HomeMy WebLinkAboutORD 030 1984 1003ORDINANCE NO. 30 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADDING CHAPTER 12.02 TO TITLE 12 OF THE MOORPARK MUNICIPAL CODE RELATIVE TO PUBLIC TRAFFIC REGULATION AND CONTROL OF PRIVATE ROADS AND PARKING FACILITIES. WHEREAS, pursuant to California Vehicle Code Sections 21107.6 and 21107.8, the City may enforce public traffic regulations and controls on private roads and parking facilities after a public hearing thereon and ten (10) days prior notice to the owner of the privately owned roads and parking facilities; and WHEREAS, the City Council has held a duly noticed public hearing relative to public traffic regulation and control of private roads and parking facilities on the property commonly known as Varsity Park Shopping Center. NOW, THEREFORE, the City Council of the City of Moorpark does ordain as follows: SECTION 1. The Moorpark Municipal Code is hereby amended by adding Chapter 12.02 to Title 12 to read as follows: CHAPTER 12.02 PRIVATF ROADS AND PARKING FACILITIES SFCTION 12.02.010 Roadways Desiqnated. Pursuant to the provisions of Section 21107.6 of the California Vehicle Code, the City Council finds and declares that there are privately owned and maintained roads, as described in this section, within the City which are generally held open to the public for purposes of vehicular traffic to serve commercial establishments. The provisions of the California Vehicle Code shall apply to such roads. The roads are as shown on the exhibits incorporated herein by this reference: Exhibit 1. Varsity Park Shopping Center SECTION 12.02.020 Parkinq Facilities Desiqnated. Pursuant to California Vehicle Code Section 21107.8, the City Council finds and declares that there are privately owned and maintained off - street parking facilities, as described in this section, that are generally held open for use of the public for purposes of vehicular parking. Sections 22507.8, 22350, 23103, 23109 and Division 16.5 (commencing with Section 38000) of the California Vehicle Code shall apply to such facilities, provided that the owner or operator has caused to be posted in a conspicuous place at each entrance to such off - street parking facility a notice, not less than 17 inches by 22 inches in size with lettering not less than one (1) inch in height, to the affect that such off - street parking facility is subject to public traffic regulation and control. The off - street parking facilities are as shown on the exhibits incorporated herein by this reference: Exhibit 1. Varsity Park Shopping Center SECTION 12.02.030 Violations; Penalties. Any person who violates any provision of, or fails to comply with any requirement of, this Chapter is guilty of a misdemeanor /infraction and, upon conviction thereof, shall be punished in accordance with Chapter 1.01 of this Code. SECTION 2. The City Clerk shall, within 15 days after the passage of this Ordinance, cause it to be posted in at least the three public places designated by resolution of the City Council; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with the proof of posting, to be entered in the book of ordinances of this City.
