Home My WebLink AboutORD 006 1983 092111L� 1"t ORDINANCE NO. 6 7 13 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING BY REFERENCE VARIOUS ORDINANCES OF THE COUNTY OF VENTURA. WHEREAS, Government Code Sections 50022.1 et seq. provide that ordinances and codes of the county may be adopted by reference, provided that prior to such adoption by reference a noticed public hearing has been held; and WHEREAS, a noticed public hearing has been held by the City Council at which time all interested persons had the opportunity to appear and be heard on the matter of adopting by reference the Ventura County Building Code and the following provisions of the Ventura County Ordinance Code: (a) Division 2; (b) Division 3; (c) Chapters 1, 2, 4, 6 and 7 of Division 4; (d) Division 5, (e) Chapters 1, 2 and 3 of Division 6; (f) Chapter 1 of Division 7, (g) Division 8; (h) Chapter 2 of Division 9; (i) Division 11; and (j) Division 12; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY UN MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Division 2 of the Ventura County Ordinance Code relating to Business Licenses is hereby adopted by reference. SECTION 2. Ventura County Ordinances Numbers �lA 1 3495, 3583 and 3644, also known collectively as the Ventura County Building Code, is hereby adopted by reference as the Moorpark Building Code. SECTION 3. Chapter 1 of Division 4 of the Ventura County Ordinance Code relating to Public Health is hereby adopted by reference. SECTION 4. Chapter 2 of Division 4 of the Ventura County Ordinance Code relating to Public Health is hereby adopted by reference. -1- SECTION 5. Chapter 4 of Division 4 of the Ventura County Ordinance Code relating to Public Health is hereby adopted by reference. SECTION 6. Chapter 6 of Division 4 of the Ventura County Ordinance Code relating to Public Health is hereby adopted by reference. SECTION 7. Chapter 7 of Division 4 of the Ventura County Ordinance Code relating to Public Health is hereby adopted by reference. SECTION S. Division 5 of the Ventura County JP o Ordinance Code relating to Safety is hereby adopted by goy• iG reference. SECTION 9. Chapter 1 of Division 6 of the Ventura County Ordinance Code relating to Public Morals is hereby adopted by reference. SECTION 10. Chapter 2 of Division 6 of the Ventura County Ordinance Code relating to Public Protection is hereby adopted by reference. SECTION 11. Chapter Ventura County Ordinance Code adopted by reference. SECTION 12. Chapter Ventura County Ordinance Code hereby adopted by reference as of the City of Moorpark. 3 of Division 6 of the relating to Parks is hereby 1 of Division 7 of the relating to Traffic is the Traffic Ordinance SECTION 13. Subject to the provisions of Ordi- nance Number 5 of the City of Moorpark, which is entitled "AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, EXTEND- ING THE PERIOD FOR REVIEW AND APPROVAL OF RESIDENTIAL PLANNED DEVELOPMENTS APPROVED BY THE COUNTY OF VENTURA PRIOR TO JULY 2, 1983" and which was adopted August 3, 1983, Division 8 of the Ventura County Ordinance Code relating to Planning and Development is hereby adopted by reference, including the zoning maps contained in Section 8118 -2, et. seq., as amended through July 1, 1983. SECTION 14. Chapter 2 of Division 9 of the Ventura County Ordinance Code relating to Flower and Plant Regulations is hereby adopted by reference. SECTION 15. Division 11 of the Ventura County Ordinance Code relating to an Uniform Transient Occupancy Tax is hereby adopted by reference. -2- SECTION 16. Ordinance Code relating adopted by reference. SECTION 17. Division 12 of the Ventura County to Highway Encroachments is hereby (a) Certain provisions of the Ventura County Ordinance Code and of the uncodified ordinances and resolu- tions of the County of Ventura adopted by reference pursuant to this ordinance reflect the County governmental structure and contain references to officials, official titles, commissions, and other designations which are not a part of the structure of this City's government. In order to effectively and intelligently administer the County enactments to the extent that they are adoped by reference by this ordinance, it is the purpose of this ordinance to provide for the substitution of the appropriate city official, title, or designation in County enactments. (b) Whenever in the enactments of the County of Ventura which are adopted by reference by the City there is reference to "Board of Supervisors ", this reference shall be interpreted to mean the "City Council of the City of Moorpark." (c) Whenever in the enactments of the County of Ventura which are adopted by reference by the City there is a reference to an officer, office, official title, or other designation, the reference shall be interpreted to mean that office, title, or designation in the governmental structure of the City, or if there is none, any official or titleholder in the City who has been specifically directed by the City Council or the City Manager to perform the functions referred to or the duties imposed. (d) Whenever it is appropriate under the circum- stances, and in the enactments of the County of Ventura which are adopted by reference by the City, there is a reference to the "County of Ventura ", said reference shall be interpreted to mean the "City of Moorpark." (e) Whenever in the enactments of the County of Ventura which are adopted by reference by this Ordinance, there is a reference to "Board of Supervisors ", "Planning Commission ", "Planning Director" such reference shall be interpreted to mean that these agencies are acting as agents or agencies of the City of Moorpark, until such time as the City Council has created an agent or agency(s) within the city government structure to otherwise perform the functions of the said County agency or agencies, and until such time as said City agent or agency has commenced functioning and -3- has been directed to undertake the particular function or functions theretofore performed by the said County agency or agencies. SECTION 18. The City Clerk shall, within 15 days after the passage of this ordinance, cause it to be posted in at least the three-public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification together with proof of posting, to be entered in the book of ordinances of this City.
