GEDNEY City Treasurer MEMORANDUM TO: The Honorable City Council FROM Steven Kueny, City Manager DATE: May 16, 1985 SUBJECT: Proposed Parks Maintenance Assessment District and Lighting Maintenance Assessment District BACKGROUND: The Council has before it a series of three (3) resolutions to (a) Conduct proceedings and form the proposed citywide Parks Maintenance District (AD-85-1) , incorporating a part of AD-83- 1 for the maintenance of Glenwood Park effective September 1 , 1985; (b) Conduct proceedings and levy annual assessments in the citywide Lighting Maintenance District (AD-84--2) : As now proposed, this would incorporate the landscaping maintenance within public rights of way for [1] all of the current AD-84-1 areas (Griffin Tract, including Campus Park Drive median, Collins Drive and areas adjacent to the flood channel); [2] a portion of AD-83-1, including the median in Tierra Rejada Road and parkway trees, and [3] all of the Tierra Rejada Road - Landscape aintenance District, which would be for the slope areas, and for which no improvements have been provided nor assessments levied in the past; (c) Conduct proceedings and levy annual assessment for AD-83-1 . In the event the citywide Parks Maintenance District is not formed, this will assure that existing assessments for Glenwood Park are in place. 799 Moorpark Avenue Moorpark,California 93021 (805)529-6864 /y L The Honorable City Council Page 2 May 16, 1985 The three (3) different actions to be considered by the Council for each of the three (3) mentioned districts are : 1 . Initiate proceedings 2. Approve Engineer' s Report with any changes desired at this time 3. Setting hearing date for June 3, 1985. A notice will be published in the Moorpark News, as well as sent to each owner of property within the City. At the June 3, 1985 public hearing the Council will accept testimony concerning the three (3) separate districts. If desired by the Council the hearing can be continued, however, final action must be taken no later than June 30, 1985. Assessment information must be provided by the City to the Coun' Auditor-Controller by July 12, 1985, for inclusion on the 1985-8 ssessment roles. During or after the hearing, the Council may order changes to the Engineer' s Report, including the budget amounts and method of spread. The follwing is a breakdown of the proposed Parks Maintenance District Budget: 4 f 1 . Administration $ 6, 000 5. Engineering $ 14, 500 TOTAL $103, 000 It is not proposed that any of the City' s general overhead costs be included for operation of the District. It is proposed to include ' 80% of the projected labor costs for one full time position and part time labor of $24,000. 00 of the $30, 000. 00 total, the remaining $6, 000. 00 proposed to be funded by the Lighting District. The Council may wish to add the premium for the property insurance coverage (fire, earthquake) for the Community Center. It is estimated at $1, 800. 00. The Council may also supplement any or all of the budget estimates with Quimby Interest or General Fund monies. There is an estimated balance of $18, 400. 00 (or major portion of) in AD-83-1 that can be transferred into this District. It was intended for use primarily for Glenwood Park, which is estimated to have a ten (10) month main- te, - . ce cost of about $18, 000. 00 for 1985-86. The Engineering costs woul• be spread out over a number of years. This would require a possible advance of funds by the General Fund. The following is a breakdown of the proposed budget for the Lighting Maintenance Assessment District: 1. Street lighting $ 124, 800 2 . Tree removal - includes necessary repair of damaged curb, gutter, sidewalk and street for estimated 25 - 40 locations 25, 000 3. Tree trimming - estimated 50 - 100 locations $ 10, 000 4. This includes 20% of the estimated labor costs for administration of the landscaping related portions of the proposed work. The cost for the landscaping and tree related expenses can be supplemented with gas tax funds . AD-84-1 has an estimated balance of $16, 000. 00. These funds should be transferred to AD-84-2. The areas currently within Ad-B4-1 are not scheduled to be accepted by the City for maintenance purposes until sometime in 1985-86. The Engineer will be at the meeting to present the report, including the proposed method of spreading the assessments. Dennis Delzeit , City Engineer DATE : City Council Meeting of May 22 , 1985 RECEIVED SUBJECT: Proposed Lighting Maintenance Assessment District MAY 161985 No. A.D. 84-2 City of Moorpark Proposed Park Maintenance Assessment District No. A.D. 85-1 PROPOSED ACTION Adopt the procedural resolutions attached to this report and set the public hearings for the proposed districts . BACKGROUND INFORMATION The first course of action for the Cit - in the formation of the two districts is to adopt the o enclosed . ocedural resolutions and set the Public Hearing date. The Engineer' s Report provides a description of the benefits that the two districts will provide to the City as well as a cost breakdown and a proposed method of spreading the costs among the parcels within the City. Both of the formulas attempt to relate the benefit received on the basis of "people use" and are described in detail in these reports. Both of these formulas were specifically developed for the City of Moorpark and, are subject to review and modification by the City Council prior to the final confirmation of the Assess- ment District . The appropriate time for the City Council to direct staff to make any changes (if any are necessary) would be at the Public Hearing , after hearing testimony presented by staff and the public. Assuming that both of these districts will be successfully implemented, staff would then take any final changes as directed 799 Moorpark Avenue Moorpark,California 93021 (805)529-6864 Page -2- by the City Council and incorporate them into the spread method prior to submitting the amounts to be collected to the County Auditor. RECOMMENDED ACTION Adopt the enclosed resolutions and set the Public Hearing date for June 3 , 1985 for the two districts . RDD: 1b2 Encl. ..5164.4_ 1 - 4 RESOLUTION NO. 85- /920 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, INITIATING PROCEEDINGS FOR THE FORMATION OF THE "PARKS MAINTENANCE ASSESSMENT DISTRICT NO. AD-85-1 " , AN ASSESSMENT DISTRICT TO BE ESTABLISHED PURSUANT TO THE "LANDSCAPING AND LIGHTING ACT OF 1972" ; CONSOLIDATING A PORTION OF "MOORPARK LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. AD-83-1" THEREWITH; AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT IN ACCORDANCE THEREWITH. WHEREAS, at a Special Municipal Election held in the City of Moorpark on November 6 , 1984, the voters of the City supported an advisory measure for the City Council to consider the formation of an assessment district pursuant to the Landscaping and Lighting Act of 1972 for the purpose of maintaining public parks and other landscaped areas within the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1 . Inititation of Proceedings to Form Assessment District. Pursuant to Section 22585 of the Streets and Highways Code of the State of California, this Council hereby proposes to form, and does initiate proceedings for the formation of a parks maintenance assessment district purusuant to, and in accordanc with, the provisions of the "Lanscaping and Lighting Act of 1972" , as set forth in Part 2 of Division 15, Section 22500 et seq. , of said Code, to provide for the maintenance and improvement of parks and recreational facilities within the City. SECTION 2. Description of Service and Maintenace. The assessments proposed to be levied and collected shall be used for the maintenance and improvement of parks and recreational facilites pursuant to Section 22525 of the Streets and Highways Code of the State of California. SECTION 3. Description of Proposed Assessment District. To ensure that the costs and expenses of maintaining and improving the parks and recreational facilities in the City are borne by the owners of the property to be benefited thereby, this Council resolves that the proposed parks maintenance assessment district consist of all property within the City. SECTION 4. Consolidation of Portion of "Moorpark Landscape Maintenance Assessment DistrictNo. AD-83-1" . Said parks maintenance district shall specifically include the parksite with all improvements located therein, described by and heretofore included within "Moorpark Landscape Maintenance Assessment District No. AD-83-1" , which was -1- formed and confirmed by this City Council by Resolution No. 83-44, adopted October 3, 1983, a.id the above described portion of said "Moorpark Landscape Maintenance Assessment District No. AD-83-I" shall be consolidated with said parks maintenance assessment district, pursuant to the provisions of Sections 22585 et seq. of said Streets and Highways Code. SECTION 5. Distinctive Designation. The distinctive desig- nation for the proposed assessment district to be formed pursuant to this resolution shall be "Parks Maintenance Assessment District No. AD-85-1". SECTION 6. Preparation of Engineer ' s Report. The City Manager is directed to cause to be prepared an Engineer ' s Report, in accordance with Article 4, Chapter 1, Part 2, Division 15 of said Streets and Highways Code; and that upon completion, the report shall be filed with the City Clerk, who shall then submit the same to the City Council for its consideration, pursuant to Section 22586 of said Street and Highways Code. SECTION 7. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this day of May, 1985. WHEREAS, by Resolution No. 85- , the City Council ordered the City Manager to cause to be prepared an Engineer' s Report in accordance with Article 4, Chapter 1, Part 2, Division 15 of the California Streets and Highways Code; and WHEREAS, pursuant to said Resolution the Engineer' s Report was filed with the City Clerk on the day of May, 1985; and WHEREAS, the City Clerk has submitted the report to the City Council and the City Council now has reviewed and examined the report as so submitted; • NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1 . The Engineer' s Report, prepared pursuant to Resolution No. 85- and filed with the City Clerk on the day of May, 1985, is hereby approved. SECTION 2. AD-85-1" , PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO. WHEREAS, the City Council, by Resolution No. 85- proposed to form a parks maintenance assessment district pursuant ' to the provisions of the Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the California Streets and Highways Code) ; and WHEREAS, by said Resolution No. 85- , the City Council ordered the City Manager to cause to be prepared an Engineer' s Report, pursuant to Article 4, Chapter 1, Part 2, Division 15 of the said Streets and Highways Code; and WHEREAS, the Engineer' s Report was prepared and filed, and the same was approved by the Council on the day of May, 1985 by Resolution No. 85- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE. AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of Moorpark to order the formation of "Parks Maintenance Assessment District No. AD-85-1" , consisting of a single City-wide zone for the maintenance and improvement of parks and recreational facilites within the city, . pursuant to the Landscaping and Lighting Act of 1972. In addition, said district is to be formed to levy and collect assessments for such parks maintenance and improvement in accordance with said Act. SECTION 2. That said parks maintenance assessment district shall specifically include the parksite with all improvements located therein, described by and heretofore included within "Moorpark Landscape Maintenance Assessment District No. AD-83-1" , which was formed and confirmed by this City Council by Resolution No. 83-44, adopted October 3, 1983, and the above described portion of said "Moorpark Landscape Maintenance Assessment District No. AD-83-1" shall be consolidated with said parks maintenance assess- ment district, pursuant to the provisions of Section 22585 et seq. of said Streets and Highways Code. SECTION 3. That the foregoing described work is to be located within said Assessment District, the boundary of which is more particularly described on a map on file in the City Clerk' s office -1- and is entitled, "Diagram of Parks Maintenance Assessment District No. Ad-85-1" , filed in the office of the City Clerk on the day of May, 1985 . SECTION 4 . That the contemplated maintenance and improvement of parks and recreational facilities, in the opinion of said City Council, is of benefit to, and the said City Council hereby makes the expense of the said maintenance and improvement chargeable upon, the district. SECTION 5. Reference is hereby made to the report of the Engineer on file with the City Clerk and open to inspection, for a full and detailed description of the improvements, the boundaries of the Assessment District and any zones therein, and the proposed assessments upon assessable lots and parcels of land within the District. SECTION 6. Notice is hereby given that on the 3rd day of June, 1985, at the hour of 7: 00 p.m. , in the Council Chambers in the City Hall of said City, located at 799 Moorpark Avenue, Moorpark, any and all persons having any objections to the work or extent of the assessment district may appear and show cause why said work should not be done or carried out or why said district should not be formed in accordance with this Resolution of Intention. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection and if filed by a property owner., shall contain a description sufficient to identify the property. SECTION 7. All the work herein proposed shall be done in accordance with the Landscaping and Ligiting Act of 1972, being Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 8. The City Clerk shall cause notice of the hearing to be given by causing the Resolution of Intention to be published and mailed in the manner required by Part 2 of Division 15 of the Streets and Highways Code.
