AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, IMPOSING A MORATORIUM ON THE
INCREASE OF RENT SCHEDULES PURSUANT TO
ORDINANCE NO. 7, AND DECLARING THE
URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Commencing on the effective date of this
ordinance, the Mobilehome Park Rent Review Board of the City of
Moorpark shall not accept for filing pursuant to Ordinance No. 7
any rent schedule increase application.
SECTION 2. There is existing in the County of Ventura,
inclusive of the area that is now within the boundaries of the City
of Moorpark, a shortgage of mobilehome sites in mobilehome parks,
which has resulted in a low vacancy rate and rapidly rising rents.
In order to protect the owners of mobilehomes from unreasonable
rent increases, while at the same time recognizing the need of
mobilehome park owners to receive a fair return on their property
and sufficient rental income, the County of Ventura adopted Ordinance
No. 3635. Upon the 120th day after incorporation of the City of
Moorpark,no County of Ventura ordinance was of any further force and
effect in the City, unless formally adopted by the City. In order to
maintain the status quo until the City was able to undertake an
independent study of mobilehome rent regulations, the City Council
of the City of Moorpark adopted County Ordinance No. 3635, by City
Ordinance No. 7. Subsequently, the City commenced a study to insure
that the mobilehome rent regulations are adequate to serve the needs
of Moorpark, and, as a result of the study, is considering amendments
to Ordinance No. 7. In the meantime, if rent schedules are permitted
to be processed under Ordinance No. 7, the intent and purpose of the
amendments being considered would be defeated and the effective
implementation of the amendments would be substantially impaired.
SECTION 3. This ordinance shall remain in effect until
October 3, 1985, unless sooner repealed.
SECTION 4. This ordinance is for the immediate preserva-
tion of the public peace, health and safety and shall take effect
immeditely upon its adoption. The facts constituting the urgency
are set forth in Section 3 hereinabove.
PASSED AND ADOPTED this 22nd day of June , 1985,
by not less than a four - fifth's (4/5) vote of the City Council.
