AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MOORPARK AMENDING MEASURE F, AN ORDINANCE
ESTABLISHING A RESIDENTIAL DEVELOPMENT MANAGEMENT
SYSTEM OF THE CITY OF MOORPARK, RELATIVE TO THE
ANNUAL RESIDENTIAL DEVELOPMENT ALLOTMENT FOR
CALENDAR YEAR 1986
WHEREAS, on October 22, 1985, a notice of intention
to circulate an initiative petition was filed with the City
Clerk by the proponents of an ordinance to establish a
residential development management system for the City of
Moorpark; and
WHEREAS, on February 3, 1986, the initiative
petition was certified by the City Clerk and the initiative
ordinance was ordered to be placed on the November 3, 1986
election ballot by the City Council; and
WHEREAS, Measure F prohibits the issuance of
building permits for non - exempt residential projects in
excess of an annual residential development allotment and
limited the allotment for calendar year 1986 to a maximum of
400 dwelling units; and
WHEREAS, until Measure F became effective, the City
was required to issue a building permit for every
residential dwelling unit that otherwise complies with all
applicable laws, rules and regulations; and
WHEREAS, no residential building permits were
issued by the City in calendar year 1986 prior to the
certification of the initiative petition, while
approximately 2,354 residential building permits were issued
between that date and the election, of which approximately
2,006 were issued in the three months immediately preceding
the election; and
WHEREAS, the number of residential building permits
that were issued between February and November, 1986 is a
568 percent increase over the 352 residential building
permits that were issued for the entire calendar year 1985
and a 285 percent increase over the 611 residential building
permits that were issued for the entire calendar year 1984,
which was the first full year of City incorporation; and
WHEREAS, less than one percent of the residential
building permits that were issued in calendar year 1986 were
for residential projects that would be exempt from Measure
F; and
WHEREAS, at duly noticed public hearings held
during the months of July through August, 1987, the Planning
Commission and the City Council considered ways and means to
implement Measure F, including not awarding the 1986 annual
residential development allotment;
NOW, THEREFORE, the City Council of the City of
Moorpark does ordain as follows:
Section 1. The City Council finds, determines
and declares that for the City to award the 1986 annual
residential development allotment, when approximately 2,354
residential permits were already issued during that calendar
year, would be inconsistent with the intent of Measure F "to
achieve a steady, rather than a fluctuating, overly rapid
rate of residential growth each year" and "to establish
control over the quality, distribution, and rate of growth
of the City" as that intent is more fully set forth in
section 10.01 of Measure F.
Section 2. Consistent with the intent of
Measure F, subsection A of section 10.04 of Measure F is
hereby amended to read as follows:
"A. Calendar year 1986; no units; and"
Section 3. The City Clerk shall certify to the
passage and adoption of this ordinance by not less than a
four - fifths vote of the City Council; shall enter the same
in the book of original ordinances of said City; shall make
a minute of the passage and adoption thereof in the records
of the proceedings of the City Council at which the same is
passed and adopted; and shall, within fifteen (15) days
after the passage and adoption thereof, cause the same to be
published in the Moorpark News, a weekly newspaper of
general circulation, as defined in Section 6008 of the
Government Code, for the City of Moorpark, and which is
hereby designated for that purpose.

91 was regularly introduced and approved for first reading at a
meeting of the City Council on the 23rd day of September 1987,
by the following vote, to wit:
AYES: Councilmembers Brown, Galloway. Lane and Mayor Harper.
NOES: Councilmember Ferguson.
ABSTAIN: None.
ABSENT: None.
and, that said ordinance was duly approved for second reading and adopted at
a meeting of the City Council on the 2nd day of December 1987,
by the following vote, to wit:
AYES: Councilmembers Brown, Harper, Lane and Mayor Galloway.
NOES: None.
ABSTAIN: None.
ABSENT: None.
