HomeMy WebLinkAboutORD 067 1986 0317ORDINANCE NO. 67 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING ZONE CHANGES NOS. Z -2807, Z -2808 AND Z -2809, ON APPLICATION OF URBAN WEST COMMUNITIES. WHEREAS, applications were received from Urban West Communities for the following: I. Z -2807 - To rezone a 56.19 acre parcel from "PC" ( Planned Community) to the "RPD -3.65 U" ( Residential Planned Development 3.65 Units to the Acre) Zone; 2. Z -2808 - To rezone a 54.3 acre parcel from "PC" ( Planned Community ) to the "RPD -5 U" ( Residential Planned Development 5 Units to the Acre) Zone; and 3. Z -2809 - To rezone a 128.8 acre parcel from "PC" (Planned Community) to the RPD -2.2U" ( Residential Planned Development 2.2 Units to the Acre) Zone; and WHEREAS, the Planning Commission of the City of Moorpark considered said proposed zone changes at a duly noticed public hearing on January 8, 1986, and after careful consideration recommended approval thereof; and WHEREAS, public notice having been given in time, form and manner as prescribed by law, the City Council of the City of Moorpark has held a public hearing, has received testimony regarding said proposed zone changes, has duly considered the proposed projects, and has reached its decision; and WHEREAS, the City Council, after careful review and consideration, has determined that for all three zone changes hereinabove referred to, the environmental effects discussed in the EIR prepared for Planned Community No. 3 and the environmental effects of the proposed projects are similar enough to warrant the same treatment in an EIR, and has certified that the Planned Community No. 3 EIR adequately covers the impacts of these projects; and pursuant to Section 15162 of the State CEQA Guidelines, this body has reviewed and considered the information contained therein and has endorsed the reasons which have been given in the staff reports on file for allowing the occurrence of the significant cumulative impacts identified in the EIR that was earlier prepared for Planned Community No. 3; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the official Zoning Map of the City of Moorpark is hereby amended by changing the zones and zone boundaries shown upon a portion of said Zoning Map so that such portion of said Zoning Map shall be as shown on EXHIBIT A, attached hereto and made a part hereof. -1- SECTION 2. That the zone changes are hereby approved, based on the following finds: 1. That the proposed zones are in conformance with the Land Use Element of the General Plan. 2. That the public necessity, convenience, general welfare, and good zoning practice require that the properties be reclassified. SECTION 3. That this ordinance shall take effect 30 days after final passage and adoption. SECTION 4. That the City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published once in the Moorpark News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
