INUTES OF THE CITY COUNCIL r ~e Moorpark, California November 5, 2014 A Special Meeting of the City Council of the City of Moorpark was held on November 5, 2014, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:49 p.m. 2. ROLL CALL: Present: Councilmembers Mikos, Millhouse, Pollock, Van Dam, and Mayor Parvin. Staff Present: Steven Kueny, City Manager; Kevin Ennis, City Attorney; Hugh Riley, Assistant City Manager; and Deborah Traffenstedt, Deputy City Manager. 3. PUBLIC COMMENT: None. 4. REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 5. PRESENTATION/ACTION/DISCUSSION: A. Consider Agreement to Purchase Tax Defaulted Property APN 500-0-170- 295 and Resolution Authorizing the Purchase of the Property and Amending the Fiscal Year 2014-15 Budget to Appropriate Funding from the City's Endowment Fund. Staff Recommendation: 1) Authorize the City Manager to sign the Agreement to Purchase Tax-Defaulted Property; and 2) Adopt Resolution 2014-3326 authorizing the purchase of the property and amending the Fiscal Year 2014-15 Budget to fund the purchase from the City's Endowment Fund. ROLL CALL VOTE REQUIRED Ms. Traffenstedt gave the staff report. There were no speakers. Councilmember Mikos stated she had been contacted by one of the adjacent property owners, who had been informed by the County staff that the City was interested in purchasing the property. 89 Minutes of the City Council Moorpark, California Page 2 November 5, 2014 MOTION: Councilmember Millhouse moved and Mayor Parvin seconded a motion to adopt Resolution No. 2014-3326, authorizing the purchase of the tax defaulted property APN 500-0-170-295 and amending the Fiscal Year 2014/15 Budget to fund the purchase from the City's Endowment Fund. The motion carried by unanimous roll call vote. 6. CLOSED SESSION: Mr. Kueny requested the Council go into closed session for discussion of one case under Item 6.C. on the agenda. MOTION: Councilmember Millhouse moved and Councilmember Van Dam seconded a motion to adjourn to closed session for discussion of one case under Item 6.C. on the agenda. The motion carried by unanimous voice vote. The time was 6:54 p.m. C. CONFERENCE WITH LEGAL COUNSEL-EXISTING LITIGATION (Pursuant to Subdivision (a) of Section 54956.9 of the Government Code) City of Moorpark vs. California Skateparks, Inc.; Insurance Company of the West et al (Civil Case No. 56-2014-00451156-CU-BC-VTA) Present in closed session were Councilmembers Mikos, Millhouse, Pollock, Van Dam, and Mayor Parvin; Steven Kueny, City Manager; Kevin Ennis, City Attorney; Hugh Riley, Assistant City Manager; and Deborah Traffenstedt, Deputy City Manager. The Council reconvened into open session at 7:02 p.m. Mr. Kueny stated one case under Item 6.C. was discussed and there was no action to report. 7.
