HARE City Clerk City Treasurer MEMOPANDUM TO: The Honorable City council FROM: Susan Cauldwell, Administrative Assistan DATE: January 26, 1990 SUBJECT: RESOLUTION INTITIATING PROCEEDINGS FOR THE ANNUAL ASSESSMENTS FOR THE "MOORPARK LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. AD-84-2"; AND ORDERING PREPARATION OF THE FNGINEER'S REPORT Annual assessments for the L 4hting and Landscaping Maintenance District (AD-48-2) are determir.-d through the preparation of the Engineer's Report. This repori (which is required by State law) evaluates the benefits received y various classes of properties and spreads the costs according to an approved method of distribution. The estimated annual maintenance cos- s and requisite maintenance program are also part of the report. A opy of the Engineer's Report for the current year has been previously rovided to the Council. This report explains the method of spread and related matters. The Landscaping and Lighting District has been funded -ach year since its inception in 1984. After submission of the Engine-r' , Report, the City Council must conduct a public hearing in lite May or early June to consider protests, comments concerning th, costs, method of spread and other pertinent matters. The Engirree ' s Report must be approved and the assessments levied prior to July Jnder state law, this date may be extended to no later than the th ,c1 Monday in August if authorized by the County Auditor. As the Council may recall, Dwigh- French and Associates submitted a two-year proposal in 1989 for the preparation of the Engineer' s Report for AD-84-2. The cost for the F"89-90 report was $3,700 plus direct expenses. The cost for the :- 41-91 report is $2,900 plus direct expenses. AD-84-2" FOR THE FISCAL YEAR COMMENCING JULY 1, I990, AND ENDING JUNE 30. 1901. AND ORDERING THE ENGINEER TO PRE`ARE AND ;ILE A REPORT IN ACCORDANCE THEREWIT WHEREAS, pursuant to the prov sions of the "Landscaping and Lighting Act of 1972'/, being Division 15, P' 't ? of the Streets and Highways Code of the State of California, the Ci '; Council of the City of Moorpark, by its Resolution No. 84-88, adopted °ay iG, :984, ordered the formation of the "Moorpark Lighting Maintenance Assessment District No. AD-84-2"; confirmed and levied the assensmen.s approved thereunder for the fiscal year commencing July 1, 1984 and ending June 30, 1985; and has confirmed and levied the assessments approve' txpreurier for each subsequent fiscal year. WHEREAS, the City Council of ne City of Moorpark proposes to extend the improvements specified in said iiot~ict for the fiscal year commencing July 1, 1990 and ending June 30, 991 pursuant to the "Landscaping and Lighting Act of 1972", being Div sim' Part 2 of the Streets and Highways Code of the State of Calif -n�... SECTION 4: The distinctive designation for the assessment district to be continued pursuant to this ' esolution shall be "Moorpark Lighting and Landscaping Maintenance Assessm. nt. ['istrict No. AD-84-2". SECTION 5: The City Manager s directed to cause to be prepared an Engineer's Report, in accordance 4ith Article 4, Chapter 1, Part 2, Division 15 of said Streets and Hiihways Code; and that upon completion, the report shall be filed with the :ity Clerk, who shall then submit the same to the City Council for its c „s;deration, pursuant to Section 22586 of said Streets and Highways Code SECTION 6: The City Clerk 7a} certify to the adoption of this resolution.
