SUBJECT: Consider Rescinding Resolution No. 2004-2228 and Establishing
Parking Restrictions at Mammoth Highlands Park and Rescinding
Resolution No. 2012-3118 and Establishing Parking Restrictions at
612 Spring Road (Ruben Castro Human Services Center) and
Establish New Parking Regulations for the Parking Lot at 798
Moorpark Avenue
BACKGROUND/DISCUSSION
Staff is recommending rescinding Resolution No. 2004-2228 and adopting a new
resolution to subject all City parks to enforcement of the California Vehicle Code (CVC),
establish parking restrictions at Mammoth Highlands Park, and modify parking
restrictions at Country Trail, Monte Vista, and Villa Campesina parks to be consistent
with Section 12.15.020 of the Moorpark Municipal Code (MMC). As the property owner
of all City Parks, the City Council is being asked to consider declaring the parking
facilities at all City parks outlined in the Resolution subject to the provisions of the CVC.
This will enable Police and Public Officers to enforce the CVC within and upon the
parking lots on behalf of the City. Both Sections 21107.8 of the CVC and Section
10.08.010.6 of the MMC provide for the enforcement of certain portions of the CVC on
privately maintained parking facilities generally held open for public use, including those
owned and maintained by the City, when designated by City Council resolution. The
only portions of the CVC which can be enforced within a parking lot are: Section 22350
(Basic Speed Law), Section 23103 (Reckless Driving), Section 23109 (Speed
Contests), and Division 16.5 [Section 38000 et seq.] (Off-road Vehicles). MMC Section
12.15.020 states that parks without lighted facilities shall be closed from sunset to 6:00
a.m. and that parks with lighted facilities shall be closed between 10:00 p.m and 6:00
a.m. CVC Section 22519, allows the City, by resolution, to restrict parking at publicly-
owned off-street parking facilities. For the purposes of parking restriction, the Resolution
will prohibit parking at parks without lighted facilities between the hours of 8:00 p.m and
6:00 a.m. and will prohibit parking at the parks with lighted facilities between the hours
of 10:00 p.m. and 6:00 a.m. The resolution will maintain the additional restriction at the

west parking lot of Tierra Rejada Park which restricts parking to 2-hour parking between
the hours of 7:00 a.m. and 3:00 p.m., Monday through Friday.
Staff is also recommending rescinding Resolution No. 2012-3118 and adopting a new
resolution in order to modify the parking restrictions at the Ruben Castro Human
Services Center (RCHSC). Currently, the parking lot at the RCHSC has overnight
parking restricted between the hours of 10:00 p.m. and 6:00 a.m. and is subject to
enforcement of California Vehicle Code (CVC) Sections 22350 (Basic Speed Laws),
23103 (Reckless Driving), 23109 (Speed Contests) and Division 16.5, Section 38000 et
seq. (Off-Road Vehicles). Staff is proposing to maintain enforcement of the CVC,
change the overnight parking prohibition to between the hours of 12:00 a.m. and 6:00
a.m. due to janitorial work that extends beyond 10:00 p.m., and add parking by permit-
only in designated parking spaces reserved for each tenant. Staff has received multiple
phone calls from the tenants at the RCHSC regarding parking concerns. Patrons
visiting the RCHSC, as well as employees and patrons of businesses located on Flinn
Avenue and Minor Street, have been parking in the spaces reserved for tenants. The
reserved spaces at RCHSC are included in the respective lease agreement for each
tenant. Once adopted, parking permits would be issued to each tenant based on the
number of employees or authorized personnel they wish to allow access to the reserved
parking spaces. The tenant would be responsible for assigning individual permits to
their staff.
As mentioned above CVC Section 22519, allows the City, by resolution, to restrict
parking at publicly-owned off-street parking facilities. The City, acting as the Successor
Housing Agency of the Redevelopment Agency of the City of Moorpark, owns and
currently leases the property at 798 Moorpark Avenue to the Boys and Girls Club for
administrative office space. Staff has received notice from the tenant that they have had
difficulty with residents from the neighborhood parking their cars in the parking lot
overnight. Currently, there are no parking restrictions in this parking lot. The City
Council is being asked to adopt a resolution establishing parking restrictions at 798
Moorpark Avenue that would prohibit overnight parking between the hours of 10:00 p.m.
and 6:00 a.m.
The proposed resolutions also direct the City Manager to have placed and maintained
the appropriate signs and/or curb markings giving notice of the parking regulations.
FISCAL IMPACT
The City will install and maintain the signs at the City Parks and the RCHSC, as well as,
issue the permits to the tenants. The cost to purchase and install the signs is estimated
to be approximately $6,000, and the permits are estimated to cost $250.
The City will absorb the cost of installing the parking signs at 798 Moorpark Avenue.

The tenant will be required to maintain the signs after the initial installation. The cost to
install the signs is approximately $100.
There is sufficient funding in the facilities and parks maintenance budgets to fund this
work.
STAFF RECOMMENDATION
1. Adopt Resolution No. 2015- , adopting enforcement of the California Vehicle
Code and restricting overnight parking in City Parks, and rescinding Resolution No.
2004-2228; and
2. Adopt Resolution No. 2015- , establishing permit-only parking at the Ruben
Castro Human Services Center and rescinding Resolution No. 2012-3118; and
3. Adopt Resolution No. 2015- , restricting parking at 798 Moorpark Avenue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO.
2004-2228, FINDING AND DECLARING CERTAIN PARKING
FACILITIES SUBJECT TO CERTAIN PROVISIONS OF THE
CALIFORNIA VEHICLE CODE (CVC) AND ESTABLISHING
PARKING RESTRICTIONS IN CITY PARKS
WHEREAS, CVC Section 21107.8 provides for the enforcement of CVC Sections
22350 (Basic Speed Law), 23103 (Reckless Driving), 23109 (Speed Contests) and
Division 16.5, Section 38000 et seq. (Off-Road Vehicles), upon privately owned and
maintained off-street parking facilities generally held open for use by the public for
vehicular parking; and
WHEREAS, Municipal Code Section 10.08.010.B provides that certain off-street
parking facilities, including those owned and maintained by the City, which are generally
held open for use by the public for purposes of vehicular parking, are subject to
California Vehicle Code Sections 22350, 23103, 23109, and the provisions of Division
16.5 (commencing with Section 38000) of the California Vehicle Code when designated
as such by City Council Resolution and provided that the owner or operator has caused
to be posted in a conspicuous place at each entrance to that off-street parking facility a
notice as required by the CVC; and
WHEREAS, Section 22519 of the California Vehicle Code provides for the
regulation of parking in any publicly-owned off-street parking facility; and
WHEREAS, the City Council adopted Resolution No. 2004-2228, establishing
parking restrictions in certain City park parking lots; and
WHEREAS, the City Council Resolution No. 2004-2228 shall be rescinded and
replaced with the revised parking restrictions; and
WHEREAS, on March 18, 2015, a staff report was presented to the City Council
requesting approval of this matter to enforce the CVC in the parking lots at the City
Parks outlined in this resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council rescinds Resolution No. 2004-2228, establishing
parking restrictions in certain City park parking lots.

SECTION 2. That the parking facilities open to the general public, located at the
following City parks, shall be subject to the provisions of the CVC Sections 22350,
23103, 23109, and Division 16.5 (Section 38000 et seq):

SECTION 6. That said enforcement shall take effect upon placement of
appropriate signs erected in accordance with the requirements of CVC Section
.21107.8(b).

placed and maintained the appropriate signs and/or curb markings giving notice of the

regulation of parking in any publicly-owned off-street parking facility; and
WHEREAS, the City Council adopted Resolution No. 2012-3118, establishing
enforcement of certain sections of the CVC ; and
WHEREAS, the City Council Resolution No. 2012-3118 shall be rescinded and
replaced with the revised resolutuion; and
WHEREAS, on March 18, 2015, a staff report was presented to the City Council
requesting approval of this matter to enforce the CVC in the parking lots at the RCHSC.

DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the parking facilities open to the general public, located upon
the property of the Ruben Castro Human Services Center, 612 Spring Road, shall be
subject to the provisions of CVC Section 22350, 23103, 23109, and Division 16.5
(Section 38000 et seq.).
SECTION 2. That overnight parking shall be prohibited between the hours of
12:00 a.m. and 6:00 a.m..
SECTION 3. Parking by permit only zones shall be established based on the
tenants assigned spaces, as shown in Exhibit A, and parking permits will be distributed
to the tenants by the City based on the quantity requested by the tenant.
SECTION 4. That said enforcement shall take effect upon pacement of
appropriate signs erected in accordance with the requirements of CVC Section
21107.8(b).
SECTION 5. That the City Manager or his designee is hereby directed to have
placed and maintained the appropriate signs and/or curb markings giving notice of
these parking regulations.
SECTION 6. The City Clerk shall certify to the adoption of the resolution and

RESTRICTIONS FOR THE PARKING LOT AT 798 MOORPARK
AVENUE
WHEREAS, the Redevelopment Agency of the City of Moorpark (Agency)
purchased 798 Moorpark Avenue for affordable housing purposes; and
WHEREAS, upon the dissolution of the Agency, the City of Moorpark took over
the housing responsibilities of the Agency and the property at 798 Moorpark Avenue
was subsequently transferred to the City; and
WHEREAS, the City, acting as the Successor Housing Agency of the
Redevelopment Agency of the City of Moorpark, currently owns and leases the property
to the Boys and Girls Club ("Tenant"); and
WHEREAS, the Tenant has had neighborhood residents parking in their parking
lot and has requested that parking restrictions be adopted to curb overnight use of the
parking lot by the residents; and
WHEREAS, Section 22519 of the California Vehicle Code provides for the
regulation of parking in any publicly-owned off-street parking facility.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:

WHEREAS, CVC Section 21113 provides that all provisions of the CVC relating
to traffic upon the highways shall be applicable to the traffic upon driveways, paths,
parking facilities, or grounds of the City so long as the City Council, at a meeting open
to the public, determines that the use of vehicles or animals on the property should be
prohibited or regulated ; and
WHEREAS, Section 22519 of the California Vehicle Code provides for the
regulation of parking in any publicly-owned off-street parking facility; and
WHEREAS, oversized vehicle parking shall also be restricted at City parks; and
WHEREAS, oversized vehicles shall mean any vehicle, as defined by Section
670 of the CVC, or combination of vehicles, which exceeds nineteen (19) feet in length,
seven (7) feet in width, or eight (8) feet in height, exclusive of projecting lights or
devices allowed by Section 35109, 35110, or 35112 of the CVC, as may be amended;
and
WHEREAS, the City Council adopted Resolution No. 2004-2228, establishing
parking restrictions in certain City park parking lots; and
WHEREAS, the City Council Resolution No. 2004-2228 shall be rescinded and
replaced with the revised parking restrictions; and
WHEREAS, on March 18, 2015, a staff report was presented to the City Council

regulation of parking in any publicly-owned off-street parking facility; and
WHEREAS, oversized vehicle parking shall also be restricted at Ruben Castro
Human Services Center; and
WHEREAS, oversized vehicles shall mean any vehicle, as defined by Section
670 of the CVC, or combination of vehicles, which exceeds nineteen (19) feet in length,
seven (7) feet in width, or eight (8) feet in height, exclusive of projecting lights or
devices allowed by Section 35109, 35110, or 35112 of the CVC, as may be amended;
and
WHEREAS, the City Council adopted Resolution No. 2012-3118, establishing
enforcement of certain sections of the CVC ; and
WHEREAS, the City Council Resolution No. 2012-3118 shall be rescinded and
replaced with the revised resolution; and
WHEREAS, on March 18, 2015, a staff report was presented to the City Council
requesting approval of this matter to enforce the CVC in the parking lots at the RCHSC.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 1 . That the parking facilities open to the general public, located upon
the property of the Ruben Castro Human Services Center, 612 Spring Road, shall be
subject to the provisions of the CVC pursuant to CVC Section 21113 and 22519.
SECTION 2. That overnight parking shall be prohibited between the hours of
12:00 a.m. and 6:00 a.m. at the Ruben Castro Human Services Center, 612 Spring
Road.
SECTION 3. Parking by permit only zones shall be established at the Ruben
Castro Human Services Center, 612 Spring Road, based on the tenants assigned
spaces, as shown in Exhibit A, and parking permits will be distributed to the tenants by
the City based on the quantity requested by the tenant.
SECTION 4. "NO OVERSIZED VEHICLE PARKING" is hereby established at
the Ruben Castro Human Services Center, 612 Spring Road.
SECTION 5. That said enforcement shall take effect upon placement of
appropriate signs erected in accordance with the requirements of CVC Section 21113
and 22519.
SECTION 6. That the City Manager or his designee is hereby directed to have
placed and maintained the appropriate signs and/or curb markings giving notice of
these parking regulations.
SECTION 7. The City Clerk shall certify to the adoption of the resolution and
shall cause a certified resolution to be filed in the book of original resolutions.
