SUBJECT: Consider Authorization of Recordation of the Notice of Completion
for Installation of the Bleachers and Flooring at the Arroyo Vista
Recreation Center (AVRC) and Authorize Release of Payment and
Performance Bonds
BACKGROUND & DISCUSSION
On February 5, 2014, the City Council authorized an Agreement with Irwin Seating
Company, Inc. to replace the Bleachers and Vinyl Composite Tile (VCT) Flooring for
$74,851.00. This included contingency of $9,763.00 for unforeseen circumstances.
There were no change orders for this project. Irwin Seating Company, Inc. has
satisfactorily completed all the work and staff is requesting that the City Council
authorize the recordation of the Notice of Completion. The recordation of the Notice of
Completion starts the timeline for exoneration of the payment and performance bonds
associated with the project:
• Bond for Faithful Performance, Western Surety Company, Bond # 929-584-
885 — null and void one (1) year after date of recordation of notice of
completion by the City of completed work.
• Bond for Material Suppliers and Laborers, Western Surety Company, Bond
# 929-584-885 — release six (6) months after the date of recordation of the
notice of completionand only with the City's written permission.
Upon recordation of the Notice of Completion, the City Clerk will be authorized to release
the bonds in accordance with the bond documents as outlined above.
FISCAL IMPACT
There is no fiscal impact.
STAFF RECOMMENDATION
1. Authorize the City Clerk to file the Notice of Completion, and
2. Authorize release of the project bonds as outlined in the staff report.

NOTICE OF COMPLETION
Notice pursuant to Civil Code Section 9204 must be filed on or within 15 days after the date of completion of a work of
improvement. Civil Code Section 9200 provides that completion of a work of improvement occurs at the earliest of
(a) acceptance of the work of improvement by the public entity or (b) cessation of labor on the work of improvement for a
continuous period of 60 days.

Inc., 61 O E. Cumberland Road, Altamont, IL, 62411 Attn: Rusty Conner, Vice President
The date of the contract was: April 17, 2014
6. The name and address of the surety, if any, was: Western Surety Company, 100 S. Reid Street, #300, Sioux

7. The name and address of the construction lender, if any, for such work of improvement was: NONE
