Moe II, Economic Development and Housing Manager v- Prepared By: John Brand, Senior Management Analyst 9S DATE: April 28, 2005 (CC Meeting of May 6, 2015) U� SUBJECT: Consider Ordinance Amending Section 6.16.030, Licensing Period of Chapter 6.16, Licensing of Dogs and Cats of Title 6,Animal Regulations of the Moorpark Municipal Code SUMMARY If approved, this ordinance amends the Moorpark Municipal Code Title 6, Animal Regulations (Animal Regulations), to match a proposed resolution of the City Council to provide for animal license terms that are consistent with the term of rabies vaccinations, up to three (3) years. BACKGROUND In 1983, the City adopted the Ventura County Animal Regulations Ordinance as its own. From time to time since then, various chapters of the ordinance were revised, amended, or replaced. The last revision to the Animal Regulations Ordinance was in 2005. Animal Regulations Section 6.16.030 Licensing Period stipulates that a license period must be a minimum of one (1) year and not more than two (2) years. 6.16.030 Licensing Period. A. The period of time any license issued pursuant to this chapter is valid must be specified on the license application. B. The license period specified may be whatever period the city or its authorized agent may select for that particular license application;provided, however, that the period is not to be less than one(1)year nor more than two(2)years from the date the license is issued; and provided further, that the period does not extend beyond the expiration date of the applicable rabies vaccination. A license and corresponding license tag ceases to be current when the applicable license period expires. 39 Title 6—Animal Ordinance CC Meeting of May 6, 2015 Page 2 While a pet's first rabies vaccination has a one (1) year duration, all subsequent vaccination in the pet's lifetime have a three (3) year duration. DISCUSSION The proposed change is to allow the term of a pet license and a rabies vaccination to coincide for the convenience of pet owners and to provide for more efficient operation of the pet licensing program. It will also allow pro-rated payment of license fees for term of six months to three years, at the option of the pet owner. It is believed that the pet owning public may find it easier to keep pet licenses up to date when the terms of the license and that of the rabies vaccination are more closely synchronized. Staff recommends the proposed revision to the Animal Regulations in order to implement a more flexible and convenient pet licensing process. The City Attorney has reviewed and approved the ordinance. FISCAL IMPACT No fiscal impact. STAFF RECOMMENDATION Introduce Ordinance No. for first reading, waive full reading, and place this ordinance on the agenda for the May 20, 2015 regular meeting, for the purpose of providing second reading and adoption of the ordinance. AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 6.16.030, LICENSING PERIOD OF CHAPTER 6.16, LICENSING OF DOGS AND CATS OF TITLE 6, ANIMAL REGULATIONS OF THE MOORPARK MUNICIPAL CODE WHEREAS, in 1983, the City Council adopted Moorpark Municipal Code Title 6 Animal Regulations; and WHEREAS, state law proscribes that the term of an animal license may not extend beyond the term of the animal's rabies vaccination; and WHEREAS, the term of a rabies vaccination may be as long as three years; and WHEREAS, the term of a City of Moorpark animal license is no longer than two (2) years; and WHEREAS, it is a priority of the City Council to provide convenient and cost effective service to the public whenever possible; and WHEREAS, the City Council wishes to update its Animal Regulations Ordinance to permit closer coordination of the term for a rabies vaccination and a City animal license. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. Section 6.16.030 License Period, of the Moorpark Municipal Code is hereby amended in its entirety to read as shown: 6.16.030 Licensing period. A. The period of time any license issued pursuant to this chapter is valid must be specified on the license application. B. The license period specified may be whatever period the city council may adopt by Resolution for that particular license application, provided that the period does not extend beyond the expiration date of the applicable rabies vaccination. A license and corresponding license tag cease to be current when the applicable license period expires. 41 Ordinance No. Page 2 SECTION 2. If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 3. This Ordinance shall become effective thirty (30) days after its passage and adoption. SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall publish notice of adoption in the manner required by law.
