AN ORDINANCE: OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING ARTICLE
10 (SECTION 8128 -1); ARTICLE 11 (SE,CTION 8129-1); ARTICLE 12
(SECTION 8130 -1); ARTICLE, 21 (SE CTION 8139 -1); ARTICLE 23
(SI'.CTION 8141 -1.4 AND 8141 -2.4); AND ARTICI,i' 47 (SECTION 8170 -0)

WHEREAS, on April 5, 1989, tho Cit% Council directed the Planning

WHEREAS, at a duly noticed hearing; ()n iL'ty 15, 1989, the Planning
Commission considered this matter and recommended ailouance for Child Care
Centers in the C -O (Commercial Office), C -1 (N-- (,i);hborhood Commercial), C -2
(General Comm(,,rcial.), CPD (Commercial Planiw l 1)eveie})ment.), 1 -1 (Industrial
District) zones; and
WHEREAS,
public
notice having been given i.n time, form,
and
manner as required
by law,
the City Council of the
City of Moorpark has
held
a public hearing
on June
7, 1989, has received
testimony regarding
said
subject, has duly
considered the proposed Zoning
Ordinance Amendment,
and
has reached its decision;
Section 8141 -1.4 and Section 8141 -2.4 adding Child Day
and
only where sponsored by or permitted within an industrial
use on the
WHEREAS, the City Council has determined that the proposed
amendment will riot have a significant effect. on the environment, has
reviewed and considered the information contained in the Negative
Declaration, and has approved the Negative Declaration as being completed
in compliance with State CEQA Guidelines issued thereunder;
NOW, THEREFORE, THE CITY COUNCIi. OF THE CITY OF MOORPARK,
CALIFORNIA DOES ORDAIN AS FOLLOWS:
Section 1. That the Cit.y's 'Losing Ordinance regarding
conditionally permitted uses be amended ns follow
Article 10,
Section 8128 -1
adding Child Day Care Centers
Article 11,
Section 8129 -1
adding Child Dny Care Centers
Article 12,
Section 8130 -1
adding Child Day Care Centers
Article 21,
Section 81.39 -1
adding Child Day Care Centers only where
sponsored by
or permitted
within an office building or complex on the
same site,
by the owner or
lessee of the building or complex.
Article 23,
Section 8141 -1.4 and Section 8141 -2.4 adding Child Day
Care enter
only where sponsored by or permitted within an industrial
use on the
same site.
Article 47,
Section 8170 -0 adding a dofinit: ion for Child Day Care
Centers as
follows:
Shall mean an establishment where care or supervision is provided on a less
than twenty -four (24) hour per day basis, limited to children only, which
is licensed according to applicable State Law. This term shall include
nursery schools.
Section 2. That this ordinance shall become effective thirty (30)
days after its passage and adoption;
Section 3. That the City Clerk shall certify to the passage and
adoption of this ordinance; shall enter the same in the hook of original
ordinances of said City; shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council at which the
same is passed and adopted; and shall, within fifteen (15) days after the
passage and adoption thereof, cause the Same to be published once in the
Moorpark Mirror, a weekly newspaper of general circulation, as defined in
Section 6008 of the Government Code, for the City of Moorpark, and which is
hereby designated for that purpose.
