HomeMy WebLinkAboutORD 064 1986 0218ORDINANCE NO. 64 AN INTERIM ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTED ON AN URGENCY BASIS, IMPOSING A MORATORIUM PROHIBITING ISSUANCE OF LAND USE ENTITLEMENTS IN THE DOWNTOWN AREA OF THE CITY OF MOORPARK. THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark, California, finds and determines that it has directed a study relative to the acquisition of public parkland in the downtown area of the City, as described in EXHIBIT A attached hereto and made a part hereof, and in connection with said study intends to study the land use and zoning designations of any property con- templated to be acquired and of the property in the surrounding area, to resolve any conflict of use. City Council action will be required to evaluate the results of the study and to implement any recommendations developed therefrom. SECTION 2. Pending the conclusion of studies and City Council action thereon, no general plan amendment, subdivision, rezoning, land use permit, variance, building permit, or any other entitlement for use for which no planned development permit or development plan permit has been approved, shall be issued, nor shall applications therefor be accepted by the City of Moorpark, or its officers, agents or employees, relative to any parcel of land of five (5) gross acres or more within the downtown area. SECTION 3. Pursuant to Government Code Sections 36934, 36937 and 65858, the City Council of the City of Moorpark hereby declares this Ordinance to be an urgency ordinance requiring the immediate enactment thereof, because the same is necessary for the immediate preservation of the public peace, health, safety and general welfare of the City and its citizens, and, accordingly, the provisions of this Ordinance shall become effective at once as an urgency ordinance. The facts constituting such urgency are as set forth in Section 1 of this Ordinance. In addition thereto, the City Council finds and determines that the absence of this Ordinance would create a serious threat to the orderly and effective implementation of any zoning or land use plans which may be adopted by the City Council as a result of said studies, in that current develop- ment of the affected area at this time, would permit the zoning and land use problems which such actions would seek to remedy. SECTION 4. If any section, subsection, sentence, clause, phrase or word of this Ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remining portions of this Ordinance. The City Council of the City of Moorpark hereby declares that it would have passed and adopted this Ordinance and each and all provisions thereof, irrespective of the fact that any one or more of said pro- visions may be declared invalid. -1- SECTION 5. This Ordinance shall be effective immediately upon its adoption, and shall expire and be of no further force and effect April 4, 1986 unless sooner extended pursuant to Government Code Section 65858. SECTION 6. The City Clerk shall certify to the passage and adoption of this ordinance by not less than a four - fifths vote of the City Council; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published in the Moorpark News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
