GEDNEY City Treasurer MEMORANDUM TO: The Honorable City Council FROM: Steven Kueny, City Manager V DATE: March 28 , 1985 / / SUBJECT: Proposed Modification of Purchasing Procedures BACKGROUND INFORMATION Shortly after incorporation the City adopted the Moorpark Municipal Code, which included Chapter 3. 12 of Title 3 of said Code, pertaining to purchasing procedures. Section 3 . 12. 120 of that Chapter requires that supplies and equipment with an estimated value greater than $5, 000. 00 be awarded through the formal (sealed) bid procedure. With the effect of cost increases over the years, the purchasing ability relative to this limit has been eroded, and it now requires most purchases to go through the time and expense of formal bid pro- cedure, when the same procedure (written bids by three vendors) can be done on an informal basis. Three cities were surveyed concerning their current limits for formal bid procedures, as follows : Simi Valley $7, 500. 00 Thousand Oaks 5, 000. 00 Camarillo 2, 500. 00 None of these cities has revised its purchasing procedures or limits since at least 1980 . The City of Thousand Oaks is currently considering an increase to $10 or $15, 000. 00. 799 Moorpark Avenue Moorpark, California 93021 M5)529-6864 410 The Honorable City Council Page 2 March 28, 1985 To permit the purchase of most items without the time and expense of formal bids, while adhering to the informal bid requirements, it is recommended that the $5, 000. 00 estimated value be modified to $10, 000 . 00. The proposed action would not modify the State law requirement that all public works projects with a cost of $5, 000. 00 or more be publicly bid. RECOMMENDED ACTION Introduce Ordinance No. modifying the estimated value of purchases that require formal bid procedures. SK:ddb ® a'".09 ORDINANCE NO. 43 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTIONS 3 . 12. 120 AND 3. 12. 230 OF CHAPTER 3. 12 OF TITLE 3 OF THE MOORPARK MUNICIPAL CODE, PERTAINING TO PURCHASES. THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1 . That Section 3 . 12 . 120 of Chapter 3 . 12 of Title 3 of the Moorpark Municipal Code is hereby amended to read as follows : "3. 12. 120 Formal (sealed) bid procedure. Except as otherwise provided herein, purchases of supplies and equipment of an estimated value greater than Fifteen Thousand Dollars ($15, 000. 00) shall be awarded to the lowest responsibile bidder pursuant to the formal bid procedure hereinafter prescribed. Public projects, as defined in Section 20161 of the Public Contract Code of the State of California shall be awarded pursuant to applicable provisions of said Public Contract Code. " SECTION 2. That Section 3. 12. 230 of Chapter 3. 12 of Title 3 of the Moorpark Municipal Code is hereby amended to read as follows: "3. 12. 230 Open market or informal bid procedure. Purchases of supplies and equipment of an estimated value in the amount of Fifteen Thousand Dollars ($15, 000.00) or less may be made by the purchasing agent in the open market pursuant to the procedure prescribed in Sections 3. 12. 240 through 3 . 12. 260 and without observing the procedure prescribed in Sections 3. 12 . 120 through 2 . 12 . 215; provided, however, all bidding may be dispensed with for purchases of supplies and equipment having a total estimated value of less than One Thousand Dollars ($1 , 000. 00) . " SECTION 3 . The City Clerk shall, within 15 days after the passage of this ordinance , cause it to be posted in at least the three public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City.
