ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, AMENDING CHAPTER 2. 06 OF
TITLE 1 OF THE MOORPARK MUNICIPAL CODE,
RELATING TO THE RESIGNATION OF
COMMISSIONERS.
THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Article I of Chapter 2.06 of Title 1 of
the Moorpark Municipal Code is hereby amended by revising
Section 2.06.040 to read as follows:
"Section 2.06.040 - Removal of Members
(a) Any member of the Planning Commission may
be removed by any of the following:
( 1) A majority vote of the legislative
body;
( 2) Absence from three ( 3) consecutive
regular meetings without formal
consent of the Commission shall be
deemed to constitute the resignation
of the Commissioner and the position
declared vacant.
( 3) Resignation by the Commissioner,
which shall be in writing and shall
be deemed effective immediately upon
receipt by the City Clerk regardless
of the date specified in the
resignation. The City Clerk shall
immediately inform the City Council
of any such vacancy by causing a
copy of the resignation to be sent
to each Councilmember. "
SECTION 2. Article II of Chapter 2. 06 of Title
1 of the Moorpark Municipal Code is hereby amended by
revising Section 2. 06. 140 to read as follows:
"Section 2.06.140 - Removal of Members
(a) Any member of the Parks and Recreation
Commission may be removed by any of the following:
(1) A majority vote of the legislative body;
( 2) Absence from three ( 3) consecutive regular
meetings without formal consent of the
Commission shall be deemed to constitute the
resignation of the Commissioner and the
position declared vacant.
( 3) Resignation of the Commissioner , which shall
be in writing and shall be deemed effective
immediately upon receipt by the City Clerk
regardless of the date specified in the
resignation. The City Clerk shall immediately
inform the City Council of any such vacancy by
causing a copy of the resignation to be sent
to each Councilmember . "
SECTION 3 . This ordinance shall become
effective thirty ( 30) days after its passage and adoption.
SECTION 4. The City Clerk shall certify to the
passage and adoption of this ordinance; shall enter the same
in the book of original ordinances of said City; shall make
a minute of the passage and adoption thereof in the records
of the proceedings of the City Council at which the same is
passed and adopted; and shall, within fifteen ( 15) days
after the passage and adoption thereof, cause the same to be
published once in the Moorpark News, a weekly newspaper of
general circulation, as defined in Section 6008 of the
Government Code, for the City of Moorpark, and which is
hereby designated for that purpose.
