Bobardt, Community Development \ip tor Prepared by Joseph Fiss, Principal Planner DATE: October 21, 2014 (PC Meeting of 10/28/2014) SUBJECT: Consider Resolution Approving Conditional Use Permit (CUP) No. 2014-07, to Allow an Automotive Repair Shop at 480 Moorpark Avenue and Making a Determination of Exemption under CEQA in Connection Therewith, on the Application of Jeff Morris (Open Public Hearing Continued from September 23, 2014) BACKGROUND/DISCUSSION On September 23, 2014, the Planning Commission opened a public hearing, took testimony on proposed CUP No. 2014-07, for an automotive repair shop in an existing building at 480 Moorpark Avenue. A copy of the original staff report is attached. After closing the public hearing, the Planning Commission discussed this item and expressed concern regarding the parking lot accessibility and landscaping, the interior accessibility, and the proposed term of the Permit. The item was continued to the October 28, 2014 Planning Commission meeting with the hearing open. The applicant has worked with staff, including the Building Official, to revise the site and floor plans showing a plan that meets the Moorpark Zoning Code and City Landscape Standards and Guidelines for parking and landscaping, and also meeting the California Building Code for interior and exterior accessibility standards (PC Attachment 2). In order to accommodate a van accessible parking space and the proper number of parking spaces, one parking space was relocated to an existing covered bay area in the rear of the property. This bay area is also proposed to accommodate trash and recycling bins. Buildings within the "mercantile" category, with less than 50 occupants are required to only have one unisex accessible restroom. This has been accommodated within the existing showroom area. With regard to the proposed term of the permit, staff has met with the applicant and discussed this condition of approval. Staff's recommendation (Condition No. 3) is for the permit to be valid for 10 years, with an extension by the Community Development Director of an additional five years if all conditions of approval have been met by the applicant. Staff maintains that this condition is necessary given the changes taking 1 Honorable Planning Commission October 28, 2014 Page 2 place to nearby uses in the neighborhood. Should the use still meet the findings of a Conditional Use Permit in 15 years, the applicant could seek a new permit. The attached draft resolution has been updated to reflect the October 28 decision date, however, no additional or modified conditions of approval are proposed. STAFF RECOMMENDATION 1. Continue to accept testimony and close the public hearing. 2. Carrillo,Assistant Planner I 1 DATE: August29, 2014 (PC Meeting of 9/23/2014) SUBJECT: Consider a Resolution Approving Conditional Use Permit (CUP) No. 2014-07, to Allow an Automotive Repair Shop at 480 Moorpark Avenue and Making a Determination of Exemption under CEQA in Connection Therewith, on the Application of Jeff Morris BACKGROUND A Conditional Use Permit application was filed by Jeff Morris on July 29, 2014, to allow an automotive repair shop with seven (7) service bays, display area, and office space in two existing buildings on a 16,500 square-foot lot at 480 Moorpark Avenue (within the Downtown Specific Plan area). DISCUSSION Project Setting Existing Site Conditions: The property is located on Moorpark Avenue between First Street and Second Street with a main entrance from Moorpark Avenue and a secondary entrance from an alley behind the property. Two vacant buildings exist on site. The northernmost building is approximately 4,532 square-feet and includes a display area, office space, and five (5) service bays. The southernmost building is approximately 2,436 square feet and includes two (2) service bays and two storage bays. The applicant owns a vacant lot behind the property across the alley. The lot was historically used for parking and storage of vehicles for the automotive businesses on the subject property. It is zoned for residential use (R-1) and has since lost its non- conforming rights for commercial parking due to non-use. This lot is not part of the current application. PC ATTACHMENT 1 1 3 Honorable Planning Commission September 23, 2014 Page 2 Currently the site includes parking for only six (6) vehicles. This has been a non- conforming condition which right was lost after the non-conforming use rights expired. Display Area 1000 s.f. 1/1000 1 Office 200 s.f. 1/300 1 Service Bays 7 Bays 1/Bay 7 Total 9 In order to provide the nine (9) required parking spaces, the applicant has provided plans for the Moorpark Avenue driveway to be removed and relocated per Caltrans' standards. The proposed parking area and associated improvements, including landscaping, are required and are addressed in a condition of approval in the attached resolution. Previous Applications: The City does not have early records for 480 Moorpark Avenue. Therefore, staff is unable to report on the permit history and its early uses. However, the applicant was able to give staff a recollection on the history of the site. The buildings were built by the Morris family in the 1940s for a Chevrolet sales and service center. The center closed down when the family decided to build a new and bigger facility in Simi Valley. Since then the site has been used on and off as an auto repair or tire shop. The Zoning Ordinance requires Planning Commission approval of a Conditional Use Permit for an auto repair 2 4 Honorable Planning Commission September 23, 2014 Page 3 shop in the Neighborhood Commercial (C-1) Zone. This allows for consideration of the compatibility of the proposed use with surrounding uses in making findings on the application, and adoption of conditions of approval as deemed necessary. ANALYSIS Issues Auto repair uses are the primary concern in the analysis of this application. The zoning ordinance allows brake repair, oil change, tires and shock sales and installation, tune- ups, smog check, window tinting, electronic installation, and other light service and repair. The zoning ordinance does not allow auto body shops, painting, engine rebuilding, transmission repair, steam cleaning, and other heavy service and repair in the Neighborhood Commercial (C-1) zone. A condition of approval has been added to prohibit any kind of heavy service and repair from being conducted on this property. Certain site improvements are necessary to bring the property to current standards. The chain-link fence and gate located on the west and east sides of the property are in disrepair and would not be approved under today's standards. The vacant buildings have been a target for graffiti for several years. To enhance the property, staff has recommended a condition to replace the chain-link fence and gate with a decorative fence and gate, and to repaint both buildings to the satisfaction of the Community Development Director. In addition, staff has also added a condition to apply an anti- graffiti coating to the buildings to prevent graffiti paint from bonding to surfaces. To maintain consistency with the future goals of the neighborhood, a condition of approval has been added to review this CUP in the future. The condition is as follows, "This permit will be valid for ten (10) years from the date of final approval. Upon written request of the applicant at least sixty (60) days prior to the expiration of this permit, the Community Development Director may extend this permit an additional five (5) years if all conditions of approval have been met by the applicant". Staff has identified compatibility with surrounding uses as the only potential issue for this proposed use. Conditions of approval are recommended to preclude outdoor storage and repair work. In addition, the vacant lot under same ownership across the alley from the property may not be used for parking or storage of vehicles. Staff has added a condition to satisfy this concern. Given the location of the proposed use within an commercial with other light service and repair, and office use in the vicinity, and that all activities will take place within the building, staff does not find concerns with land use compatibility with the project as conditioned. 3 5 Honorable Planning Commission September 23, 2014 Page 4 Findings A. The proposed auto repair shop use is consistent with the provisions of the General Plan, Zoning Ordinance, and any other applicable regulations, in that the property is planned, zoned, and developed for a variety of light service and repair uses to take place within the building on site. B. The proposed use is compatible with both existing and permitted land uses in the surrounding area, in that this is a light service and repair use where an auto repair shop is not unexpected and other auto repair shops have located in the vicinity. C. The proposed use is compatible with the scale, visual character and design of surrounding properties, in that the auto repair shop does not require any modification to the exterior of the approved building. D. The proposed use would not be obnoxious or harmful, or impair the utility of neighboring property or uses, in that conditions are required to ensure proper control of the auto repair shop including conditions that all work will take place inside the building and all vehicles under repair will be stored inside the service bays. E. The proposed use would not be detrimental to the public health, safety, convenience, or welfare, in that conditions are required to ensure proper control of an auto repair shop. PROCESSING TIME LIMITS Time limits have been established for the processing of development projects under the Permit Streamlining Act (Government Code Title 7, Division 1, Chapter 4.5), the Subdivision Map Act (Government Code Title 7, Division 2), and the California Environmental Quality Act Statutes and Guidelines(Public Resources Code Division 13, and California Code of Regulations, Title 14, Chapter 3). Under the applicable provisions of these regulations, the following timelines have been established for action on this project: Date Application Determined Complete: August 29, 2014 Planning Commission Action Deadline: December 1,2014 Upon agreement by the City and Applicant one 90-day extension can be granted to the date action must be taken on the application. ENVIRONMENTAL DETERMINATION In accordance with the City's environmental review procedures adopted by resolution, the Community Development Director determines the level of review necessary for a project to comply with the California Environmental Quality Act (CEQA). Some projects may be exempt from review based upon a specific category listed in CEQA. Other 6 Honorable Planning Commission September 23, 2014 Page 5 projects may be exempt under a general rule that environmental review is not necessary where it can be determined that there would be no possibility of significant effect upon the environment. A project which does not qualify for an exemption requires the preparation of an Initial Study to assess the level of potential environmental impacts. Based upon the results of an Initial Study, the Director may determine that a project will not have a significant effect upon the environment. In such a case, a Notice of Intent to Adopt a Negative Declaration or a Mitigated Negative Declaration is prepared. For many projects, a Negative Declaration or Mitigated Negative Declaration will prove to be sufficient environmental documentation. If the Director determines that a project has the potential for significant adverse impacts and adequate mitigation cannot be readily identified, an Environmental Impact Report(EIR) is prepared. The Community Development Director has determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The proposed project associated with CUP No. 2014-07 qualifies for a Class 1 categorical exemption under State CEQA Guidelines Section 15301 (Existing Facilities) in that CUP No. 2014-07 would allow an automotive repair shop on a site previously developed and used as an automotive repair shop, and this use as conditioned is consistent with the applicable general plan designation and all applicable general plan policies as well as with the applicable zoning designation and regulations. In addition, there is no substantial evidence that the project will have a significant effect on the environment. NOTICING Public Notice for this meeting was given consistent with Chapter 17.44.070 of the Zoning Ordinance as follows: 1. Publication. The notice of the public hearing was published in the Ventura County Star on September 14, 2014. 2. Mailing. The notice of the public hearing was mailed on September 11, 2014, to owners of real property, as identified on the latest adjusted Ventura County Tax Assessor Roles, within one-thousand (1,000) feet of the exterior boundaries of the assessor's parcel(s) subject to the hearing. 3. PC-2014- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT (CUP) NO. 2014-07, TO ALLOW AN AUTOMOTIVE REPAIR SHOP AT 480 MOORPARK AVENUE, AND MAKING A DETERMINATION OF EXEMPTION UNDER CEQA IN CONNECTION THEREWITH, ON THE APPLICATION OF JEFF MORRIS WHEREAS, on July 29, 2014, an application for Conditional Use Permit No. 2014-07 was filed by William Morris, Jr. to allow an auto repair shop at 480 Moorpark Avenue; and WHEREAS, at a duly noticed public hearing on September 23, 2014 and October 28, 2014, the Planning Commission considered the application for Conditional Use Permit (CUP) No. 2014-07, the agenda report and any supplements thereto and written public comments; opened the public hearing and took and considered public testimony both for and against the proposal; closed the public hearing, and on October 28, 2014 reached a decision on this matter; and WHEREAS, the Community Development Director has determined that the proposed project associated with CUP No. 2014-07 qualifies for a Class 1 categorical exemption under State CEQA Guidelines Section 15301 (Existing Facilities) in that CUP No. 2014-07 would allow an automotive repair shop on a site previously developed and used as an automotive repair shop, and this use as conditioned is consistent with the applicable general plan designation and all applicable general plan policies as well as with the applicable zoning designation and regulations. In addition, there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The Planning Commission concurs with the Community Development Director's determination that the proposed project associated with CUP No. 2014-07 qualifies for a Class 1 categorical exemption under State CEQA Guidelines Section 15301 (Existing Facilities) in that CUP No. 2014-07 would allow an automotive repair shop on a site previously developed and used as an automotive repair shop, and this use as conditioned is consistent with the applicable general plan designation and all applicable general plan policies as well as with the applicable zoning designation and regulations. In addition, there is no substantial evidence that the project will have a significant effect on the environment. PC ATTACHMENT 3 14 Resolution No. PC-2014- Page 2 The Planning Commission has reviewed the Community Development Director's determination of exemption, and based on its own independent judgment, concurs in staff's determination of exemption. SECTION 2. CONDITIONAL USE PERMIT FINDINGS: Based upon the information set forth in the staff report(s), accompanying studies, and oral and written public testimony, the Planning Commission makes the following findings in accordance with City of Moorpark, Municipal Code Section 17.44.040: A. The proposed automotive repair shop use is consistent with the provisions of the General Plan, Zoning Ordinance, and any other applicable regulations, in that the property is planned, zoned, and developed for a variety of light service and repair uses to take place within the building on site. B. The proposed use is compatible with both existing and permitted land uses in the surrounding area, in that this is a light service and repair use where an auto repair shop is not unexpected and other auto repair shops have located in the vicinity. C. The proposed use is compatible with the scale, visual character and design of surrounding properties, in that the auto repair shop does not require any modification to the exterior of the approved building. D. The proposed use would not be obnoxious or harmful, or impair the utility of neighboring property or uses, in that conditions are required to ensure proper control of the auto repair shop including conditions that all work will take place inside the building and all vehicles under repair will be stored inside the service , bays. E. The proposed use would not be detrimental to the public health, safety, convenience, or welfare, in that conditions are required to ensure proper control of an auto repair shop. SECTION 3. Bobardt Community Development Director Exhibit A—Standard and Special Conditions of Approval 16 Resolution No. PC-2014- Page 4 EXHIBIT A STANDARD AND SPECIAL CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT (CUP) No. 2014-07 STANDARD CONDITIONS OF APPROVAL The applicant shall comply with Standard Conditions of Approval for Conditional Use Permits as adopted by City Council Resolution No. 2009-2799, except as modified by the following Special Conditions of Approval. In the event of conflict between a Standard and Special Condition of Approval, the Special Condition shall apply. SPECIAL CONDITIONS 1. This Conditional Use Permit is granted or approved with the City's designated approving body retaining and reserving the right and jurisdiction to review and to modify the permit—including the conditions of approval—based on changed circumstances. Changed circumstances include, but are not limited to, major modification of the business; a change in scope, emphasis, size, or nature of the business; the expansion, alteration, reconfiguration, or change of use; or the fact that the use is negatively impacting surrounding uses by virtue of impacts not identified at the time of application for the conditional use permit or impacts that are much greater than anticipated or disclosed at the time of application for the conditional use permit. The reservation of right to review any permit granted or approved under this chapter by the City's designated approving body is in addition to, and not in lieu of, the right of the City, its Planning Commission, City Council and designated approving body to review and revoke or modify any permit granted or approved under this chapter for any violations of the conditions imposed on such permit. 2. The development must be in substantial conformance with the plans presented in conjunction with the application for Conditional Use Permit No. 2014-07, except any modifications as may be required to meet specific Code standards or other conditions stipulated herein. 3. This permit will be valid for ten (10) years from the date of final approval. Upon written request of the applicant at least sixty (60) days prior to the expiration of this permit, the Community Development Director may extend this permit an additional five (5) years if all conditions of approval have been met by the applicant. 4. No outdoor storage is allowed under this approval. Any request for outdoor storage is subject to the application requirements in place at the time of such request. 5. The chain-link fence and gate located on the west and east sides of the property shall be replaced with decorative fencing and gate to the satisfaction of the 17 Resolution No. PC-2014- Page 5 Community Development Director. Razor wire fencing and barbed wire fencing are not permitted. 6. Prior to issuance of a Zoning Clearance for a Building Permit, the applicant shall provide a color board to be reviewed and approved by the Community Development Director. 7. Prior to issuance of a Zoning Clearance for Occupancy, the applicant shall install an anti-graffiti coating to the building, and prior to installation, the applicant shall submit the proposed brand and application of the anti-graffiti coating for the review and approval of the Community Development Director. 8. Lighting is subject to review and approval by the Community Development Director and Police Chief and must comply with Chapter 17.30 of the Zoning Code. 9. All exterior areas of the site, including parking areas under use by the facility, shall be maintained free of litter and debris at all times. 10. Hours of operation shall be no earlier than 7:00 a.m. and no later than 7:00 p.m. Monday through Saturday. The Community Development Director shall have the authority to restrict hours of operation through a Permit Adjustment when in his/her opinion limits on hours of operations are necessary to maintain compatibility with adjacent uses. 11. No outdoor repair or maintenance, including washing, cleaning, or detailing of vehicles is allowed under this permit. All mechanical equipment (e.g. air compressors) must also be kept inside service bays. 12. No heavy service or repair such as auto body shop, painting, engine rebuilding, transmission repair, steam cleaning and other heavy services are allowed. 13. The vacant lot on First Street on the east side of the alley across from 480 Moorpark Avenue shall not be used in conjunction with the commercial use of this site. Parking or storage may not take place on this lot. 14. Vehicles brought in for service may only be parked within the parking spaces designated for this building during open hours of operation and may not be parked in driveway, street, or in the alley. All vehicles left overnight and on weekends (outside business hours), both operative and inoperative, must be parked inside the service bays. 15.
