HomeMy WebLinkAboutORD 005 1983 0803ORDINANCE NO. 5 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, EXTENDING THE PERIOD FOR REVIEW AND APPROVAL OF RESIDENTIAL PLANNED DEVELOPMENTS APPROVED BY THE COUNTY OF VENTURA PRIOR TO JULY 2, 1983. WHEREAS, the City of Moorpark adopted Ordinance No. 4, an urgency ordinance, on July 6, 1983, which requires that no building permit be issued for any Residential Planned Development approved by the County of Ventura prior to July 2, 1983, unless said Residential Planned Development has been considered by the City Council at a public hearing upon ten (10) days posted notice, and has been approved and ratified, or approved, ratified and modified by City Council resolution; and, WHEREAS, said urgency ordinance was adopted because there was a current and immediate danger to the public health, safety and welfare of the people of Moorpark if Residential Planned Developments approved by the County are issued building permits without the City Council of the City of Moorpark reviewing, and ratifying and approving, or ratifying, approving and modifying said Residential Planned Developments to ensure that said Residential Planned Developments are consistent with and serve the needs of the public health, safety and welfare of the people of Moorpark; and, WHEREAS, there are fifteen (15) Residential Planned Developments approved by Ventura County that have not been issued building permits; and, WHEREAS, the City Council has considered ten (10) of said Residential Planned Developments, and has ratified and approved, or ratified, approved and modified two (2) of said Residential Planned Developments, and have directed the preparation of resolutions ratifying and approving, or ratifying, approving and modifying three (3) of said Residential Planned Developments; and, WHEREAS, it is necessary to extend the term of Ordinance No. 4 so that the City Council can consider, and determine whether or not to approve and ratify, or approve, ratify and modify each of said Residential Planned Developments to ensure that each development is consistent with, and serves the needs of the public health, safety and welfare of the people of Moorpark. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Notwithstanding any other provision of the Ventura County ordinances adopted by Ordinance No. 1, Ordinance No. 4 shall be extended for ten (10) months and fifteen (15) days, and no building permit shall hereafter be issued for any Residential Planned Development approved by the County of Ventura prior to July 2, 1983 unless said Residential Planned Development has been considered by the City Council at a public hearing upon ten (10) days posted notice and ratified and approved, or ratified, modified and approved, by the City Council by resolution. Notice of the public hearing shall be posted for ten (10) days in three public places. No other notice shall be required. SECTION 2. The reason for the extension of Ordinance No. 4 is that there is a current and immediate danger to the public health, safety and welfare of the people of Moorpark if the City Council is unable to complete the process of reviewing, and determining whether or not to approve and ratify, or approve, modify and ratify each Residential Planned Development approved by Ventura County prior to July 2, 1983 to ensure that said Residential Planned Developments are consistent with, and serve the needs of the public health, safety and welfare of the people of Moorpark. SECTION 3. The Community Development Director is directed to continue to study the Residential Planned Developments approved by the County of Ventura prior to July 2, 1983, and report to the City Council as to his recommendations on the solution to any problems posed by said Residential. Planned Developments. SECTION 4. The Community Development Director is directed to prepare the report required by California Government Code Section 65858 (d) and submit it to the City Council for action on or before June 12, 1984. SECTION 5. The City Clerk shall, within 15 days after the passage of this ordinance, cause it to be posted in at least the three public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this city. -2- The foregoing ordinance was introduced, adopted and ordered posted at a regular meeting of the City Council of said City, held on August 3, 1983.
