HomeMy WebLinkAboutORD 023 1984 0718ORDINANCE NO. 23 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, REQUIRING REVIEW AND APPROVAL OF RESIDENTIAL PLANNED DEVELOPMENTS APPROVED BY THE COUNTY PRIOR TO JULY 2, 1983 AND DECLARING THE ORDINANCE TO BE AN URGENCY ORDINANCE THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Notwithstanding any othe r provision of the ordinances of the City of Moorpark, no building permit shall hereafter be issued for any Residential Planned Develop- ment approved by the County of Ventura prior to July 2, 1983 unless said Residential Planned Development has been considered by the City Council at a public hearing upon ten (10) days posted notice and approved, or modified and approved, by the City Council by resolution. Notice of the public hearing shall be posted for ten (10) days in three (3) public places. No other notice shall be required. Section 2. This ordinance shall be operative for a period of one (1) year commencing July 6, 1984 and ending July 5, 1985. Section 3. This ordinance, being an urgency ordinance, shall become effective upon adoption. The reasons for the urgency are that the County of Ventura has approved a large number of Residential Planned Developments which had not previously been reviewed or approved by the City of Moorpark. The City Council has now reviewed most of the County Residential Planned Develop- ment approvals and determined that said permits should be approved subject in some cases to certain modifications. The Council wishes to be assured that the conditions imposed by the City Council of Moorpark will be complied with. Section 4. This ordinance is a continuation of Ordinance No. 4 entitled " An Ordinance of the City of Moorpark, California, Requiring Review and Approval of Residential Planned Developments Approved by the County Prior to July 2, 1983; Declaring the Ordinance to be an Urgency Ordinance; and Setting a Public Hearing for August 3, 1983," adopted July 6, 1983 and Ordinance No. 5, entitled "An Ordinance of the City of Moorpark, California, Extending the Period for Review and Approval of Residential Planned Developments Approved by the County of Ventura Prior to July 2, 1983," adopted August 3, 1983. Section 5. This ordinance is an urgency ordinance for the immediate preservation of the public peace, health and safety, is passed by at least a four - fifths (4/5) vote of the City Council, and shall take effect immediately upon its adoption. The facts constituting the urgency are as set forth in Section 3 of this ordinance. Section 6. The City Clerk shall, within fifteen (15) days after the passage of this ordinance, cause it to be posted in at least the three public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. The foregoing ordinance was introduced, adopted and ordered posted at an adjourned regular meeting of the City Council held on July 2, 1984.
