HomeMy WebLinkAboutORD 076 1986 0707ORDINANCE NO. 76 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 8112 -2.3 OF THE ZONING ORDINANCE OF THE COUNTY OF VENTURA, ADOPTED BY THE CITY OF MOORPARK ON SEPTEMBER 21, 1983, PERTAINING TO MAXIMUM DENSITY. WHEREAS, at a duly noticed public hearing on April 23, 1986, the Moorpark Planning Commission considered a proposed amendment to make more explicit that the maximum density authorized by the General Plan is not an automatic right; and WHEREAS, after careful consideration the Planning Commission reached its decision in the matter and adopted its Resolution No. PC- 86 -95, recommending to the City Council of the City of Moorpark that staff findings be adopted, and that the the Zoning Ordinace of the City be amended as proposed; and WHEREAS, public notice having been given in time, form and manner as required by law, the City Council of the City of Moorpark has held a public hearing, has received testimony regarding said project, has duly considered the proposed Zoning Ordinance amendment, and has reached its decision; and WHEREAS, the City Council, after careful review and consideration, has determiend that the proposed amendment will not have a significant effect on the environment, has reviewed and considered the information contained in the Negative Declaration, and has approved the Negative Declaration as having been completed in compliance with State CEQA Guidelines issued thereunder; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 8112 -2.3 of Article 1 of Chapter 1, Zoning, of Division 8 of the Ventura County Ordinance Code, adopted by the Moorpark City Council on September 21, 1983, is hereby amended to read as follows: "Section 8112 -2.3 - Subzones for the R -P -D Zone - The maximum density allowed in the R -P -D Zone is established by the subzone (suffix), e.g. R- P -D -6. This maximum density must be within the range established in the Land Use Element of the General Plan. For example, R -P -D -6 would be appropriate under a General Plan designation of '5.1 to 10 U /Ac average'. The maximum density in the zoning subzone is not an automatic entitlement but could be considerably less, depending upon the size, location and terrain of the particular property and the plan for development for that property. Said plan must provide an environment that is desirable in character, in that parking, open space and recreational facilities and other amenities are adequate for the proposed population." SECTION 2. That this ordinance shall become effective thirty (30) days after its passage and adoption; an SECTION 3. That the City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published once in the Moorpark News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
