional emergency planning and preparedness coalition in Ventura County, which includes but is not limited to a Ventura County Emergency Planning Council and Emergency Coordinators Council; and WHEREAS, the membership of the disaster council needs clarification. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Moorpark Municipal Code Section 2.48.040, Disaster Council- Creation-Membership, of Chapter 2.48, Emergency Preparedness, is hereby revised and replaced in its entirety, as follows: 2.48.040 Disaster council — Membership The Moorpark disaster council shall consist members of the City Council. The Mayor shall serve as chair and the Mayor Pro Tempore shall serve as the vice chair. SECTION 2. That Moorpark Municipal Code Section 2.48.050, Disaster Council- Powers and duties, of Chapter 2.48, Emergency Preparedness, is hereby revised and replaced in its entirety, as follows: 3 Honorable City Council May 28, 2014, Special Meeting Page 4 2.48.040 Disaster council — Powers and duties It shall be the duty of the disaster council to develop and recommend for adoption by the City Council emergency and mutual aid plans and agreements and such ordinances and resolutions and rules and regulations as are necessary to implement such plans and agreements. The disaster council shall meet upon call of the chair or, in such person's absence from the city or inability to call such meeting, upon call of the vice chair. The disaster council shall have such other powers, duties, and responsibilities of a local disaster council pursuant to state law. SECTION 3. If any section, subsection, sentence, clause, phrase, part or portion of this ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council declares that it would have adopted this ordinance and each section, subsection, sentence,clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 4. This ordinance shall become effective thirty (30) days after its passage and adoption. SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall publish notice of adoption in the manner required by law.
