Home My WebLink AboutRES CC 2015 3375 2015 0318 RESOLUTION NO. 2015-3375 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO. 2004-2228, FINDING AND DECLARING CERTAIN PARKING FACILITIES SUBJECT TO CERTAIN PROVISIONS OF THE CALIFORNIA VEHICLE CODE (CVC) AND ESTABLISHING PARKING RESTRICTIONS IN CITY PARKS WHEREAS, CVC Section 21113 provides that all provisions of the CVC relating to traffic upon the highways shall be applicable to the traffic upon driveways, paths, parking facilities, or grounds of the City so long as the City Council, at a meeting open to the public, determines that the use of vehicles or animals on the property should be prohibited or regulated; and WHEREAS, Section 22519 of the California Vehicle Code provides for the regulation of parking in any publicly-owned off-street parking facility; and WHEREAS, oversized vehicle parking shall also be restricted at City parks; and WHEREAS, oversized vehicles shall mean any vehicle, as defined by Section 670 of the CVC, or combination of vehicles, which exceeds nineteen (19) feet in length, seven (7) feet in width, or eight (8) feet in height, exclusive of projecting lights or devices allowed by Section 35109, 35110, or 35112 of the CVC, as may be amended; and WHEREAS, the City Council adopted Resolution No. 2004-2228, establishing parking restrictions in certain City park parking lots; and WHEREAS, the City Council Resolution No. 2004-2228 shall be rescinded and replaced with the revised parking restrictions; and WHEREAS, on March 18, 2015, a staff report was presented to the City Council requesting approval of this matter to enforce the CVC in the parking lots at the City Parks outlined in this resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1 . The City Council rescinds Resolution No. 2004-2228, establishing parking restrictions in certain City park parking lots. SECTION 2. That the parking facilities open to the general public, located at the following City parks, shall be subject to the provisions of the CVC pursuant to CVC Section 21113: Resolution No. 2015-3375 Page 2 Arroyo Vista Community Park, 4550 Tierra Rejada Road College View Park, 15400 Campus Park Drive Country Trail Park, 117011/2 Mountain Trail Street Mammoth Highlands Park, 7000 Elk Run Loop Miller Park, 4530 Miller Parkway Monte Vista Park, 4201 Spring Road Mountain Meadows Park, 4350 Mountain Meadows Drive Peach Hill Park, 13200 Peach Hill Road Poindexter Park, 500 Poindexter Avenue Tierra Rejada Park, 11900 Mountain Trail Street Villa Campesina Park, 4704 Leta Yancy Road SECTION 3. The parking of vehicles is hereby prohibited between the hours of 10:00 p.m. and 6:00 a.m. in the parking lots for the following parks pursuant to CVC Section 22519 and Moorpark Municipal Code Section 12.16.210: Arroyo Vista Community Park, 4550 Tierra Rejada Road College View Park, 15400 Campus Park Drive Mammoth Highlands Park, 7000 Elk Run Loop Miller Park, 4530 Miller Parkway Mountain Meadows Park, 4350 Mountain Meadows Drive Peach Hill Park, 13200 Peach Hill Road Poindexter Park, 500 Poindexter Avenue Tierra Rejada Park, 11900 Mountain Trail Street SECTION 4. The parking of vehicles is hereby prohibited between the hours of 8:00 p.m. and 6:00 a.m. in the parking lots for the following parks pursuant to CVC Section 22519 and Moorpark Municipal Code Section 12.16.210: Country Trail Park, 117011/2 Mountain Trail Street Monte Vista Park, 4201 Spring Road Villa Campesina Park, 4704 Leta Yancy Road SECTION 5. An additional parking restriction shall apply to the west parking lot (adjacent to Mountain Trail Street) at Tierra Rejada Park as follows pursuant to CVC Section 22519 and Moorpark Municipal Code Section 12.16.210: Parking shall be restricted to 2-hour parking between the hours of 7:00 a.m. and 3:00 p.m., Monday through Friday. SECTION 6. "NO OVERSIZED VEHICLE PARKING" zones are hereby established at all City park parking lots with the exception of Parking Lots C and D at Arroyo Vista Community Park, as generally described in Exhibit A, attached hereto and made a part hereof. Resolution No. 2015-3375 Page 3 SECTION 7. That said enforcement shall take effect upon placement of appropriate signs erected in accordance with the requirements of CVC Section 21113 and 22519. SECTION 8. That the City Manager or his designee is hereby directed to have placed and maintained the appropriate signs and/or curb markings giving notice of the enforcement of the CVC and these parking regulations. SECTION 9. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original resolutions.
