AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, ADDING TITLE 11,
ENTITLED "PEACE, MORALS AND SAFETY" TO THE
MOORPARK MUNICIPAL CODE; AND ADDING CHAPTER 1
TO SAID TITLE 11, RELATING TO THE DISCHARGE
OF FIREARMS.
WHEREAS, the City Council of the City of Moorpark
finds that the dischsrge of firearms contrary to the provisions
of this ordinance is dangerous to the public safety;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA DOES ORDAIN AS FOLLOWS:
SECTION 1. That Title 11, entitled "PEACE, MORALS
AND SAFETY" is hereby added to the Moorpark Municipal Code.
SECTION 2. That Chapter 1 is hereby added to Title 11
of the Moorpark Municipal Code, to read as follows:
"CHAPTER 1
FIREARMS
"Section 11.01.010 Discharge of Firearms
"(a) No person shall fire, shoot, or discharge within
the limits of the City any gun, rifle, pistol, or any
spring gun, spring rifle, or spring pistol, or any
carbon dioxide or other gas operated gun, rifle or
pistol. The discharge of such duns, rifles or pistols
shall include blank ammunition and /or the discharge
of a muzzle loader having a powder charge.
"(b) The provisions of this section shall not apply
to:
"(1) A peace officer in the performance of his
or her duty; or
"(2) Any person while lawfully defending life
or property, including the destruction of injured
animals or any predatory or dangerous animals; or
"(3) Any person while shooting in a municipally
licensed or municipally owned or operated shooting
gallery or pistol or target range; or
"(4) The discharge of blank ammunition in a
starting gun during an athletic event; or

"(5) Any person while shooting an air gun, air
rifle, or air pistol, or any spring gun, spring rifle,
or spring pistol, or any carbon dioxide or other gas
operated gun, rifle, or pistol in any private place
or location constructed or arranged such that it is
not possible for the ammunition, projectiles, or other
objects expelled by such guns, rifles, or pistols to
escape the place or location, and said person has
obtained a permit from the City Manager or his designee;
or
"(6) Any person or persons while shooting firearms
as a part of a 'special event', and who has obtained
a permit from the City Manager or his designee.
"(i) a 'special event' shall include a
parade, the filming of a motion picture or tele-
vision program, and the like.
"(ii) The City Manager shall not grant the
permit until the County Sheriff or his designee
and the County Fire Chief or his designee have
approved the special event.
"(iii) The permit shall contain a time
limit, not to exceed 60 days.
"(c) There shall be no fee for any permit required by
this Section.
"(d) The City Manager or his designee shall implement
rules and regulations pertaining to the provisions of
this Section, including, but not Limited to, grounds
for approval, duration and revocation of permits.
"(e) Any person who has been denied a permit under
this section may appeal such denial to the City Council
by filing with the City Clerk a written notice of
appeal within ten (10) calendar days of the date of
denial.
"Section 11.01.020 Discharge of Firearms by Minor
"(a) If the person shooting or discharging under
Section 11.01.010 of this Code is a minor, then he or
she shall be supervised by an adult person who is
present when the minor is shooting or discharging.
"(b) No minor shall possess in any public place any
gun, rifle, or pistol as described in Section 11.01.010
of this code, except as follows:

"(1) When such minor is in the immediate
charge and supervision of a parent, guardian, or
adult person having the responsibility for the
conduct of such minor, regardless of whether the
gun, rifle, or pistol is capable of being immedi-
ately discharged or whether it is unloaded or in
a dismantled or 'take down' condition or completely
wrapped or in a carrying case made for the purpoees
of carrying such firearm; or
"(2) When such minor is engaged in marks-
manship training or firearm safety training at
an established range or shooting area, as provided
and regulated in Section 11.01.010 of this code,
under the supervision of a competent adult
instructor."
SECTION 3. The City Clerk shall, within 15 days
after the passage of this ordinance, cause it to be posted in
at least the three public places designated by resolution of
the City Council; shall certify to the adoption and posting of
this ordinance; and shall cause this ordinance and its certifi-
cation, together with the proof of posting, to be entered in the
book of ordinances of this City.

AYES: Councilmembers Harper, Prieto, Beaulieu,
Straughan and Mayor Yancy- Sutton;
NOES: None;
ABSENT: None.
