HomeMy WebLinkAboutORD 056 1985 1118ORDINANCE NO. 56 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING ZONE CHANGE NO. Z -2805, ON APPLICATION OF U. S. CONDOMINIUM CORPORATION. WHEREAS, an application was received from U. S. Condominium Corporation for a change in zone from RE -20 (Rural Exclusive) to RPD -1.6 (Residential Planned Development, 1.6 Units Per Acre) on approximately 58 acres located west of and adjacent to Stathern Drainage channel at the western terminus of Eact Loyola and Fordham Street in the Campus Park neighborhood of the City of Moorpark, Assessors Parcel No. 500 -0- 280 -72 and 73, as shown on Exhibit "A" attached hereto; and WHEREAS, the Planning Commission of the City of Moorpark considered said proposed zone change at a duly noticed public hearing held on October 10, 1985, and after careful consideration recommended certification of the Negative Declaration and approval of the Zone Change; and WHEREAS, public notice having been given in time, form and manner as required by law, the City Council of the City of Moorpark has held a public hearing, has received testimony regarding said proposed zone change, has duly considered the proposed project, and has reached its decision; and WHEREAS, the City Council, after careful review and consideration, has determined that the proposed project will not have a significant effect on the environment, has reviewed and considered the information contained in the Negative Declaration and approves the Negative Declaration as having been completed in compliance with State CEQA Guidelines issued thereunder; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CA.LIFORIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the official Zoning Map of the City of Moorpark is hereby amended by changing the zone and zone boundaries shown upon a portion of said Zoning Map so that such portion of said Zoning Map shall be as shown on Exhibit A, attached hereto and made a part hereof. SECTION 2. That the zone change is hereby approved, based on the following findings: 1. That the proposed zone is in conformance with the General Plan of the City. 2. That the public necessity,. convenience, general welfare, and good zoning practice require that the property be reclassified. SECTION 2. That this office shall take effect 30 days after final passage and adoption. 1kC SECTION 4. That the City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the recordsof the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published once in the Moorpark News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
