Bankus, City Cler:� /' DATE : August 26, 1985 . S UB.T E C T = Unscheduled Vacancy Notice BACKGROUND: Section 54974 of the Government Code reads as follows: "Sec. 54974. Unscheduled vacancy; special notice; acting basis; final appointment "Whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, whether due to resignation, death, termination, or other causes, a special vacancy notice shall be posted in the office of the clerk of the local agency, and in other places as directed by the legislative body within 20 days after the vacancy occurs. Final appointment to the board, commission, or committee shall not be made by the legislative body for at least 10 working days after • the posting of the notice in the clerk's office. "Notwithstanding the provisions of Section 54974, the legislative body may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. Persons appointed to fill such a vacancy shall only serve on an acting basis until the final appointment is made pursuant to this section." In view of the foregoing, we have posted a notice of the vacancy created by the recent resignation of Tom Schleve from the Planning Commission. A copy of the notice is attached. The notice was posted in the office of the City Clerk on August 26, 1985. Any further posting would be at the direction of the City Council. Appointment to fill the vacancy may be made after September 10, 1985, or prior to that time if any emergency exists. We will place the matter on the agenda for appointment to fill the vacancy at your meeting of September 16, 1985.
