Richards, Director of Conum ity Development DATE: January 31, 1990 (CC meeting of 2/7/90) SUBJECT: TRACT 3963/PD-1041 GRIFFIN HOMES — MINOR NIDDIFICIATON NO. 8 IM ��.. •1 Planned Development Permit No. 1041 and Tract 3963 were approved for a total of 484 units to be completed in four phases. Condition No. 63 of Tract 3963 (see attachment) required certain levels of traffic service be maintained on Los Angeles Avenue or no Zone Clearance would be granted past the 281st unit. On December 11, 1989 Griffin Hordes filed a request for Zoning Clearance for 44 homes in Phase IV and the remaining 3 homes in Phase I. Discussion The City Engineer's office had identified that the current Level of Service for Los Angeles Avenue between Princeton Avenue and High Street is below a "C" level of service at this time. This has caused Condition No. 63 to be invoked. The total number of units by phase with the number occupied and remaining is listed below. Richards, Director of Community Development DATE: January 31, 1990 (CC meeting of 2/7/90) SUBJECT: TRACT 3963/PD-1041 GRIFFIN HOMES - MINOR NDDIFICIATON NO. 8 Page -2- At this time, a total of 348 Zone Clearances have been issued. This is 69 over what should have been approved inasmuch as the level of traffic service is higher than that allowed under Condition No. 63. The error in issuance of Zone Clearance was caused by a lack of information at the time of condition compliance review from the City Engineer's office. In order that the traffic level identified under Condition No. 63 be mitigated, Griffin Hanes has agreed to pay the City an amount of $3,000 per dwelling unit. This traffic mitigation amount will be paid for 129 remaining "market priced" units and not for the 5 "affordable" set aside units. This Minor Modificiaton will amend Condition No. 63 of Tract 3963 to allow the issuance of Zone Clearance by providing a payment to the City's Citywide Traffic Mitigation Fund. The Director of Ccem[mulity Development has reviewed the proposed modifications and intends to approve it. Pursuant to Resolution No. 88-523 the Director has the authority to approve Minor Modifications. This matter is being presented to the council as a courtesy. In the event the Council wishes to appeal the Director's decision, it may do so. Should the Council decide to appeal, it should set the matter for a public hearing. Prior to issuance of the certificate of occupancy for the first unit of the project, the developer shall deposit $200,000.00 with the City to be placed in a separate fund for the purpose of study- ing and improving an alternate route to existing Los Angeles Avenue. The use of these funds shall include, but not be limited to, alignment studies, environmental review, slope analyses, area of benefit/ contribution determinations, traffic projections, design and engineering including the Arroyo Simi bridge(s), financ- ing and right-of-way alternatives. Any of the $200,000.00 paid by the developer but not used for studying or improving an alternate route to existing Los Angeles Avenue shall be returned to the developer upon four -fifths (4/5) vote of the City Council not to continue with the study or improvement of said alternate route. 62. That prior to issuance of a certificate of occupancy for the first unit of the project, and following the installation of the signal at the Princeton Avenue_/Los_ Angeles Avenue. (Highway 118) intersection, the developer shall make a directional traffic count on Los Angeles Avenue illighway 118) between Princeton Avenue and College View Avenue, for the morning and afternoon peak hours. Following the issuance of a cp.rti£i- cate of occupancy for the 70th, but prior to the 100th, dwelling unit, a second traffic count shall be made. Following the issuance of a certi- ficate of occupancy for the 1-74th, but prior to the 281st, dwelling unit, a third traffic count shall be made. The purpose of these traffic counts shall be to assist the City in determining the need for a second eastbound lane on Los Angeles Avenue between Princeton Avenue and College View Drive. 63. That prior to the issuance of a zone clearance for the 281st unit of the project, either the City shall have added the fourth (westbound) lane on Los Angeles Avenue between Princeton Avenue and High Street, "or the Highway 23/118 connection shall be made, but not both. However, prior to the issuance of a zone clearance for the 100th and the 281st unit, the developer shall make a directional traffic count at the above loca- tion on Los Angeles Avenue, for the morning and afternoon peak hours, to verify the actual traffic volumes. The purpose of the directional count taken prior to the issuance of the 100th zone clearance is to inform the developer of the potential future need for either installation of the fourth (westbound) lane or the Highway 23/118 connection. If the directional volumes obtained from the count taken prior to the issuance of the 281st zone clearance do not equal or exceed 1130 vehicles per hour per lane,'or 2260 vehicles per hour per direction on the two lane portions, the developer may construct and occupy additional units consistent with Level of Service "C" operation on Los Angeles Avenue between Princeton Avenue and High Street (capacity is considered to be 1880 vehicles per hour per lane, and Level of Service "C" is 60 percent of capacity). If the directional volumes -obtained from the count taken prior to issuance of the zone clearance for the 281st unit equal or exceed the above vehicles per hour (Level of Service "D" or less), then no additional units within the project will be permitted to be con- structed until the fourth (westbound) lane on Los Angeles Avenue between Princeton Avenue and High Street or the Highway 23/118 connection is constructed. 59018B/E-12
