HomeMy WebLinkAboutORD 165 1993 0519ORDINANCE NO. 165 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA CHANGING THE ZONING DESIGNATION (ZC 93 -2) ON ASSESSOR'S PARCEL NUMBER 512 -0- 150 -380 (MCDONALD'S CORPORATION PROJECT SITE) FROM C -2 (GENERAL COMMERCIAL) TO THE ZONING DESIGNATION OF CPD (COMMERCIAL PLANNED DEVELOPMENT) WHEREAS, on November 4, 1992, the City Council adopted Ordinance Number 154 changing the zoning designation on the parcel from Residential Planned Development (RPD) to C -2 (General Commercial); however, the intended zoning designation was Commercial Planned Development (CPD); and WHEREAS, in order to rectify the error in nomenclature, it was necessary to process the property through a zone change once again; and WHEREAS, on April 5, 1993 the Planning Commission adopted Resolution Number PC -93 -274, recommending that the City Council rescind Ordinance Number 154 and adopt the aforementioned Ordinance changing the zoning on Assessor's Parcel Number 512 -0 -150 -380 from C -2 (General Commercial) to CPD (Commercial Planned Development); and WHEREAS, the City Council finds that Commercial Planned Development (CPD) zoning on the subject site would be consistent with the General Plan land use designation of General Commercial (C -2) on the subject site; and WHEREAS, public notice having been given in time, form, and manner, as required by law, the City Council of the City of Moorpark has held a public hearing on May 5, 1993; and WHEREAS, the City Council, after careful review and consideration, has determined that the proposed Zone Change will be categorically exempt pursuant to the State CEQA Guidelines, Section 15061(b)(3) in that the proposed amendment does not have the potential for causing a significant effect on the environment. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the official Zoning Map of the City of Moorpark is hereby amended, on 43,540.20 square feet of real property located at the northeast corner of the intersection of New Los Angeles Avenue and Spring Road within Assessor's Parcel Number 512 -0- 150 -380 from C -2 (General Commercial) to CPD (Commercial Planned Development) and so that all of the lessor's Parcel Number 512 -0 -150 -380 is zoned CPD. ID4P- 03- 04- 93(6:22pm)A:\NMZCCHG_ M 1 SECTION 2. That the Zone Change is hereby approved, based upon the following findings: a. That the proposed zone change is in conformance with the Land Use Element of the General Plan. b. That the public necessity, convenience, general welfare, and good zoning practice require that the property be rezoned. C. The proposed Zone Change is categorically exempt pursuant to the State CEQA Guidelines, Section 15061 (b)(3). SECTION 3. That this ordinance shall take effect thirty (30) days after the final passage and adoption. SECTION 4. That the City Clerk shall certify to the passage and adoption of this Ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause and same to be published once in the Moorpark Mirror News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
