SUBJECT: PROPOSAL FOR THE DEVELOPMENT OF A GOLF COURSE, TENNIS
CLUB AND 159 RESIDENTIAL UNITS (BOLLINGER DEVELOPMENT
CORP. ) - CONSIDERATION FOR ENTITLEMENT PROCESSING
Background
The Bollinger Development Corp. of Westlake Village is requesting
that the City Council consider special entitlement processing so
as to develop a 518 acre site in the northwest portion of the City
(see attached map) . The proposed development includes an 18 hole
golf course, tennis club, golf course club house, 159 single family
home sites, a 10 acre site for a future church, and an equestrian
park.
The subject site is zoned RE-5 acre (Residential Estate - 5 acre
lot size) . The surrounding land uses are orchards and vacant land
to the north; generally vacant land and some residential units on
acreage property to the south; to the east across Walnut Canyon
Road is generally vacant land; to the west is Tract 3319-1 a 5 acre
lot subdivision.
Discussion
The current zoning and General Plan designation of the subject
property requires that future development allow for only the
creation of 5 acre residential lots. Under the current zoning,
only 103 lots could be created. If 10 acres is taken for a future
church site; then only 101 lots could be allowed under current
zoning.
The golf course, tennis club, etc . may only be allowed in
conjunction with the "clustering " of dwelling units (minimum 1

acre lot size) benefit provided by such a design. Should the
Council consider allowing this proposal to proceed, findings of
"public benefit" must be made.
The proposal as suggested by the Bollinger Development Corp. , will
require a General Plan Amendment. The proposal is requesting to
be processed outside of the current General Plan Update program.
As identified by staff in the past, processing a GPA outside of the
current General Plan Update undermines the intent of the current
process and has the potential to foster other similar demands upon
the City. If this request be allowed to proceed, specific findings
should be evidenced by the City.
Although the Community Development Committee has met with Mr. Paul
Bollinger of Bollinger Development Corp. , on several occasions,
the Committee does not recommend that this project proceed.
Staff Recommended Action
That the City Council deny the request of Bollinger Development
Corp. as proposed.

Dear Mr . Richards ;
Per our meeting with Mr . Harper and Mrs . Brown we are requesting
that the following items be acted upon.
1 . That council will approve the over all concept of this
project for 159 lots and a golf course community on 518
acres in the Northwest part of the City of Moorpark as
shown on map. (shown at February 21 , 1990 council
meeting)
2 . That council allows this project to be considered
separately from the general plan update which is
presently under study. This is the most important item
because of the time restraints on Bollinger
Development , Inc . I 'm asking the city to take this
opportunity to facilitate the project .
3 . I am asking city council to give staff the necessary
latitude and authority to be able to deal with the
following items in an expedited and timely manner .
A. Final Track Map or Vested Map
To review subject project map and change any
items necessary so that the final map will be
acceptable to staff and city council .

B . Zone Change
To change the present zoning of R-5 to RPD and
correlate such other development controls and
entitlements needed for a residential
development , or any other items associated with
this project such as a golf course, tennis
facility and any other auxiliary uses which the
staff feels necessary to this project .
4 . Development Agreement
I 'm asking city council to authorize the city attorney
to draft a development agreement at Bollinger expense
so that we can expedite the procedure . The city
attorney , staff and Bollinger will draft a
comprehensive development agreement with appropriate
development standards , building allotment, cost , fees,
entitlement required which will be acceptable to city
council .
5 . Engineering Consultants
Allow staff to hire outside engineering consultants
where needed for any of the following items , EIR
update, development agreement , traffic studies, staff
help or for any other reason. It is understood that
Bollinger Development , Inc. will pay for any expense
associated with such services. By hiring outside help
we can expedite all the procedure needed to bring this
project to a successful conclusion.
