HomeMy WebLinkAboutORD 208 1995 0621ORDINANCE _108 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING MUNICIPAL CODE TITLE 17 (ZONING) PERTAINING TO GARAGE CONVERSIONS WHICH OCCURRED PRIOR TO CITY INCORPORATION Whereas, on January 23, 1995, the Planning Commission studied, held a public hearing, and recommended the City Council make the modifications described in Section 3 to the Zoning Code in order to clarify certain sections of �he Code and to better fit the needs of the City; and Whereas, the City Counci: opened the public hearing on March 1, 1995 and closed the public 'rearing on June 7,1995; and Whereas, the City Council determined that the modifications to the City's Zoning Code are categorically exempt pursuant to State CEQA Guidelines Section 15061 (b) (3) in that the proposed amendments to the Zoning Cade does not have the potential for causing a significant effect on -:he environment; and Whereas, changes to the 2,oning Code as directed by the City Council have been made pursuanr to section 3. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That the modifications to the City's Zoning Code are categorically exempt pursuant to 'hate CEQA Guidelines Section 15061 (b) (3). SECTION 2. That the Municipal Cade related to Zoning is hereby amended as found in Section 3. SECTION 3. Section 17.08.010 is amended and 17.52.065 is added to read as follows: Sec. 17.08.010 - APPLICATION OF DEFINITIONS- Unless the provision or context otherwise requires, the definitions of words and terms as follows shall govern the constru,-tion of this Chapter. Sleeping Ouarters - A space in ? structure used for sleeping purposes. PP06:08:95 12:45p".\PIYAL.0RD t 17.52.065 Garage conversions - Grandfathered Garages, which were converted, without a permit, to a use other than a garage use prior to the City's incorporation, shall be considered to be legally conforming uses if the property owner is able to meet the following provisions: a. The property owner shall prove to the satisfaction of the Director of Community Development that the conversion was done prior to City incorporation (July 1, 1983). b. The property owner shall apply for and obtain an Administrative Permit and building permit for the purpose of assuring that the conversion meets all applicable building codes. The Administrative Permit and building permit shall be obtained within four weeks of notification from the City of the property owner's compliance with Section 17.52.065 a. The Director of Community Development may extend the time period to obtain a building permit upon the determination that a circumstance `ustifying the need for said extension exis' s . SECTION 4. That if any section, subsection, sentence, clause, phrase, part or portion of this Ordnance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, )hrases, parts or portions be declared invalid or unconstitut.ior. .. SECTION 5. This Ordinance shal become effective thirty (30) days after the passage and adoptic-. SECTION 6. The City Clerk sha_1 certify to the passage and adoption of this Ordinance; shall enter the same in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the sarte is passed and adopted; and shall, within fifteen (15) days .�•.er the passage and adoption PP06:00:95 12:151=A- \FYMAL.ORD 2 thereof, cause the same to be published once in the Moorpark News, a weekly newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
