Wall , City Clerk DATE: June 24, 1988 SUBJECT: Resolutions needed to call and give notice of the holding of a General Municipal Election and possible Special Election to be held in the City on November 8, 1988 This November three councilmanic seats are up for election with this being the City' s third General Municipal Election held since our incorporation. As with all elections, the Council needs to take certain actions to call and give notice of the election, to ask the Board of Supervisors to consolidate our election with the Presidential General Election, and to ask the County Clerk to perform election-related services for the City. The resolutions necessary to take these actions are contained in your council packet as Items 11.0. , 11.5. , and must be approved and presented to the County by July 7, 1988. On June 15, 1988, your Council asked that additional resolutions be prepared which would allow you to also place a Council-initiated measure on the November ballot. This would require that your Council additionally call for a Special Election to be held on November 8, 1988. The resolutions necessary to take these actions are contained in your council packet as Items 11. P. , 11.Q. , and 11. R. , and must be approved and presented to the County by July 7, 1988 if the Council desires to place a measure on the November 1988 ballot. General Municipal Election - November 8, 1988: You will recall that candidate' s statements for the February 1988 election were estimated to be quite costly ($400), and then subsequently reduced to $156. During a joint meeting with the County Clerk' s office and City Clerks who are holding elections this November, it was determined that candidate' s statements for our City will cost each candidate approximately $170. Staff is pleased to see these estimates more closely match actual costs of candidate' s statements in the past. The candidate' s statements are printed 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 , Honorable City Council June 24, 1988 Page 2 by the County, but are paid for by the candidates. Pursuant to Resolution No. 84-107, these statements may not be more than 200 words in length. The Request for Election Services spells out each item of service the City is requesting. In essence, the County will be providing master sets of election forms; verifying signatures on the candidate' s nomination petitions; printing the candidates' statements and all necessary election forms; and providing all equipment, equipment set-up, and precinct workers necessary to carry out the election. Staff is recommending one deviation in the election services contract from what has been done in the past; that is the use of a computer terminal (CRT) in our multi-purpose room to allow access to vote tabulation as ballots are being tallied. Most cities in our county use CRT' s during their general elections. Absentee ballots will be tabulated at the close of the polls (8:00 p.m. ), with ballots from our precincts estimated to be received at 10:30 p.m. and tabulation of those ballots to begin shortly thereafter. Attached for your information are floor plans of the County Elections Department which indicate how ballots are processed, as well as the routes ballot boxes take prior to their arrival at the Government Center (Exhibits A,B,C & D). Estimated costs for the General Municipal Election were not available at the time of this report, but will be briefly outlined for you during the June 29, 1988 meeting. Special Election - November 8, 1988: The initiative process relating to municipalities, or the ability to enact ordinances by and for any incorporated city, is set forth in the Elections Code beginning with Section 4000. Election Code Section 4017 allows the City Council to submit to the voters the enactment of an ordinance to be voted upon at any special city election. If the Council wants to place an initiative on the November 1988 ballot, you would need to take several actions to begin the election process. The City Council must adopt a resolution calling and giving notice that a Special Municipal Election is to be held in the City on November 8, 1988 and additionally asking that our election be consolidated with the statewide presidential general election which is also being held on that date (Item 11.P. ). Your Council should additionally direct that the City Attorney' s office prepare an impartial analysis of the measure showing the effect of the measure on the existing law and the operation of the initiative. This analysis, which cannot exceed 500 words, will be included in the voter information pamphlet. Under Elections Code Section 5013, the City Council can authorize any member or members of the Council , or any individual voter who is eligible to vote on the measure, or bona fide association of citizens, or any combination of voters and associations, to file a written argument for or against any city Honorable City Council June 24, 1988 Page 3 measure. The argument cannot exceed 300 words in length. In the past the City Council has authorized the full Council to submit the argument for the initiative, and a resolution giving the full Council authorization to file the written argument for the initiative has been prepared (Item 11.Q. ). The deadline for filing arguments for or against the initiative is August 1, 1988 at 5:00 p.m. The written argument(s) as submitted may be amended by the filer(s) until the deadline. Section 5014.5 of the Elections Code, if adopted by the Council , allows rebuttals if arguments for and against the initiative have been filed. Staff is suggesting this section be adopted since this is a Council initiated measure, and you may want to rebut if an argument is filed against the initiative. The deadline for the filing of both rebuttals, one supporting the argument for and one supporting the argument against, would be August 11, 1988 at 5:00 p.m. This section would be applicable until it is repealed by the City Council . In the past the Council has enacted this section, but has included a "sunset clause" making the section applicable only to the subject election. This allows a future Council the option of applying the section as they deem appropriate. Such a resolution has been prepared, and is attached (Item 11. R. ). I have included an election calendar of events for the November 8, 1988 election if a measure is to be consolidated with the Presidential General Election for your use (Exhibit D). Cost estimates for the holding of this election were not available from the County at the time this report was prepared. They will be outlined for you during the meeting of June 29, 1988. STAFF RECOMMENDATION: 1. Adopt Resolution No. 88- 5/fo (Item 11.0. ) calling and giving notice of a General Municipal Election to be held in the City on Tuesday, November 8, 1988 for the election of certain officers of the City and requesting said General Municipal Election be consolidated with the Presidential General Flection on said date. 2. Adopt Resolution No. 88- 4/8/ (Item 11.5. ) requesting the Board of Supervisors of Ventura County permit the County Clerk to render services to the City of Moorpark for the election to be held in the City on November 8, 1988. 3. Adopt Resolution No. 88- yR). (Item 11 . P. ) calling and giving notice of a Special Municipal Election to be held in the City on Tuesday, November 8, 1988 for the submission of the questions or measure to the qualified electors of the City of a separately elected Mayor for a two or four year term and requesting consolidation of said election with the Presidential General Election on said date, if Council desires to place this measure on the November ballot. 4. Adopt Resolution No. 88- iif? (Item 11.Q. ) authorizing certain members of the Council to file a written argument for or against the questions or measure concerning a separately elected Mayor for a two Honorable City Council June 24, 1988 Page 4 or four year term to be submitted to the voters of the City at a Special Municipal Election to be held November 8, 1988, if Council desires to place this measure on the November ballot. 5. Adopt Resolution No. 88- 989 (Item 11. R. ) providing for the filing of rebuttal arguments for City measures submitted at municipals elections, if Council desires to place a measure on the November ballot. 6.
