HomeMy WebLinkAboutAGENDA REPORT 2014 1217 CC SPC ITEM 05AWei W7.W � wn jog '31 NA , 13i Honorable City Council CITY OF MOORPARK, CALIFORNIA city Council Meeting Of 0 of Dave Klotzle, City Engineer/Public Works Director December 12, 2014 (Special Meeting of 12/17/14) SUBJECT: Consider Termination of Agreement with Sully -Miller Contracting Company, Approval of Plans and Specifications, and Authorization to Advertise for Construction Bids for the Widening of Los Angeles Avenue Between Maureen Lane and Leta Yancy Road (Project 8058) DISCUSSION On October 2, 2013, the City Council awarded a construction contract to Sully -Miller Contracting Company (Sully -Miller) for the widening of Los Angeles Avenue between Maureen Lane and Leta Yancy Road. The project includes widening the south side of Los Angeles Avenue and restriping to provide three through lanes in each direction with a center lane for left turns. Curb, gutter and sidewalk are also included in the project. The project also includes the construction of a protective concrete cap over the existing 36 -inch Calleguas Municipal Water District (Calleguas) pipeline. Several Calleguas valves and manholes also must be adjusted or relocated to the south beyond the widened roadway. The City has entered into an agreement with Calleguas for the required pipeline protection and adjustment work. The start of construction has been delayed due to: 1) the need for the City to grant an easement to Calleguas over their facilities to be relocated by the project; and 2) Caltrans requiring a new encroachment permit. The City granted the required easement to Calleguas on March 1.1, 2014, and Calleguas accepted the easement on March 19, 2014. On March 17, 2014, Caltrans informed the City that a new encroachment permit was required to proceed with construction. The City had obtained the original encroachment permit in May 2010, and several time extensions were approved by Caltrans while the project was approved by Calleguas, advertised for bids and a construction contract awarded. Just prior to the start of construction, Caltrans determined that the permit could not be extended again and a new permit application was required. Among other things, Caltrans required revisions to the plans to meet their updated standards, testing of the soil for hazardous materials, an updated stormwater report and a drainage acceptance letter Honorable City Council January 16, 2013 Page 2 from the owner of the adjacent property to the south. A new encroachment permit was issued by Caltrans on September 17, 2014. Since then, staff has been coordinating with Sully -Miller to initiate construction of the project. Recently, Sully -Miller informed staff that they no longer self -perform the type of work to construct the concrete cap over the Calleguas pipeline, and they would need to hire a subcontractor to perform the work. Additionally, Sully -Miller stated that prior to starting construction, they would seek to increase the prices included in their original bid and existing agreement for construction with the City. After review by the City Attorney, it has been determined that the preferred course of action at this time is to terminate the agreement with Sully -Miller, confirm the approval of the project plans and specifications, and advertise for new construction bids. Sully -Miller agrees with the termination of the agreement and has waived the requirement for the City to notify Sully -Miller ten days prior to terminating the agreement. The design of the project complies with applicable requirements of the Caltrans Highway Design Manual. The City Engineer/Public Works Director has reviewed the entire record for the widening of Los Angeles Avenue between Maureen Lane and Leta Yancy Road (Project 8058), including the plans and specifications for the widening of Los Angeles Avenue between Maureen Lane and Leta Yancy Road (Project 8058). It is the City Engineer/Public Works Director's professional opinion that the plans and specifications relating to the widening of Los Angeles Avenue between Maureen Lane and Leta Yancy Road (Project 8058) were designed in accordance with reasonable, professional engineering judgment, and with due consideration for public safety. A copy of the project plans and specifications has been placed on top of the file cabinet in the City Council Conference Room. Project administration will be performed by City staff with construction inspection and materials testing to be provided by Filippin Engineering. The anticipated project schedule is as follows: City Council Authorization to Bid December 17, 2014 Advertise for Bids December 29, 2014 Bid Opening February 3, 2015 Award of Construction Contract February 18, 2015 Notice to Proceed March 16, 2015 Project Completion August 31, 2015 FISCAL IMPACT The vacant property on the south side of the project was to be developed by Pacific Communities Builders as part of Tract 5053. That development would have constructed the Los Angeles Avenue widening improvements but the development has been delayed. The City is using Los Angeles Avenue Area of Contribution — Fund 2501 for the design and construction of the improvements. There are sufficient funds appropriated for this project in the current FY 2014/15 Capital Improvement Budget. The estimated project costs are shown below. Description Estimated Cost Construction $ 900,000.00 Inspection/Materials Testing $ 136,000.00 Total $ 1,036,000.00 STAFF RECOMMENDATION 1. Terminate the agreement between the City and Sully -Miller Contracting Company for the widening of Los Angeles Avenue between Maureen Lane and Leta Yancy Road. 2. Approve the plans and specifications for the subject project and authorize staff to advertise for construction bids.
