HomeMy WebLinkAboutORD 124 1990 0221ORDINANCE NO. 124 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING ZONE CHANGE NO. Z-88-2A, ON APPLICATION OF JOSEPH LATUNSKI WHEREAS, an application was received from Joseph Latunski for a change in zoning from Rural Exclusive (RE) 5 Acre to RE-1 Acre for his 4.12-acre property located approximately 1,800 feet north of Casey Road and 1,500 feet West of Walnut Canyon Road (Assessor's Parcel No. 500-0-260-060), and WHEREAS, the Planning Commission of the city of Moorpark considered said proposed zone change at a duly noticed public hearing on December 18, 1989; and WHEREAS, public notice having been given in time, form, and manner as required by law, the city Council of the City of Moorpark has held a public hearing, has received testimony regarding said proposed zone change, has duly considered the proposed project, and has reached its decision; and WHEREAS, the City Council, after careful review and consideration, has determined that the proposed project will not have a significant effect on the environment and has reviewed and considered the information contained in the Negative Declaration and approves the Negative Declaration as having been completed in compliance with the California Environmental Quality Act; and WHEREAS, the City Council by resoli.,,.-tion, No. 90-628 , approved a General Plan Amendment to change the General Plan land use designation from Residential Rural Low (5 acre/dwelling unit) to Rural High-(1 acre/dwelling unit) for the referenced property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the official Zoning Map of the City of Moorpark is hereby amended by changing the zone and zone boundaries shown upon a portion of said Zoning Map so that such portion of said Zoning Map shall be as shown on Exhibit A, which is attached hereto and made a part hereof. SECTION 2. That the zone change is hereby approved, based on the following findings: 1. That the proposed zone is in conformance with the General Plan. 2. That the proposed zone change will not result in significant environmental impacts. SECTION 3. That this ordinance sha,'11 take effect 30 days after final passage and adoption. The Assessor's Parcel No. was corrected to AP NO. 500-0-260-060 from AP NO. 500-0-260-065. April 16, 1990 City Clerk- Date SECTION 4. That the City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published once in the Moorpark News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
