SUBJECT: RESOLUTION INITIALING PROCEEDINGS FOR THE ANNUAL
ASSESSMENTS FOR THE "PARKS MAINTENANCE ASSESSMENT
DISTRICT NO. AD-85-1": AND ORDERING PREPARATION OF
THE ENGINEER'S REPORT
Annual assessments for the :irks Maintenance Assessment District
(AD-85-1) are determined throu,4n the preparation of the Engineer's
Report. This report (which required by State law) evaluates the
benefits received by various asses of properties and spreads the
costs according to an approved qethod of distribution. The estimated
annual maintenance costs and quisite maintenance program are also
part of the report. A copy of the Engineer's Report for the current
year has been previously providf to the Council . This report explains
the method of spread and relate ma .ter Assessments were levied for
the FY89-90 fiscal year. Ass rnr '1, AD-85-1 were not levied in
FY87-88 or FY88-89
After submission of the Eng ' er ' Report, the City Council must
conduct a public hearing in ate Ma> or early June to consider
protests, comments concerning e ':ost. ;, method of spread and other
pertinent matters. The EnginE r' s Report must be approved and the
assessments levied prior to Ju I Under state law, this date may be
extended to no later than the ird Morday in August if authorized by
the County Auditor. At this IN , 'Ai-FT does not foresee a problem
meeting the July 1 date.

The preparation of the Engine^ '' s Report does not compel the City
Council to order the assessmeni Preparation of this report affords
the Council the opportunity to review the proposed parks budget and
maintenance program for FY9O-91 and compare it to the proposed levels
of assessments as part of the ar ua| h'^d:et deliberations.
The cost for preparation of the Engine ' x Report has been included in
the adopted budget for FY89-90 The purnose of the proposed Resolution
is to formally authorize initi. : ior ,f the process and to direct the
City Manager to secure the serr :*` ' qualified engineer to prepare
the necessary Engineer' s Report
As the Council may recall , Dw ,;ht French and Associates submitted a
two-year proposal in 1989 for t'`e preparation of the Engineer' s Report
for AO-85-1. The cost for the FY89-9C report was $3,700 plus direct
expenses. The cost for t°e YqC-H report is $2,900 plus direct
expenses.
The FY89-90 budget includes $3 'On for preparation of the Engineer' s
Report for AD-89-1 for FY9O-91
STAFF RECOMMENDATIONS
1. Adopt Resolution No. 9O- initiating Proceedings for AO-85-1
and Ordering Preparation , f Eng nee- ' s Report.
2. Authorize the City Manager o secure the services of Dwight French
and Associates to prepare the Engineer' s Report for the Parks
Maintenance Assessment Di - /-ict (4D-85-1) at a cost not to exceed
$3,700. Any cost above /O') w` 1 ' require prior approval of the
City Council .

POR THE ANNUAL ASSESSMENTS FOR THE "PARKS
MAINTENANCE ASSESSMENT DISTRICT NO. AD-85-1"
FOR THE FISCAL YEAR ';OMMENCING JULY 1, 1990
AND ENDING JUNE 30. AND ORDERING THE
ENGINEER TO PREPARE `ND RILE A REPORT IN
ACCORDANCE THEREWlrF
WHEREAS, pursuant to the prov lots of the "Landscaping and Lighting
Act of 1972r, being Division 15, Port of the Streets and Highways Code
of the State of California, the City Council of the City of Moorpark, by
its Resolution No. 85-206, adopted June 17, 1985, ordered formed the
"Parks Maintenance Assessment Dist-ict No. 8D-85-1«, and confirmed and
levied the assessments approved th,erehy [nr the fiscal year commencing
July 1, 1985 and ending June 30, Y986; and has confirmed and levied the
assessments approved thereunder fueach subsequent fiscal year, except
the fiscal years commencing July , ]987 and ending June 30, 1988 and
commencing July 1, 1988 and endino ure 3r. 1989.
WHEREAS, the City Council ot :ity of Moorpark proposes to extend
the improvements specified in said /i»trict for the fiscal year commencing
July 1, 1990 and ending June 30, 991 pursuant to the "Landscaping and
Lighting Act of 1972°. being Div sinn | i Part 2 of the Streets and
Highways Code of the State of Cal ^
NOW, THEREFORE, the City Council of the City of Moorpark,
California, does hereby resnlve, dr- ermine and order as follows:
SECTION 1: Pursuant to Seci on 22585, et seq. , of the Streets and
Highways Code (the "Landscaping ar Lighting Act of 1972'/), it is hereby
proposed to extend the annual ass, sments levied under "Parks Maintenance
Assessment District No. AD-85-1" ol the City of Moorpark, so as to
continue, for the fiscal year camm '`c ',O w~ th July I. 1990 and ending June
30, 1991, to provide for main, 'nan:~ +nd improvement of parks and
recreational facilities within -,h~ i^y
SECTION 2: The assessment proposed to be levied and collected
shall be used for the mairtr' ince and improvements of parks and
recreational facilities within -.ho i ` >
SECTION 3: To ensure that t e costs and expenses of maintaining and
improving the parks and recrea. onal facilities within the City as
specified hereinabove are borne .y ...he owners of the property to be
benefitted thereby, this Cnun' resolves that the proposed parks
maintenance assessment district .r rf all property within the City.
SECTION 4: The distinctive lesignation for the assessment district
to be extended pursuant to this V^ 1)l//cinn shall remain "Parks Maintenance
Assessment District No. AD-85-1"

SECTION 5: The City Manager I directed to cause to be prepared an
Engineer' s Report, in accordance w th Article 4, Chapter 1, Part . 2,
Division 15 of the said Streets and Highways Code; and that upon
completion, the report shall be filed with the City Clerk, who shall then
submit the same to the City Counci fn, t consideration, pursuant to
Section 22586 of said Street and High,,,ays Cock .
